Unique Product definition

Unique Product means Product that is unique in nature, customer-specific to HP and cannot be resold by Supplier to customers other than HP without major modification.
Unique Product is defined in Section 3.1 of this Agreement.
Unique Product means: A Product that is not a Common Product and that has been demonstrated with supportive experimental data to be biologically different from any Common Product (i) [ * ], (ii) [ * ], and (iii) for use in [ * ] with any Common Product. The parties may add a Unique Product to the definition of Common Product by amendment to this Agreement. For the avoidance of doubt, a Unique Product, upon becoming a Common Product, shall cease to be a Unique Product.

Examples of Unique Product in a sentence

  • If Customer fails to order the Annual Volume Commitment or any Unique Product Volume as set forth on Exhibit B, Customer shall be required to pay Supplier an amount equal to the difference between Customer’s annual purchase amount for each Unique Product Volume and the total annual value of the applicable Unique Product Volume.

  • Seller will use commercially reasonable efforts to timely issue purchase orders for Buyer Unique Product which Seller has agreed to purchase hereunder; provided Buyer is fully in compliance with Buyer’s obligations under this Agreement.

Related to Unique Product

  • New Product means the Synology-branded hardware product and Synology-branded accessories contained in the original packaging Customer bought from an authorized Synology distributor or reseller. You may see our “New Product” at Product Support Status.

  • Software Product means any COTS which you propose to provide pursuant to the contract.

  • Product means any deliverable under the Contract, which may include commodities, services, technology or software.
