PRIJEDLOG
Na temelju članka 30. stavka 1. Zakona o sklapanju i izvršavanju međunarodnih ugovora (Narodne novine, broj 28/96), a u vezi s člankom 22. Stockholmske konvencije o postojanim organskim onečišćujućim tvarima (Narodne novine-Međunarodni ugovori, broj 11/06), Vlada Republike Hrvatske je na sjednici održanoj godine donijela:

Izmjena i dopuna Dodataka A, B i C iz svibnja 2009. godine, Izmjene i dopune Dodatka A iz travnja 2011. godine i Izmjene i dopune Dodatka A iz svibnja 2013. godine Stockholmske konvencije o postojanim organskim onečišćujućim tvarima
Članak 1.
Objavljuju se Dodatak G Stockholmske konvencije o postojanim organskim onečišćujućim tvarima (dalje u tekstu: Konvencija) usvojen na prvom sastanku K onferencije stranaka Konvencije 6. svibnja 2005. godine, Izmjene i dopune Dodataka A, B i C usvojene na četvrtom sastanku Konferencije stranaka Konvencije u svibnju 2009. godine, Izmjena i dopuna Dodatka A usvojena na petom sastanku Konferencije stranaka Konvencije u travnju 2011. godine (dalje u tekstu: Izmjena i dopuna Dodatka A iz travnja 2011. godine) i Izmjena i dopuna Dodatka A usvojena na šestom sastanku Konferencije stranaka Konvencije u svibnju 2013. godine (dalje u tekstu: Izmjena i dopuna Dodatka A iz svibnja 2013. godine), u izvorniku na arapskom, kineskom, engleskom, francuskom, ruskom i španjolskom jeziku.
Članak 2.
Tekst Dodatka G iz svibnja 2005. godine članka 1. ove Uredbe, u izvorniku na engleskom jeziku i u prijevodu na hrvatski jezik, glasi:

Usvojila je, kao Dodatak G Konvencije, sljedeći arbitražni postupak za potrebe stavka 2. (a) članka 18. Konvencije i postupak mirenja za potrebe stavka 6. članka 18. Konvencije.
Dodatak G
I. Arbitražni postupak
Arbitražni postupak za potrebe stavka 2. (a) članka 18. Konvencije bit će kako slijedi:
Članak 1.

1. Stranka može pokrenuti postupak arbitraže u skladu s člankom 18. Konvencije pisanom obaviješću upućenoj drugoj stranci u sporu. Obavijesti mora biti priložena izjava o zahtjevu sa svom popratnom dokumentacijom, te se u njoj mora navesti predmet arbitraže, a posebno mora sadržavati članke Konvencije oko čijeg se tumačenja ili primjene spori.
2. Stranka tužitelj mora obavijestiti Tajništvo da će stranke uputiti spor na arbitražu temeljem članka 18. Obavijesti mora biti priložena pisana obavijest stranke tužitelja, izjava o zahtjevu i popratna dokumentacija navedena u gornjem stavku 1.Tajništvo zaprimljene informacije proslijeđuje svim strankama.
Članak 2.
1. Ukoliko se spor uputi na arbitražu u skladu s gornjim člankom 1. osniva se arbitražni sud. Mora se sastojati od tri člana.
2. Svaka stranka u sporu imenuje arbitra i tako dva imenovana arbitra sporazumno određuju trećeg arbitra koji je predsjednik suda. Predsjednik suda neće biti državljanin stranke u sporu niti će mu/joj uobičajeno boravište biti na državnom području jedne od stranaka, neće biti zaposlenik jedne od stranaka niti će u bilo kakvom drugom svojstvu biti povezan sa slučajem.
3. U sporovima između više od dviju stranaka, stranke s istim interesom sporazumno zajednički imenuju jednog arbitra.
4. Svako upražnjeno mjesto popunjuje se na način propisan za prvotno imenovanje.
5. Ukoliko se stranke ne slože oko predmeta spora prije imenovanja predsjednika arbitražnog suda, arbitražni sud određuje predmet.
Članak 3.
1. Ako jedna od stranaka u sporu ne imenuje arbitra u roku od dva mjeseca od datuma na koji tužena stranka zaprimi obavijest o arbitraži, druga stranka može obavijestiti glavnog tajnika Ujedinjenih naroda koji ga mora odrediti u roku od daljnjih dva mjeseca.
2. Ako se predsjednik arbitražnog suda ne odredi u roku od dva mjeseca od datuma imenovanja drugog arbitra, glavni tajnik Ujedinjenih naroda na zahtjev stranke određuje predsjednika u roku od daljnjih dva mjeseca.
Članak 4.
Arbitražni sud donosi svoje odluke u skladu s odredbama Konvencije i međunarodnog prava.
Članak 5.
Ako se stranke u sporu ne dogovore drugačije, arbitražni sud određuje vlastiti poslovnik.
Članak 6.
Arbitražni sud može na zahtjev jedne od stranaka odrediti neophodne privremene mjere zaštite.
Članak 7.
Stranke u sporu moraju olakšati rad arbitražnog suda i, osobito, koristeći sva sredstva koja su im na raspolaganju:
(a) osigurati mu svu relevantnu dokumentaciju, informacije, i prostorije; te
(b) omogućiti mu da, po potrebi, pozove svjedoke ili stručnjake i primi njihovo svjedočenje.

