1.8. Objašnjenja i izmjene dokumentacije za nadmetanje / Additional information and modification of tender documentation

Za vrijeme roka za dostavu ponuda gospodarski subjekti mogu zahtijevati dodatne informacije vezane za dokumentaciju za nadmetanje, a Naručitelj će odgovor staviti na raspolaganje na istim mjestima (medijima) na kojima je objavljena Dokumentacija za nadmetanje bez otkrivanja identiteta gospodarskog subjekta.

Pod uvjetom da je zahtjev dostavljen pravodobno, Naručitelj je obvezan odgovor staviti na

raspolaganje najkasnije tijekom drugog (2) dana prije dana u kojem ističe rok za dostavu ponuda.

Zahtjev je pravodoban ako je dostavljen Naručitelju najkasnije tijekom šestog (6) dana prije dana

u kojem ističe rok za dostavu ponuda.

Ako Naručitelj za vrijeme roka za dostavu ponuda mijenja dokumentaciju, osigurat će dostupnost izmjena svim zainteresiranim gospodarskim subjektima na istim mjestima (medijima) na kojima je objavljena osnovna Obavijest o nabavi i Dokumentacija za nadmetanje. Rok za dostavu ponude biti će primjereno produljen ako je rok za dostavu ponude kraći od 8 (osam) dana od dana objave izmjene.

Before expiry of the deadline for submission of tenders, economic operators can request additional information on the tender. Contracting Authority shall make its reply available on the same places (the media) where Procurement Notice and Tender Documentation were published, without disclosing the identity of the economic operator requesting the information.

Provided that such request has been submitted in time, Contracting Authority shall undertake to make the reply available not later than by the second (2nd) day before the expiry of the deadline for submission of tenders.

The request shall be considered timely if it has been submitted to Contracting Authority not later than by the sixth (6th) day before the expiry of the deadline for submission of tenders.

If Contracting Authority modifies the documentation before the expiry of the deadline for submission of tenders, it shall make such modifications available to all the interested economic operators on the same places (the media) where the basic Procurement Notice and Tender Documentation were published. The deadline extension shall be proportional to the relevance of the clarification and shall not less then eight (8) days from the date of clarification publishing.

2. PODACI O PREDMETU NABAVE / SUBJECT OF PROCUREMENT

2.1. Opis predmeta nabave/ Procurement subject description

Predmet nabave je usluga izrade kalupa za prilagodbu i završna testiranja proizvoda sukladno tehničkoj specifikaciji koju sačinjava PRILOG V, te detaljnoj tehničkoj specifikaciji i nacrtima koji će biti Ponuditelju poslani putem elektroničke pošte, a nakon što Ponuditelj Naručitelju dostavi na email adresu (xxxxx.xxxxxxxxx0@xxxxx.xxx) sken potpisane Izjave o čuvanju tajnosti podataka, a koju sačinjava Prilog VI ovog Poziva. Ponuditelj je obavezan upoznati se sa svom tehničkom dokumentacijom, na dokaz čega u sklopu svoje ponude, prilaže Izjavu o čuvanju tajnosti podataka ovjerenu od svoje strane ali i od strane Naručitelja.

The subject of procurement is the service of making molds for customization and final testing of products in accordance with the technical specification provided in ANNEX V, as well as detailed technical specification and blueprints, which will be sent to the Bidder by e-mail, after the Bidder sends to the Contracting authority by email (xxxxx.xxxxxxxxx0@xxxxx.xxx ) a scan of the signed Confidentiality Statement (Annex VI) of this Tender documentation. The Bidder is obliged to familiarize itself with complete technical documentation, and to deliver signed confidentiality statement prooving that facet. The confidetniality statement (Xxxxx XX) has to be signed by the Bidder but also by the Contracting authority.

2.2. Opis i oznaka grupa predmeta nabave / Number and titles of lots:

Predmet nabave nije podijeljen na grupe nabave.

The procurement isn't divided into procurement groups.

2.3. Količina predmeta nabave / Quantities

Količina predmeta nabave je definirana u troškovniku koji je sastani dio Dokumentacije za nadmetanje (Prilog IV Dokumentacije za nadmetanje). Stavke troškovnika ne smiju se mijenjati.

The amount of procurement is defined in Cost estimate that is part of the Tender Documentation (Annex IV of the Tender Documentation). Items of cost estimate should not be changed.

2.4. Tehničke specifikacije

Tehničke specifikacije predmeta nabave definirane su u Prilogu V. Tehničke specifikacije/Opis poslova.

