XXXX Holder definition

XXXX Holder means (i) XXXX, (ii) Xxxx Strategic and (iii) any Person ----------- to whom XXXX or Xxxx Strategic Transfers Registrable Securities (but only to the extent of the Registrable Securities acquired from XXXX or Xxxx Strategic) and, in the case of clause (iii), which Person becomes bound by the provisions of this Agreement in the manner set forth in Section 6.5 hereto.
XXXX Holder means Xxxx XX Investor, LLC, a Colorado limited liability company, and its Permitted Transferees.
XXXX Holder shall have the meaning set forth in the Preamble hereof.

XXXX Holder means, collectively as of a particular time, each Holder that is Xxxx Industries, Inc. or is directly or indirectly controlled by or under common control with Xxxx Industries, Inc., in each case, then-holding a Share, Warrant, Option or Registrable Security.