Članak 8.
Stranke i arbitri dužni su štititi povjerljivost svih informacija koje prime u povjerenju tijekom rada arbitražnog suda.
Članak 9.
Ako arbitražni sud ne odredi drugačije zbog posebnih okolnosti slučaja, troškove arbitraže snosit će stranke u sporu u jednakom iznosu. Sud vodi evidenciju svih svojih troškova i konačno stanje istih dostavlja strankama.
Članak 10.
Stranka s interesom pravne prirode vezanim za predmet spora na koju predmetna odluka može imati utjecaj, uz odobrenje suda može se umiješati u postupak.
Članak 11.
Arbitražni sud može saslušati i utvrditi protutužbe koje izravno proizlaze iz predmeta spora.
Članak 12.
Odluke arbitražnog suda o postupku i materiji donose se većinom glasova njegovih članova.
Članak 13.
1. Ako se jedna od stranaka u sporu ne pojavi pred arbitražnim sudom ili propusti braniti svoj slučaj, druga stranka može od suda zatražiti nastavak postupka i donošenje arbitražne odluke. Odsutnost stranke ili propust stranke da brani svoj slučaj ne predstavlja prepreku postupku.
2. Prije donošenja konačne odluke arbitražni sud mora se uvjeriti daje zahtjev činjenično i pravno utemeljen.
Članak 14.
Sud donosi konačnu odluku u roku od pet mjeseci od datuma kada je u potpunosti imenovan, osim ako ne bude smatrao potrebnim produljiti rok u trajanju ne duljem od pet dodatnih mjeseci.
Članak 15.
Konačna odluka arbitražnog suda ograničena je na predmet spora i mora navesti razloge na kojima se temelji. Sadržava imena članova koji su sudjelovali i datum konačne odluke. Svaki član suda može konačnoj odluci priložiti odvojeno ili suprotno mišljenje.
Članak 16.
Arbitražna odluka je obvezujuća za stranke u sporu. Tumačenje Konvencije dano u odluci također je obvezujuće za stranku koja se umiješala temeljem gornjeg članka 10. u mjeri u kojoj je povezano s pitanjima zbog kojih je ta stranka umiješana. Na arbitražnu odluku nije moguće izjaviti žalbu osim ako se stranke u sporu nisu prethodno dogovorile oko žalbenog postupka.
Članak 17.
Bilo koju nesuglasicu koja se može pojaviti između stranaka obvezanih konačnom odlukom u skladu s gornjim člankom 16. u vezi s tumačenjem ili načinom provedbe te odluke, stranke mogu podnijeti arbitražnom sudu koji ju je donio.