The technical specifications of the procurement are defined in Annex V Technical Specifications, which is an integral part of the Tender Documentation.

2.5. Mjesto isporuke predmeta nabave / Place od delivery:

Kotiška 26, 00000, Xxxxxxxx, Xxxxxxxxx Xxxxxxxx (Croatia).

2.6. Rok isporuke predmeta nabave/ Deadline for delivery

Odabrani ponuditelj obvezuje se isporučiti predmet nabave :

– u roku od 90 dana od potpisa ugovora

Rok isporuke može biti izmijenjen samo uz pisanu suglasnost obje ugovorne strane. Odabrani ponuditelj i Naručitelj imaju pravo na produženje roka isporuke predmeta nabave u sljedećim slučajevima:

- uslijed nastupa više sile, ili

- uslijed mjera predviđenih aktima javnopravnih tijela, ili

- uslijed pisanog zahtjeva Izvršitelja s razlozima produženja i pisanog odobrenja Naručitelja, o čemu će biti sklopljen Dodatak ugovora o nabavi kojim će se regulirati novi dogovoreni rok za isporuku predmeta nabave.

The selected bidder is obliged to deliver the subject of the procurement:

- within 90 days of signing the contract

Delivery time may only be modified with the written consent of both parties. The choosen bidder and the Contracting Authority shall have the right to extend the delivery time of the procurement subject in the following cases:

- due to force majeure, or

- as a result of measures provided for by acts of public bodies, or

- upon written request of the Contractor with the reasons for the extension and the written approval of the Client, what will be concluded in the Supplement to the procurement contract, which will regulate the new agreed deadline for delivery of the subject of procurement.

3. OBAVEZNI RAZLOZI ISKLJUČENJA PONUDITELJA / MANDATORY REASONS FOR THE EXCLUSION OF TENDERS

Gospodarski subjekt biti će isključen iz postupka ukoliko:

- je on ili osoba ovlaštena za njegovo zakonsko zastupanje pravomoćno osuđena za kazneno djelo sudjelovanje u zločinačkoj organizaciji, korupcije, prijevare, terorizma, financiranja terorizma, pranja novca, dječjeg rada ili drugih oblika trgovanja ljudima

- nije ispunio obvezu plaćanja dospjelih poreznih obveza i obveza za mirovinsko i zdravstveno osiguranje, osim ako mu prema posebnom zakonu plaćanje tih obveza nije dopušteno ili je odobrena odgoda plaćanja.

- je lažno predstavio ili pružio neistinite podatke u vezi s uvjetima koje je Naručitelj naveo kao razloge za isključenje ili uvjete kvalifikacije.

- je u stečaju, insolventan ili u postupku likvidacije, ako njegovom imovinom upravlja stečajni upravitelj ili sud, ako je u nagodbi s vjerovnicima, ako je obustavio poslovne aktivnosti ili je u bilo kakvoj istovrsnoj situaciji koja proizlazi iz sličnog postupka prema nacionalnim zakonima i propisima

- je u posljednje dvije godine do početka postupka nabave učinio težak profesionalni

propust koji Naručitelj može dokazati na bilo koji način

Nepostojanje razloga za isključenje iz točke 3. ove Dokumentacije za nadmetanje ponuditelj će dokazati potpisanom izjavom koju dostavlja s ponudom (Prilog II ove Dokumentacije za nadmetanje).

NOJN može u bilo kojem trenutku tijekom postupka nabave, zahtijevati od ponuditelja da prije sklapanja ugovora dostavi jedan ili više dokumenata (potvrda, izvoda, i sl.) koji potvrđuju da se ponuditelj ne nalazi u situacijama navedenim u točki 3., a koje izdaju nadležna tijela. Ako ponuditelj u roku od 5 dana ne dostavi sve tražene izvornike ili ovjerene preslike dokumenata i/ili nedokaže da i dalje ispunjava uvjete koje je odredio Naručitelj, Naručitelj će isključiti takvog ponuditelja odnosno odbiti njegovu ponudu te izvršiti ponovo rangiranje pristiglih ponuda.

An economic entity shall be excluded from the procedure in the following cases:

- If a final judgment for the crimes of involvement in a criminal organization, corruption, fraud, terrorism, financing of terrorism, money laundering, child labor or other forms of trafficking has been passed against the economic operator or the person legally authorized to represent the economic operator.

- If the economic entity failed to pay tax arrears and mandatory contributions for pension and health insurance, unless a special law prevents the economic operator from paying such contributions or of deferred payment has been approved.

