Unpredictable Contingent Event Benefit definition

Unpredictable Contingent Event Benefit means a benefit payable solely by reason of an Unpredictable Contingent Event.”
Unpredictable Contingent Event Benefit means an “unpredictable contingent event benefit” as defined in Code Section 436(b)(3) and Section 1.436-1(j)(9) of the Treasury Regulations.”
Unpredictable Contingent Event Benefit means any benefit or increase in benefits to the extent the benefit or increase would not be payable but for the occurrence of an Unpredictable Contingent Event.

Examples of Unpredictable Contingent Event Benefit in a sentence

  • Notwithstanding any provisions of the Plan to the contrary, and except as otherwise permitted by Code Sections 436(b)(2), the Plan shall not provide any Participant with an Unpredictable Contingent Event Benefit with respect to an Unpredictable Contingent Event occurring during a Plan Year if the AFTAP for such Plan Year is less than 60 percent (or the AFTAP would be less than 60 percent as a result of payment of such Unpredictable Contingent Event benefit).

  • If the Unpredictable Contingent Event Benefit does not become payable during the Plan Year in accordance with the preceding sentence, then the Plan is treated as if it does not provide for that benefit.

  • If the Unpredictable Contingent Event Benefit does not become payable during the same Plan Year in accordance with the preceding sentence, then the Plan is treated as if it does not provide for that benefit.

  • An Unpredictable Contingent Event Benefit payable with respect to an event occurring in a Plan Year may not be provided if the Adjusted Funding Target Attainment Percentage for such Plan Year is less than 60% or would be less than 60% taking into account such occurrence.

  • If a Participant is entitled to an Unpredictable Contingent Event Benefit payable with respect to an event occurring during a Plan Year, such benefit will not be paid or provided if the Plan’s AFTAP for such Plan Year (i) is less than 60%, or (ii) would be less than 60% after taking into account the occurrence of the event with respect to which the Unpredictable Contingent Event Benefit is payable.

  • The definitions in the following Treasury Regulations apply for purposes of Sections 8.3(a) through 8.3(g): Section 1.436-1(j)(1) defining Adjusted Funding Target Attainment Percentage; Section 1.436-1(j)(2) defining Annuity Starting Date; Section 1.436-1(j)(6) defining Prohibited Payment; Section 1.436-1(j)(8) defining Section 436 Measurement Date; and Section 1.436-1(j)(9) defining an Unpredictable Contingent Event and an Unpredictable Contingent Event Benefit.

  • No unpredictable contingent event benefit otherwise payable under the Plan shall be paid during a Plan Year if the Plan’s AFTAP for the Plan Year is less than 60 percent (or would be less than 60 percent taking into account the Unpredictable Contingent Event Benefit).

More Definitions of Unpredictable Contingent Event Benefit

Unpredictable Contingent Event Benefit means any benefit or increase in benefits to the extent the benefit or increase would not be payable but for the occurrence of an Unpredictable Contingent Event. For this purpose, “Unpredictable Contingent Event” shall mean a plant shutdown (whether full or partial) or similar event, or an event (including the absence of an event) other than the attainment of any age, performance of any service, receipt or derivation of any compensation, or the occurrence of death or disability.
Unpredictable Contingent Event Benefit means any benefit payable on account of: (i) plant shutdown or similar event (whether full or partial), or (ii) any event (including the absence of an event) other than attainment of an age, performance of service, receipt or derivation of compensation, or occurrence of death or disability.
Unpredictable Contingent Event Benefit means any benefit payable solely by reason of:
Unpredictable Contingent Event Benefit means any benefit payable solely by reason of (i) a plant shutdown (or other event determined by the Secretary of Treasury to be similar to a plant shutdown); or (ii) an event other than the attainment of any age, performance of any service, receipt or derivation of any compensation, or occurrence of death or disability.