Postupak mirenja
Postupak mirenja za potrebe stavka 6. članka 18. Konvencije je kako slijedi:
Članak 1.
1. Zahtjev stranke u sporu za uspostavu Odbora za mirenje temeljem stavka 6., člankal8. upućuje se pisanim putem Tajništvu. Tajništvo o tome bez odlaganja obaviještava sve stranke Konvencije.
2. Odbor za mirenje se, osim ako se stranke ne dogovore drugačije, sastoji od tri člana, jednog imenovanog od svake stranke i predsjednika kojeg zajednički biraju ti članovi.
Članak 2.
U sporovima između više od dviju stranaka, stranke sa istim interesom sporazumno zajednički imenuju svog člana odbora.
Članak 3.
Ako stranke ne izvrše bilo koje imenovanje u roku od dva mjeseca od datuma kada Tajništvo zaprimi pisani zahtjev naveden u članku 1. glavni tajnik Ujedinjenih naroda mora na zahtjev jedne od stranaka izvršiti imenovanje u roku od daljnjih dva mjeseca.
Članak 4.
Ako se u roku od dva mjeseca nakon imenovanja drugog člana odbora ne izabere predsjednik odbora za mirenje, glavni tajnik Ujedinjenih naroda mora na zahtjev jedne od stranaka odrediti predsjednika u roku od daljnjih dva mjeseca.
Članak 5.
1. Odbor za mirenje mora, ako se stranke u sporu ne dogovore drugačije, utvrditi vlastiti poslovnik.
2. Stranke i članovi odbora dužni su štititi povjerljivost svih informacija koje prime u povjerenju tijekom rada odbora.
Članak 6.
Odbor za mirenje svoje odluke donosi većinom glasova svojih članova.
Članak 7.
Odbor za mirenje donosi izvješće s preporukama za rješavanje spora u roku od dvanaest mjeseci od svoje uspostave, koje stranke razmatraju u dobroj vjeri.
Članak 8.
Odbor mora riješiti sve nesuglasice o tome ima li odbor za mirenje nadležnost za razmatranje predmeta koji mu je upućen.
Članak 9.
Troškove odbora snose stranke u sporu u iznosu koji dogovore. Odbor mora voditi evidenciju svih svojih troškova i konačno stanje istih dostaviti strankama.
SC-1/2: Settlement of disputes
The Conference of the Parties,
Adopts, as Annex G to the Convention, the following arbitration procedure for purposes of paragraph 2 (a) of Article 18 of the Convention and conciliation procedure for purposes of paragraph 6 of Article 18 of the Convention.
Annex G
Arbitration procedure
The arbitration procedure for purposes of paragraph 2 (a) of Article 18 of the Convention shall be as follows:
Article 1
1. A Party may initiate recourse to arbitration in accordance with Article 18 of the Convention by written notification addressed to the other party to the dispute. The notification shall be accompanied by a statement of the claim, together with any supporting documents, and state the subject-matter of arbitration and include, in particular, the articles of the Convention the interpretation or application of which are at issue.
2. The claimant party shall notify the Secretariat that the parties are referring a dispute to arbitration pursuant to Article 18. The notification shall be accompanied by the written notification of the claimant party, the statement of claim and the supporting documents referred to in paragraph 1 above. The Secretariat shall forward the information thus received to all Parties.
Article 2
1. If a dispute is referred to arbitration in accordance with Article 1 above, an arbitral tribunal shall be established. It shall consist of three members.
2. Each of the parties to the dispute shall appoint an arbitrator and the two arbitrators so appointed shall designate by common agreement the third arbitrator, who shall be the President of the tribunal. The President of the tribunal shall not be a national of one of the parties to the dispute, nor have his or her usual place of residence in the territory of one of those parties, nor be employed by any of them, nor have dealt with the case in any other capacity.
3. In disputes between more than two parties, parties in the same interest shall appoint one arbitrator jointly by agreement.
4. Any vacancy shall be filled in the manner prescribed for the initial appointment.
5. If the parties do not agree on the subject-matter of the dispute before the President of the arbitral tribunal is designated, the arbitral tribunal shall determine the subject-matter.
Article 3
1. If one of the parties to the dispute does not appoint an arbitrator within two months of the date on which the respondent party receives the notification of the arbitration, the other party may inform the Secretary-General of the United Nations, who shall make the designation within a further two-month period.
2. If the President of the arbitral tribunal has not been designated within two months of the date of the appointment of the second arbitrator, the Secretary-General of the United Nations shall, at the request of a party, designate the President within a further two-month period.
Article 4