- If the economic entity has misrepresented or provided false information concerning the conditions specified by Contracting Authority as reasons for exclusion or as eligibility requirements.

- If the economic operator is bankrupt, insolvent or wound up or if a trustee or court manages his assets; if he has entered into an arrangement with creditors, has suspended business activities or is in any analogous situation arising from a similar procedure provided for in national legislation or regulations.

- If, in the period of two years preceding the beginning of the tender procedure, the economic operator has been guilty of grave professional misconduct proven by any means which Contracting Authority can justify.

The Tenderer shall provide evidence of absence of the reasons specified in Point 3. of this Tender Documentation by underwriting the declaration that shall be submitted together with the tender (Xxxxx XX of this Tender Documentation).

4. UVJETI I DOKAZI SPOSOBNOSTI PONUDITELJA / SELECTION CRITERIA:

Ponuditelj je dužan u svojoj ponudi priložiti dokumente kojima dokazuje svoju pravnu i poslovnu sposobnost te financijsku sposobnost. Dokumenti kojima se dokazuje sposobnost ponuditelja moraju biti na hrvatskom jeziku i latiničnom pismu. Ukoliko je ponuditelj registriran izvan Republike Hrvatske ili je dokument za dokazivanje sposobnosti na stranom jeziku, ponuditelj je dužan uz svaki dokument priložiti i prijevod ovlaštenog sudskog tumača za hrvatski jezik.

Bidder is obliged to enclose documents proving his / her legal and business ability and financial capacity. Documents proving the ability of the bidder must be in the Croatian language and Latin script. If the bidder is registered outside the Republic of Croatia or is a document for the proof of competence in a foreign language, the bidder must enclose the translation of the authorized court interpreter into the Croatian language with each document.

4.1. Pravna i poslovna sposobnost / Legal and business capacity

Svaki ponuditelj mora biti pravno i poslovno sposoban. Kao dokaz ispunjenja ovog uvjeta, ponuditelj dostavlja izjavu osobe ovlaštene za zastupanje gospodarskog subjekta. Prijedlog navedene izjave čini Prilog 3 ove Dokumentacije za nadmetanje.

NOJN može u bilo kojem trenutku tijekom postupka nabave, zahtijevati od ponuditelja da prije sklapanja ugovora dostavi izvod iz sudskog, obrtnog, strukturnog ili drugog odgovarajućeg registra države sjedišta ponuditelja, ne stariju od tri mjeseca računajući od dana početka postupka nabave (u slučaju dostave izvoda na stranom jeziku, isti dokument mora biti dostavljen uz priloženi prijevod na hrvatski jezik)

Every bidder must have legal and business capacity.

As proof of compliance with this condition, the tenderer submits a statement of the person authorized to represent the business entity (Annex III to this Tender Documentation).

NPO may, at any time during the procurement procedure, require the tenderer to submit an extract from the court, craft, structural or other appropriate register of the country of the supplier's seat, before the conclusion of the contract, not earlier than three months from the date of commencement of the procurement procedure Foreign language, the same document must be submitted with the enclosed translation into the Croatian language)

4.2. Financijska sposobnost / Financial capacity

Naručitelj od ponuditelja zahtijeva podnošenje sljedećih dokaza sposobnosti:

Svaki ponuditelj mora dokazati u postupku javne nabave da u posljednjih 6 (šest) mjeseci nije bio

u blokadi više od 5 dana.

Kao dokaz ispunjenja ovog uvjeta, ponuditelj dostavlja izjavu osobe ovlaštene za zastupanje

gospodarskog subjekta (Prilog III ove Dokumentacije za nadmetanje).

NOJN može u bilo kojem trenutku tijekom postupka nabave, zahtijevati od ponuditelja da prije sklapanja ugovora dostavi dokument izdan od bankarskih ili drugih financijskih institucija kojim se dokazuje solventnost gospodarskog subjekta.

The tenderer from the bidder requires submission of the following proof of ability:

Each bidder must prove in the public procurement procedure that in the last 6 (six) months he has not been blocked for more than 5 days, proving with:

As proof of compliance with this condition, the tenderer submits a statement of the person authorized to represent the business entity (Annex III to this Tender Documentation).

NPO may at any time during the procurement procedure require the tenderer to submit a document issued by banking or other financial institutions prior to the conclusion of the contract demonstrating the solvency of the economic operator.

