VAST SOLAR is not restricted or prohibited, contractually, or otherwise, from entering into and performing each of the terms and covenants contained in this Agreement, nor is VAST SOLAR’s execution and performance of this Agreement a violation or breach of any other agreement to which VAST SOLAR is a party.
Any covenants, stipulations, promises or agreements in this Agreement contained by or on behalf of MSSA or VAST SOLAR shall be for the sole and exclusive benefit of VAST SOLAR or MSSA.