The arbitral tribunal shall render its decisions in accordance with the provisions of the Convention and international law.
Article 5
Unless the parties to the dispute otherwise agree, the arbitral tribunal shall determine its own rules of procedure.
Article 6
The arbitral tribunal may, at the request of one of the parties, indicate essential interim measures of protection.
Article 7
The parties to the dispute shall facilitate the work of the arbitral tribunal and, in particular, using all means at their disposal, shall:
(a) Provide it with all relevant documents, information and facilities; and
(b) Enable it, when necessary, to call witnesses or experts and receive their evidence.
Article 8
The parties and the arbitrators are under an obligation to protect the confidentiality of any information they receive in confidence during the proceedings of the arbitral tribunal.
Article 9
Unless the arbitral tribunal determines otherwise because of the particular circumstances of the case, the costs of the tribunal shall be borne by the parties to the dispute in equal shares. The tribunal shall keep a record of all its costs, and shall furnish a final statement thereof to the parties.
Article 10
A party that has an interest of a legal nature in the subject matter of the dispute which may be affected by the decision in the case may intervene in the proceedings with the consent of the tribunal.
Article 11
The tribunal may hear and determine counterclaims arising directly out of the subject matter of the dispute.
Article 12
Decisions both on procedure and substance of the arbitral tribunal shall be taken by a majority vote of its members.
Article 13
1. If one of the parties to the dispute does not appear before the arbitral tribunal or fails to defend its case, the other party may request the tribunal to continue the proceedings and to make its award. Absence of a party or a failure of a party to defend its case shall not constitute a bar to the proceedings.
2. Before rendering its final decision, the arbitral tribunal must satisfy itself that the claim is well founded in fact and law.
Article 14
The tribunal shall render its final decision within five months of the date on which it is fully constituted unless it finds it necessary to extend the time limit for a period which should not exceed five more months.
Article 15

The final decision of the arbitral tribunal shall be confined to the subject matter of the dispute and shall state the reasons on which it is based. It shall contain the names of the members who have participated and the date of the final decision. Any member of the tribunal may attach a separate or dissenting opinion to the final decision.
Article 16
The award shall be binding on the parties to the dispute. The interpretation of the Convention given by the award shall also be binding upon a Party intervening under Article 10 above insofar as it relates to matters in respect of which that Party intervened. The award shall be without appeal unless the parties to the dispute have agreed in advance to an appellate procedure.
Article 17
Any controversy which may arise between those bound by the final decision in accordance with Article 16 above, as regards the interpretation or manner of implementation of that decision, may be submitted by any of them for decision to the arbitral tribunal which rendered it.
Conciliation procedure
The conciliation procedure for purposes of paragraph 6 of Article 18 of the Convention shall be as follows:
Article 1
1. A request by a party to a dispute to establish a conciliation commission in consequence of paragraph 6 of Article 18 shall be addressed in writing to the Secretariat. The Secretariat shall forthwith inform all Parties to the Convention accordingly.
2. The conciliation commission shall, unless the parties otherwise agree, be composed of three members, one appointed by each party concerned and a President chosen jointly by those members.
Article 2
In disputes between more than two parties, parties in the same interest shall appoint their members of the commission jointly by agreement.
Article 3
If any appointments by the parties are not made within two months of the date of receipt by the Secretariat of the written request referred to in Article 1, the Secretary-General of the United Nations shall, upon request by a party, make those appointments within a further two-month period.
Article 4
If the President of the conciliation commission has not been chosen within two months of the second member of the commission being appointed, the Secretary-General of the United Nations shall, upon request by a party, designate the President within a further two-month period.
Article 5
1. The conciliation commission shall, unless the parties to the dispute otherwise agree, determine its own rules of procedure.
2. The parties and members of the commission are under an obligation to protect the confidentiality of any information they receive in confidence during the proceedings of the commission.
Article 6
The conciliation commission shall take its decisions by a majority vote of its members.
Article 7