4.3. Pravila dostavljanja dokumenata / Rules for submitting documents

Sve dokumente koje naručitelj zahtijeva sukladno točkama 3 i 4 ove dokumentacije za nadmetanje ponuditelji mogu dostaviti u neovjerenoj preslici. Neovjerenom preslikom smatra se i neovjereni ispis elektroničke isprave.

Nakon rangiranja ponuda prema kriteriju za odabir ponude, a prije donošenja odluke o odabiru, naručitelj može od najpovoljnijeg ponuditelja s kojim namjerava sklopiti ugovor o nabavi zatražiti dostavu izvornika ili ovjerenih preslika jednog ili više dokumenata koji su bili traženi, a koje izdaju nadležna tijela. Ako je gospodarski subjekt već u ponudi dostavio određene dokumente u izvorniku ili ovjerenoj preslici, nije ih dužan ponovo dostavljati.

All documents required by the contracting authority pursuant to points 3 and 4 of this Tender Documentation may be submitted in an uncertified copy. An uncertified copy is also considered as an uncertified print of an electronic document.

After the bid is ranked according to the selection criterion, the contracting authority may, from the best bidder with whom it intends to conclude a procurement contract, request the delivery of original or certified copies of one or more of the documents requested and issued by the competent authorities. If the economic entity has already submitted certain documents in the original or certified copy of the offer, it is not obliged to resubmit them.

5. PONUDA / BID (OFFER)

5.1. Sadržaj ponude:

✓ Izjava o nepostojanju razloga isključenja (Prilog II Dokumentacije za nadmetanje)

✓ Tražene dokaze sposobnosti (Prilog III Dokumentacije za nadmetanje)

✓ Popunjeni i ovjereni Troškovnik (Prilog IV Dokumentacije za nadmetanje)

✓ Ovjerene tehničke specifikacije (Prilog V Dokumentacije za nadmetanje)

✓ Ovjerenu od strane Ponuditelja i Naručitelja Izjavu o čuvanju tajnosti podataka (Prilog VI Dokumentacije za nadmetanje). Navedenu izjavu treba ispuniti, potpisati i ovjeriti, te

njezin sken poslati Prijavitelju na email adresu: xxxxx.xxxxxxxxx0@xxxxx.xxx. Na naveden u Izjavi email Ponuditelja, Naručitelj će u roku od 1 radnog dana poslati svu tehničku dokumentaciju, te vratiti ovjerenu sa svoje strane dobivenu Izjavu o čuvanju tajnosti podataka. Ponuditelj je obvezan u svojoj Ponudi dostaviti Izjavu o čuvanju tajnosti podataka ovjerenu kako od svoje kao tako i od Ponuditeljeve strane. Samo takva Izjava smatrat će se prihvatljivom iz razloga što dokazuje da se je Xxxxxxxxxx upoznao sa svom tehničkom dokumentacijom predmeta nabave prije nego je podnio Ponudu.

✓ Statement of non-existence of reasons for exclusion (Xxxxx XX of Tender Documentation by the Bidder's Statement proves that there are no reasons for the exclusion from point 3 of the Tender Document)

✓ Statement on the fulfillment of the conditions of competence (Xxxxx XXX of Tender Documentation - for the purpose of demonstrating the legal and financial capacity required under point 4.1 and 4.2. of the Tender Document)

✓ Completed Bill of Quantities (Xxxxx XX of Tender Documentation)

✓ Completed Technical Specifications (Annex V of Tender Documentation)

✓ Confidentiality statement Signed by the Bidder and by the Contracting authority (Xxxxx XX of Tender Documentation). Bidder should scan filled and signed Confidentiality statement, and send it to the Contracting authority on email (xxxxx.xxxxxxxxx0@xxxxx.xxx). Contracting authority will within 1 business day reply on the email providing attached all the Technical documentation, and also return the Confidentiality statement signed and stamped by itself. The Bidder is obliged to submit in its Offer a Confidentiality Statement signed by both himself and the Contracting authority. Only such statement will be conisdered acceptable because it proves that the Bidder has been acquainted with all Technical documentation of the subject of procurement before submitting the Offer.

5.2. Način izrade ponude / Way of making the offer

Ponuda se izrađuje na način da čini cjelinu (1 .pdf dokument). Ako zbog opsega ili drugih objektivnih okolnosti ponuda ne može biti izrađena na način da čini cjelinu, onda se izrađuje u dva ili više dijelova.

Dijelove ponude kao što su katalozi i sl. ponuditelj obilježava nazivom i navodi u sadržaju ponude

kao dio ponude.

