  • The Purchaser acknowledges that the Vendors are not and will not be obligated to maintain, alter, modify or improve the Xxxxxx Mine site to allow the Purchaser and its Representatives to access the Xxxxxx Mine site or to conduct any Removal Activity.

  • Mortgage and related documents and instruments related to the Xxxxxx Mine will be delivered within 60 days after the Closing Date.

  • The Purchaser shall be solely responsible for all necessary maintenance and services required at the Xxxxxx Mine site in order to allow the Purchaser to access the Xxxxxx Mine site to conduct the Removal Activities.