The conciliation commission shall render a report with recommendations for resolution of the dispute within twelve months of being established, which the parties shall consider in good faith.
Article 8
Any disagreement as to whether the conciliation commission has competence to consider a matter referred to it shall be decided by the commission.
Article 9
The costs of the commission shall be borne by the parties to the dispute in shares agreed by them. The commission shall keep the record of all its costs and shall furnish a final statement thereof to the parties.

1. Odlučila je izmijeniti i dopuniti Xxx X. Dodatka A Konvencije kako bi unijela heksabromodifenil eter i heptabromodifenil eter, kako je navedeno u stavku 2. ove odluke, uz posebno izuzeće za proizvode/pripravke koji sadrže heksabromodifenil eter i heptabromodifenil eter u skladu s odredbama iz Dijela IV. Dodatka, kako slijedi:

2. Takođerje odlučila umetnuti definiciju heksabromodifenil etera i heptabromodifenil etera u novi Dio III. Dodatka A pod nazivom "Definicije" kako slijedi:
Za potrebe ovoga Dodatka:
"Heksabromodifenil eter i heptabromodifenil eter" znači 2,2',4,4',5,5'- heksabromodifenil eter (BDE-153, CAS br.: 68631-49-
2), 2,2',4,4',5,6'- heksabromodifenil eter (BDE-154, CAS br.: 207122- 15-4), 2,2',3,3',4,5',6 heptabromodifenil eter (BDE-175, CAS br.: 446255-22-7), 2,2',3,4,4',5',6-heptabromodifenil eter (BDE-183, CAS br.: 207122-16-5) i drugi heksa- i heptabromodifenil eteri prisutni u komercijalnom oktabromodifenil eteru.
3. Odlučila u Dodatak A umetnuti novi Dio IV. kako slijedi:
Dio IV.
Heksabromodifenil eter i heptabromodifenil eter
1. Stranka može dozvoliti recikliranje proizvoda koji sadrže ili mogu sadržavati heksabromodifenil eter i heptabromodifenil eter, te uporabu i konačno zbrinjavanje proizvoda proizvedenih od recikliranih materijala koji sadrže ili mogu sadržavati heksabromodifenil eter i heptabromodifenil eter, pod pretpostavkom da:
(a) Recikliranje i konačno zbrinjavanje se provode na okolišno prihvatljiv način i ne dovode do oporabe heksabromodifenil etera i heptabromodifenil etera za potrebe ponovne uporabe;
(b) Stranka poduzima korake za sprječavanje izvoza proizvoda koji sadrže koncentracije heksabromodifenil etera i heptabromodifenil etera koje prekoračuju one dozvoljene za prodaju, uporabu, uvoz ili proizvodnju tih proizvoda na državnom području stranke; i
(c) Stranka obavijesti Tajništvo o svojoj namjeri korištenja ovog izuzeća.
2. Na šestom redovnom sastanku Konferencije stranaka Konvencije i svakom drugom nakon njega, Konferencija stranaka ocijenit će napredak koji su stranke ostvarile prema postizanju konačnog cilja uklanjanja heksabromodifenil etera i heptabromodifenil etera sadržanog u proizvodima i revidirati daljnju potrebu za ovim posebnim izuzećem. Ovo posebno izuzeće u svakom slučaju ističe najkasnije 2030.
4. Odlučila je izmijeniti i dopuniti Xxx X. Dodatka A Konvencije umetanjem zareza i riječi "i uporabu heksabromodifenil etera i heptabromodifenil etera u skladu s odredbama dijela IV. ovoga Dodatka" u napomenu (iv), nakon riječi "polikloriranih bifenila u predmetima koji se upotrebljavaju u skladu s odredbama Dijela II.".