Ako je ponuda izrađena od više dijelova ponuditelj mora u sadržaju ponude navesti od koliko se dijelova ponuda sastoji.

Stranice ponude se označavaju brojem na način da je vidljiv redni broj stranice i ukupan broj stranica ponude. Kada je ponuda izrađena od više dijelova, stranice se označavaju na način da svaki slijedeći dio započinje rednim brojem koji se nastavlja na redni broj stranice kojim završava prethodni dio. Ako je dio ponude izvorno numeriran (primjerice katalozi), ponuditelj ne mora taj dio ponude ponovno numerirati.

Ispravci u ponudi moraju biti izrađeni na način da su vidljivi. Ispravci moraju uz navod datuma ispravka biti potvrđeni potpisom ponuditelja.

The offer is made in a way that makes it whole. If due to the scope or other objective circumstances of a bid can not be made in a way that it is a whole, then it is made in two or more parts.

Parts of the offer such as catalogs are marked by the name and quoted in the contents of the bidding as part of the offer/bid.

If the bid is made out of several parts, the bidder must state in the content of the bid how many parts of the bid it consists of.

The pages of the bid are marked by number in the way that the page number and the total number of pages are visible. When the bid is made from multiple parts, the page is marked in such a way that each subsequent part starts with the ordinal number that continues to the page number of the page ending the previous part. If part of the bidding is originally numbered (such as catalogs), the bidder does not have to re-number that part of the bidding.

Corrections in the offer must be made in a way that they are visible. The corrections must be confirmed by the signature of the bidder on the date of the correction date.

5.3. Način određivanja cijene ponude / How to determine the offer price

• Cijena ponude je nepromjenjiva za vrijeme trajanja ugovora.

• Cijene u ponudi moraju biti iskazane u kunama (HRK) ili Eurima (EUR).

• Cijena se iskazuje brojkama.

• U cijenu su uračunati svi troškovi i popusti.

• Potrebno je navesti jedinične cijene za svaku pojedinu stavku ponudbenog troškovnika i

ukupnu cijenu bez poreza na dodanu vrijednost (PDV-a).

• Cijenu ponude iskazati na ponudbenom listu i to: bez PDV-a, iznos PDV-a i ukupna cijena s PDV-om, zaokruženu na dvije decimale.

• Ukoliko ponuditelj nije u sustavu PDV-a, tada na Ponudbenom listu na mjestu predviđenom za upis cijene ponude s PDV-om upisuje isti iznos koji je upisan na mjestu predviđenom za upis cijene bez PDV-a, a mjesto za upis iznosa PDV-a ostavlja prazno ili se upisuje 0.

• The offer price is unchanged for the duration of the contract.

• Prices must be quoted in HRK (HRK) or euros (EUR).

• The price is expressed in figures.

• All costs and discounts are included in the price.

• It is necessary to state the unit prices for each item of bidder's offer and the total cost without value added tax (VAT).

• Offer price quoted on the Tender Sheet: VAT excluded, VAT amount and total price with VAT, rounded to two decimal places.

• If the bidder is not in the VAT system, then on the Tender sheet at the place envisaged for entering the price with VAT included he writes the same amount that is entered in the place foreseen for price without VAT, and the place to enter the VAT amount leaves blank or is entered 0.

5.4. Kriterij za odabir ponude / How to determine the offer price

Kriterij za odabir ponude je najniža cijena.

Ako su dvije ili više valjanih ponuda jednako rangirane prema kriteriju za odabir ponude,

Naručitelj će odabrati onu ponudu, koja je pristigla ranije.

The bid selection criterion is the lowest price.

If two or more valid bids are ranked according to the bidding criteria, the Buyer will choose the bid (offer) received earlier.

5.5. Jezik i pismo ponude / Language and letter of the offer

Ponuda se zajedno s pripadajućom dokumentacijom izrađuje na hrvatskom i/ili engleskom jeziku i latiničnom pismu. Ukoliko je bilo koji dokument Ponude, pisan ili izdan na nekom drugom, ne navedenom prethodno jeziku ponuditelj ga mora dostaviti zajedno s ovjerenim prijevodom na hrvatski jezik od strane ovlaštenog sudskog tumača. U slučaju ne ispunjenja navedenog uvjeta, Naručitelj zadržava pravo isključivanja Ponuditelja iz postupka.

The offer is made together with the relevant documentation in Croatian and/or English language and Latin script.

If any tenderer's document is issued in a foreign language, the tenderer must submit it together with a certified translation into the Croatian language by an authorized court interpreter. In the event of non-fulfillment of this condition, the Buyer reserves the right to exclude the Bidder from the proceeding.