  • Foreign Benefit Event means, with respect to any Foreign Pension Plan, (a) the existence of unfunded liabilities in excess of the amount permitted under any applicable Law or in excess of the amount that would be permitted absent a waiver from applicable Governmental Authority or (b) the failure to make the required contributions or payments, under any applicable Law, on or before the due date for such contributions or payments.

  • Optimal Adjustment Event With respect to any Class of Class B Certificates and any Distribution Date, an Optimal Adjustment Event will occur with respect to such Class if: (i) the Principal Balance of such Class on the Determination Date succeeding such Distribution Date would have been reduced to zero (regardless of whether such Principal Balance was reduced to zero as a result of principal distribution or the allocation of Realized Losses) and (ii) (a) the Principal Balance of any Class of Class A Certificates would be subject to further reduction as a result of the third or fifth sentences of the definition of Principal Balance or (b) the Principal Balance of a Class of Class B Certificates with a lower numerical designation would be reduced with respect to such Distribution Date as a result of the application of clause (ii) of the definition of Class B-1 Principal Balance, Class B-2 Principal Balance, Class B-3 Principal Balance, Class B-4 Principal Balance, Class B-5 Principal Balance or Class B-6 Principal Balance.

  • Potential Amortization Event means any occurrence or event which, with the giving of notice, the passage of time or both, would constitute an Amortization Event.

  • Potential Adjustment Event means any of the following:

  • Maximum Potential Additional Dividend Liability, as of any Valuation Date, means the aggregate amount of Additional Dividends that would be due if the Corporation were to make Retroactive Taxable Allocations, with respect to any fiscal year, estimated based upon dividends paid and the amount of undistributed realized net capital gains and other taxable income earned by the Corporation, as of the end of the calendar month immediately preceding such Valuation Date and assuming such Additional Dividends are fully taxable.

  • Payment Event means the event or events giving rise to the right to payment of a Performance Award.

  • Expected Final Payment Date means the March 2023 Distribution Date.

  • default value means a value derived from a typical value by the application of pre-determined factors and that may, in circumstances specified in this Directive, be used in place of an actual value;’;

  • Incipient Event of Termination means an event that but for notice or lapse of time or both would constitute an Event of Termination.

  • Reference Interest Rate Transition Event means the occurrence of one or more of the following events with respect to the then-current Reference Interest Rate:

  • Foreign Plan Event with respect to any Foreign Benefit Arrangement or Foreign Plan, (a) the failure to make or, if applicable, accrue in accordance with normal accounting practices, any employer or employee contributions required by applicable law or by the terms of such Foreign Benefit Arrangement or Foreign Plan; (b) the failure to register or loss of good standing with applicable regulatory authorities of any such Foreign Benefit Arrangement or Foreign Plan required to be registered; or (c) the failure of any Foreign Benefit Arrangement or Foreign Plan to comply with any material provisions of applicable law and regulations or with the material terms of such Foreign Benefit Arrangement or Foreign Plan.

  • Servicer Replacement Event means any one or more of the following that shall have occurred and be continuing:

  • Recovered tax increment value means, except as otherwise

  • Value Adjustment Event means, with respect to any Loan Asset, the occurrence of any one or more of the following events after the related Cut-Off Date:

  • Repayment Event means any event or condition which gives the holder of any note, debenture or other evidence of indebtedness (or any person acting on such holder’s behalf) the right to require the repurchase, redemption or repayment of all or a portion of such indebtedness by the Company or any of its subsidiaries.

  • Modification Default Loss means the loss calculated in Exhibits 2a(1)-(3) for single family loans previously modified pursuant to this Single Family Shared-Loss Agreement that subsequently default and result in a foreclosure, short sale or Deficient Loss.

  • Early Amortization Event means the occurrence of any of the following:

  • Rapid Amortization Event has the meaning given to it in Section 5.16.

  • Step Up Event means a failure to meet the Minimum Rating Requirement at any time, unless:

  • Erroneous Payment Return Deficiency has the meaning assigned thereto in Section 10.12(d).

  • Amortization Event has the meaning specified in Article IX.