1. Odlučila je da se u Dio 1. Dodatka B Konvencije unese perfluorooktan sulfonska kiselina, njezine soli i perfluorooktan sulfonil fluorid umetanjem sljedećeg retka, s prihvatljivom namjenom i posebnim izuzećem:

Dio III.
Perfluorooktan sulfonska kiselina, njezine soli i perfluorooktan sulfonil fluorid
1. Proizvodnja i uporaba perfluorooktan sulfonske kiseline (PFOS), njezinih soli, i perfluorooktan sulfonil fluorida (PFOSF) ograničava se od strane svih stranaka, osim u slučajevima predviđenim u Dijelu I. ovog Dodatka za stranke koje su obavijestile Tajništvo o svojoj namjeri da se proizvodi i/ili uporabljuje u prihvatljive namjene. Registar prihvatljive namjene uspostavlja Tajništvo i biti će dostupan javnosti. Tajništvo vodi Registar prihvatljive namjene. U slučaju da stranka koja nije navedena u Registru utvrdi da ima potrebu za uporabom PFOS-a, njezinih soli ili PFOSF za prihvatljive namjene navedene u Dijelu I. ovoga Dodatka mora obavijestiti Tajništvo što je prije moguće kako bi se njezino ime odmah dodalo u Registru.
2. Stranke koje proizvode i/ili koriste kemikalije, uzeti će u obzir, ovisno o primjenjivosti, smjernice kako su dane u relevantnim dijelovima općih smjernica o najboljim raspoloživim tehnikama i najboljoj okolišnoj praksi, Dio V. Dodatka C Konvencije.
3. Svaka stranka će svake četiri godine izvještavati o napretku vezano uz uporabu i/ili proizvodnju ovih kemikalija u smislu napretka vezano uz uklanjanje PFOS-a, njezinih soli i PFOSF te dostaviti informacije o napretku Konferenciji stranaka i putem procesa Izvještavanja sukladno članku 15. Konvencije.
4. S ciljem smanjenja i potpunog uklanjanja proizvodnje i/ili uporabe ovih kemikalija, Konferencija stranaka potiče:

(a) Svaku stranku koja koristi ove kemikalije da poduzme aktivnosti za uklanjanjem uporabe kada to bude prikladno i budu dostupne zamjenske tvari ili metode;
(b) Svaku stranku koja koristi i/ili proizvodi ove kemikalije da izradi i provede akcijski plan iz članka 7. Konvencije;
(c) Stranke, da u okviru svojih mogućnosti promoviraju istraživanje i razvoj sigurnih zamjenskih kemikalija i ne kemijskih proizvoda i procesa, metoda i strategija za stranke koje koriste ove kemikalije. Kod odabira zamjenskih kemikalija ili kombinacija zamjenskih tvari potrebno promovirati iste,
uzimajući u obzir utjecaj na zdravlje ljudi i okoliš ovih zamjenskih tvari.
5. Konferencija stranaka će ocjenjivati trajnu potrebu za tim kemikalijama u različite prihvatljive namjene i posebna izuzeća na temelju dostupnih znanstvenih, tehničkih, ekoloških i ekonomskih informacija, uključujući:
(a) informacije sadržane u izvješćima opisanim u stavku 3.;
(b) podatake o proizvodnji i uporabi tih kemikalija;
(c) informacije o dostupnosti, održivosti i provedbi zamjena tih kemikalija;
(d) informacije o napretku vezanom uz unaprijeđenje kapaciteta u državama za siguran i pouzdan prelazak na takve zamjenske tvari.
6. Procjena iz prethodnog stavka mora se provesti najkasnije u 2015. te svake četiri godine nakon toga, povezano s održavanjem redovih Konferencija stranaka.
7. Zbog složenosti uporabe u mnogim sektorima društva vezanih uz upotrebu tih kemikalija, moglo bi biti uporabe ovih kemikalija u druge namjene, a da stranke nisu trenutno svjesne toga. Stranke koje postaju svjesne uporabe za druge namjene potiču se da o tome stoje prije moguće obavijeste Tajništvo.
8. Stranka može, u bilo koje vrijeme povući svoje ime iz Registra prihvatljive namjene nakon pisane obavijesti Tajništvu. Povlačenje će stupiti na snagu na datum naveden u obavijesti.
9. Odredbe napomene (iii) Dijela I. Dodatka B ne primjenjuju se na te kemikalije.
SC-4/18: Unos tetrabromodifenil etera i pentabromodifenil etera