5.6. Rok valjanosti ponude / Validity period of the offer

Rok valjanosti ponude je najmanje 60 dana od isteka roka za dostavu ponuda.

The offer (bid) validity period is at least 60 days after the deadline for submission of tenders.

6. OSTALE ODREDBE / OTHER PROVISIONS

6.1. Jamstva / Guarantees

Minimalno jamstvo na kalup koji je predmet nabave je 3 godine ili 1.000.000 komada proizvoda

(što nastupi ranije).

The minimu guarantee on the mold (subject of procurement) is 3 years or 1.000.000 pieces of product (whichever comes first).

6.2. Datum, vrijeme i mjesto dostave ponude / Date, time and place of bid delivery

Ponuda mora biti zaprimljena od strane Naručitelja, na email adresu iz točke 1.1. ove Dokumentacije, najkasnije do 17/11/2019. u 16:00 sati po lokalnom vremenu.

Ponuditelj samostalno određuje način dostave ponude i sam snosi rizik eventualnog gubitka odnosno nepravovremene dostave ponude.

Kada ponuditelj neposredno dostavlja ponudu, izmjenu i/ili dopunu ponude, odnosno pisanu izjavu o odustajanju od dostavljene ponude naručitelj mu je obvezan o tome izdati potvrdu.

Ponude u papirnatom obliku koje nisu zaprimljene u propisanom roku za dostavu ponude neće se otvarati i vraćaju se ponuditelju neotvorene.

The offer must be received by the Buyer at the address given in item 1.1. of this Documentation, no later than 17/11/2019. at 16:00 local time.

When the bidder submits a bid, modification and / or amendment to the bid, ie a written statement of withdrawal from the submitted bid, the contracting authority is obliged to issue a certificate.

Bids in paper form that have not been received within the prescribed bid submission deadline will not open and return to the bidder unopened.

The Bidder submits his own bid at his own expense without the right to claim remuneration from the Client on any ground.

The Bidder shall bear the risk of loss or non-delivery of the Bid.

The Bidder may submit an amendment and / or supplement to the Bid by the expiry of the Bid Deadline. An amendment and / or modification of the bid is submitted in the same way as the basic bid with a mandatory indication that it is a modification and / or amendment of the offer. In this case, the bidding will be opened in reverse order of receipt, and delivery time is considered delivery of the last version of the bidding change.

Bidder may, by a written statement, withdraw from the delivered bid by the expiry of the deadline for the submission of tenders. 6.4. Pregled i ocjena ponuda / Review and rating of the offer

Odbor za nabavu nakon isteka roka za dostavu ponuda pregledava i ocjenjuje sadržaj podnesenih ponuda u odnosu na uvjete iz Dokumentacije za nadmetanje.

U postupku pregleda i ocjene ponuda Naručitelj vrši:

- provjeru formalne sukladnosti

- procjenu postojanja razloga isključenja i ispunjenja uvjeta kvalifikacije

- procjenu tehničke i materijalne sukladnosti

- evaluaciju ponuda na temelju prethodno objavljenih kriterija za odabir

The Procurement Committee after the expiry of the bidding deadline shall review and evaluate the contents of the bids submitted in respect of the terms and conditions set out in the Tender Documentation.

In the review process and the evaluation of the offer, the Buyer will do the following:

- verification of formal compliance

- assessment of the reason for exclusion and fulfillment of the qualification conditions

- assessment of technical and material conformity

- evaluation of tenders based on previously published criteria for selection

6.5. Pojašnjenje i upotpunjavanje / Clarification and completeness

Ako se podaci ili dokumentacija koju je trebao podnijeti ponuditelj čine nepotpuni ili pogrešni ili ako nedostaju određeni dokumenti, NOJN može tijekom pregleda i ocjene prijava i ponuda zahtijevati od tih kandidata ili ponuditelja da podnesu, dopune, pojasne ili upotpune nužne podatke ili dokumentaciju u primjerenom roku koji ne smije biti kraći od 5 niti dulji od 15 kalendarskih dana.

Podnošenje, dopunjavanje, pojašnjenje ili upotpunjavanje u vezi s dokumentima traženim u svrhu procjene postojanja razloga isključenja i ispunjenja uvjeta kvalifikacije ne smatra se izmjenom ponude.

Naručitelj može tražiti i pojašnjenja u vezi s dokumentima traženim u dijelu koji se odnosi na

ponuđeni predmet nabave, pri čemu pojašnjenje ne smije rezultirati izmjenom ponude.

