WHS Law all applicable Laws relating to work health and safety, including the Work Health and Safety Act 2011 (Cth), the WHS Regulations, and any applicable Corresponding WHS Law.
In undertaking any activities under this Agreement, ARENA will not be commissioning any construction projects in connection with the Project or for the purposes of Part 6 of the WHS Regulations.

The Contractor releases and indemnifies Essential Energy from and against any damage, expense, loss, cost, liability or claim by or against Essential Energy arising out of or in connection with a breach by the Contractor of its obligations under this clause 25 or the WHS Act or the WHS Regulations.

Controls are required to meet the requirements of Part 6.3 - Division 3 of the WHS Regulations and are to include, but are not limited to • Receiving of up to date drawings and surveys from the Trust and Authorities; • Dial Before You Dig; • Permit to dig procedures; • Hand digging near live services; • Electronic services scan; and • Providing permanent support for existing services if trenching or excavation crosses the line of the service.