Uzimajući u obzir procjenu rizika i ocjenu upravljanja rizicima za komercijalni pentabromodifenil eter koju je dostavilo Povjerenstvo za razmatranje postojanih organskih onečišćujućih tvari,17

3. Odlučila je u Dodatak A umetnuti novi Dio IV. kako slijedi:

Tetrabromodifenil eter i pentabromodifenil eter
1. Stranka može dozvoliti recikliranje proizvoda koji sadrže ili mogu sadržavati tetrabromodifenil eter i pentabromodifenil eter, te uporabu i konačno zbrinjavanje proizvoda proizvedenih od recikliranih materijala koji sadrže ili mogu sadržavati tetrabromodifenil eter i pentabromodifenil eter, pod pretpostavkom da:
(a) se recikliranje i konačno zbrinjavanje provode na okolišu prihvatljiv način i ne dovode do oporabe tetrabromodifenil etera i pentabromodifenil etera za potrebe ponovne uporabe;
(b) stranka ne dozvoli da ovo izuzeće dovede do izvoza proizvoda koji sadrže koncentracije tetrabromodifenil etera i pentabromodifenil etera koje prekoračuju one dozvoljene za prodaju na državnom teritoriju stranke; i
(c) je stranka obavijestila Tajništvo o svojoj namjeri korištenja ovog izuzeća.
2. Na šestom redovnom sastanku Konferencije stranaka i svakom drugom sastanku, Konferencija stranaka ocijenit će napredak koji su stranke ostvarile prema postizanju konačnog cilja uklanjanja tetrabromodifenil etera i pentabromodifenil etera sadržanog u proizvodima i revidirati daljnju potrebu za ovim posebnim izuzećem. Ovo posebno izuzeće u svakom slučaju ističe najkasnije 2030.
4. Odlučila je izmijeniti i dopuniti Xxx X. Dodatka A Konvencije umetanjem zareza i riječi "i uporabu tetrabromodifenil etera i pentabromodifenil etera u skladu s odredbama Dijela IV. ovog Dodatka" u napomenu (iv), nakon riječi "polikloriranih bifenila u predmetima koji se upotrebljavaju u skladu s odredbama Dijela II.".

Part IV
Hexabromodiphenyl ether and heptabromodiphenyl ether
1. A Party may allow recycling of articles that contain or may contain hexabromodiphenyl ether and heptabromodiphenyl ether, and the use and final disposal of articles manufactured from recycled materials that contain or may contain hexabromodiphenyl ether and heptabromodiphenyl ether, provided that:
(a) The recycling and final disposal is carried out in an environmentally sound manner and does not lead to recovery of hexabromodiphenyl ether and heptabromodiphenyl ether for the purpose of their reuse;
(b) The Party takes steps to prevent exports of such articles that contain levels/concentrations of hexabromodiphenyl ether and heptabromodiphenyl ether exceeding those permitted for the sale, use, import or manufacture of those articles within territory of the Party; and
(c) The Party has notified the Secretariat of its intention to make use of this exemption.
2. At its sixth ordinary meeting and at every second ordinary meeting thereafter the Conference of the Parties shall evaluate the progress that Parties have made towards achieving their ultimate objective of elimination of hexabromodiphenyl ether and heptabromodiphenyl ether contained in articles and review the continued need for this specific exemption. This specific exemption shall in any case expire at the latest in 2030.
4. Decides to amend part I of Annex A of the Convention by inserting in note (iv), after the words "polychlorinated biphenyls in articles in use in accordance with the provisions of Part II", a comma and the words "and the use of hexabromodiphenyl ether and heptabromodiphenyl ether in accordance with the provisions of Part IV of this Annex".