Postupanje NOJN-a vezano uz pojašnjenje i upotpunjavanje prijava i ponuda, odnosno zahtjevi i postupanje NOJN-a, moraju biti u skladu s načelima jednakog tretmana i transparentnosti.

The contracting authority may request and clarify in relation to the documents required in the part relating to the subject matter offered, whereby the clarification may not result in an alteration of the tender.

The NPO's action regarding the clarification and completing of applications and tenders, ie the requirements and conduct of the NPO, must be in accordance with the principles of equal treatment and transparency.

6.6. Odluka o odabiru ili poništenju / Decision on selection or revocation

Naručitelj (NOJN) je obvezan na temelju rezultata pregleda i ocjene prijava ili ponuda odbiti:

- ponudu koja je stigla nakon roka za dostavu,

- ponudu koja je na drugom jeziku nego je navedeno u Dokumentaciji za nadmetanje.

- ponudu ponuditelja koji nije dostavio jamstvo za ozbiljnost ponude ako je traženo,

odnosno ako dostavljeno jamstvo nije valjano ili je preniske vrijednosti,

- ponudu ponuditelja koji nije dokazao uvjete kvalifikacije u skladu s Dokumentacijom za nadmetanje,

- ponudu koja nije cjelovita tj. ne sadrži sve elemente navedene u članku 5.1. ovog dokumenta te koju nije moguće u razumnom roku, ne kraćem od 5 kalendarskih dana, upotpuniti nužnim podacima ili dokumentacijom koja nedostaje u skladu s načelima jednakog tretmana i transparentnosti ponudu koja sadrži pogreške, nedostatke odnosno nejasnoće ako pogreške, nedostaci odnosno nejasnoće nisu uklonjive

- ponudu koja je suprotna odredbama Dokumentacije za nadmetanje,

- ponudu u kojoj cijena nije iskazana u apsolutnom iznosu,

- ponudu u kojoj pojašnjenjem ili upotpunjavanjem sukladno ovoj dokumentaciji za nadmetanje nije uklonjena pogreška, nedostatak ili nejasnoća,

- ponudu koja ne ispunjava obvezne tehničke specifikacije određene u Dokumentaciji za nadmetanje,

- ponudu za koju ponuditelj nije pisanim putem prihvatio ispravak računske pogreške,

- ponudu koja sadrži štetne odredbe.

NOJN donosi odluku o odabiru najbolje ponude u roku 20 dana koja će minimalno sadržavati naziv i adresu odabranog ponuditelja, ukupnu vrijednost odabrane ponude, sa i bez PDV-a te datum donošenja i potpis odgovorne osobe.

NOJN će poništiti postupak nabave ako :

- nije pristigla niti jedna prijava ili ponuda;

- nije zaprimio niti jednu valjanu prijavu ili ponudu

NOJN može poništiti postupak nabave ako:

- je cijena ponude veća od osiguranih sredstava za nabavu;

- se tijekom postupka utvrdi da je dokumentacija za nadmetanje manjkava te kao takva ne omogućava učinkovito sklapanje ugovora (primjerice, u dokumentaciji su navedene pogrešne količine predmeta nabave);

- su nastale značajne nove okolnosti vezane uz projekt za koji se provodi nabava (primjerice, projekt nije odobren).

U slučaju poništenja postupka nabave, NOJN donosi Odluku o poništenju u kojoj će minimalno navesti predmet nabave za kojeg se donosi odluka o poništenju, obrazloženje razloga poništenja, rok u kojem će pokrenuti novi postupak za isti ili sličan predmet nabave, ako je primjenjivo te datum donošenja i potpis odgovorne osobe.

NOJN će sve ponuditelje obavijestiti o konačnom odabiru, i to dostavom Odluke o odabiru najbolje ponude ili Odluke o poništenju na način koji je moguće dokazati: slanjem telefaksom i/ili poštom i/ili elektroničkim putem ili kombinacijom tih sredstava.

Istodobno s Odlukom o odabiru ili Odlukom o poništenju Naručitelj će zasebno dostaviti zasebno

svakom pojedinom:

- neuspješnom ponuditelju: obavijest o razlozima za njegovo isključenje ili odbijanje njegove ponude;

- ponuditelju koji je dostavio prihvatljivu ponudu: obavijest o svojstvima i relativnim prednostima odabrane ponude u odnosu na njegovu ponudu.

The Buyer (NPO) is obliged to refuse, on the basis of the results of the review and evaluation of the applications or bids (offers):

- a bid that has arrived after the deadline for delivery,

- a bid which is in a language other than that stated in the Call for proposalsand the Tender Documentation,

- the bid of the bidder who did not submit the guarantee for the seriousness of the bid if it was requested, ie if the delivered guarantee is not valid or is too low,

- a bid by a tenderer who has not demonstrated the qualification requirements in accordance with the Tender Documentation,

- a bid that is not complete ie does not contain all the elements listed in Article 5.1. of this document and which is not possible within a reasonable time, not shorter than 5 calendar days, to fill in the necessary data or documentation missing in accordance with the principles of equal treatment and transparency of a bid containing errors, deficiencies or ambiguities if errors, deficiencies or ambiguities are not removable,

- a bid (offer) contrary to the provisions of the Tender Documentation,

- a bid (offer) in which the price is not expressed in the absolute amount,

- a tender in which clarification or supplementation in accordance with this tender documentation did not remove the error, lack or ambiguity,

- a bid that does not meet the mandatory technical specifications specified in the Tender Documentation,

- a bid for which the bidder did not accept a correction of the error in writing,

- an offer containing harmful terms.

NPO makes a decision on selecting the best bid within 20 days, which shall at least include the name and address of the selected bidder, the total value of the selected bid, with and without VAT, and the date of issue and signature of the responsible person.

NPO will cancel the procurement procedure if:

- no applications or bids (offers) received;

- received no valid application or bid (offer)

NPO may revoke the procurement procedure if:

- the bid price is higher than the secured means of procurement;

- it is found during the procedure that the tender documentation is defective and as such does not allow for an effective contract conclusion (for example, the documentation contains erroneous quantities of procurement);

- significant new circumstances have arisen with respect to the project for which procurement is being carried out (for example, the project has not been approved).

In case of annulment of the procurement procedure, NPO shall issue an annulment decision which shall state at least the subject of the procurement for which an annulment decision is made, an explanation of the reasons for the annulment, a time period in which to initiate a new proceeding for the same or similar subject, if applicable and the date of the award and signature of the responsible person.

NPO will notify all bidders of the final selection, by submitting a decision on the selection of the best bidding or annulment decision in a way that can be proven by fax and / or mail and / or by electronic means or a combination of these.

At the same time as the Selection Decision or the Decree on Cancellation, the Client will separately submit each item individually:

- unsuccessful bidder: notice of reasons for his exclusion or rejection of his bid;

- the bidder who has submitted an acceptable offer: a notice of the characteristics and relative advantages of the tender selected in relation to his tender.

6.7. Predstavke / Petitions

Svaki kandidat ili ponuditelj može podnijeti predstavku ako smatra da je njegova ponuda trebala biti odabrana kao najbolja, ali je to onemogućeno zbog postupanja Naručitelja protivno odredbama ove Dokumentacije za nadmetanje zbog kojeg je:

- neopravdano isključen iz postupka nabave,

- njegova prijava ili ponuda neopravdano odbijena, ili

- evaluacija prijave ili ponude protivna uvjetima i kriterijima dokumentacije za nadmetanje i odredbama ovoga Priloga.

Predstavka se podnosi u pisanom obliku u roku 8 dana od dana primitka Odluke o odabiru ili Odluke o poništenju i obavijesti Posredničkom tijelu razine 2 (PT2), a presliku predstavke mora se dostaviti i NOJN-u. Adresa na koju se podnosi predstavka je:

Podnositelj mora presliku predstavke dostaviti NOJN-u istovremeno sa slanjem predstavke PT2. Podnositelj mora u predstavci obrazložiti svoje navode.

Podnošenje predstavke ne zaustavlja sklapanje ugovora o nabavi.

Podnositelj predstavke koji je pretrpio štetu zbog povreda Postupaka nabave ima mogućnost

naknade štete pred nadležnim sudom prema općim propisima o naknadi štete.

Any candidate or tenderer may file a petition if he considers that his bid should be selected as the best but it is disabled for the Client's conduct contrary to the provisions of this Bidding Document for which:

- unjustifiably excluded from the procurement procedure,

The submission shall be submitted in writing within 8 days from the date of receipt of the Decision on the Selection or Annulment Decision and notification to the Mediating Body Level 2 (PT2) and a copy of the application shall also be served on the NPO. The applicant who has suffered damage due to a breach of the Procurement Procedure has the possibility of compensation for damages before the competent court under the general rules on compensation for damages.