Part III
Perfluorooctane sulfonic acid, its salts and perfluorooctane sulfonyl fluoride
1. The production and use of perfluorooctane sulfonic acid (PFOS), its salts and perfluorooctane sulfonyl fluoride (PFOSF) shall be eliminated by all Parties except as provided in part I of this Annex for Parties that have notified the Secretariat of their intention to produce and/or use them for acceptable purposes. A Register of Acceptable Purposes is hereby established and shall be available to the public. The Secretariat shall maintain the Register of Acceptable Purposes. In the event that a Party not listed in the Register determines that it requires the use of PFOS, its salts or PFOSF for the acceptable purposes listed in part I of this Annex it shall notify the Secretariat as soon as possible in order to have its name added forthwith to the Register.
2. Parties that produce and/or use these chemicals shall take into account, as appropriate, guidance such as that given in the relevant parts of the general guidance on best available techniques and best environmental practices given in part V of Annex C of the Convention.
3. Every four years, each Party that uses and/or produces these chemicals shall report on progress made to eliminate PFOS, its salts and PFOSF and submit information on such progress to the Conference of the Parties pursuant to and in the process of reporting under Article 15 of the Convention.
4. With the goal of reducing and ultimately eliminating the production and/or use of these chemicals, the Conference of the Parties shall encourage:
(a) Each Party using these chemicals to take action to phase out uses when suitable alternatives substances or methods are available;
(b) Each Party using and/or producing these chemicals to develop and implement an action plan as part of the implementation plan specified in Article 7 of the Convention;
(c) The Parties, within their capabilities, to promote research on and development of safe alternative chemical and non-chemical products and processes, methods and strategies for Parties using these chemicals, relevant to the conditions of those Parties. Factors to be promoted when considering alternatives or combinations of alternatives shall include the human health risks and environmental implications of such alternatives.
5. The Conference of the Parties shall evaluate the continued need for these chemicals for the various acceptable purposes and specific exemptions on the basis of available scientific, technical, environmental and economic information, including:
(a) Information provided in the reports described in paragraph 3;
(b) Information on the production and use of these chemicals;
(c) Information on the availability, suitability and implementation of alternatives to these chemicals;
(d) Information on progress in building the capacity of countries to transfer safely to reliance on such alternatives.
6. The evaluation referred to in the preceding paragraph shall take place no later than in 2015 and every four years thereafter, in conjunction with a regular meeting of the Conference of the Parties.
7. Due to the complexity of the use and the many sectors of society involved in the use of these chemicals, there might be other uses of these chemicals of which countries are not presently aware. Parties which

become aware of other uses are encouraged to inform the Secretariat as soon as possible.
8. A Party may, at any time, withdraw its name from the Register of acceptable purposes upon written notification to the Secretariat. The withdrawal shall take effect on the date specified in the notification.
9. The provisions of note (iii) of part I of Annex B shall not apply to these chemicals.
SC-4/18: Listing of tetrabromodiphenyl ether and pentabromodiphenyl ether
The Conference of the Parties,
Having considered the risk profile and risk management evaluation for commercial pentabromodiphenyl ether transmitted by the Persistent Organic Pollutants Review Committee,17
Taking note of the recommendation by the Persistent Organic Pollutants Review Committee to list tetrabromodiphenyl ether and pentabromodiphenyl ether in Annex A of the Convention,18
1. Decides to amend part I of Annex A of the Convention to list therein tetrabromodiphenyl ether and pentabromodiphenyl ether, as defined in paragraph 2 of the present decision, with a specific exemption for articles containing tetrabromodiphenyl ether and pentabromodiphenyl ether in accordance with the provisions of part IV of the Annex, by inserting the following row:

"Tetrabromodiphenyl ether and pentabromodiphenyl ether" means 2,2',4,4'-tetrabromodiphenyl ether (BDE-47, CAS No: 40088-47-9) and 2,2',4,4',5-pentabromodiphenyl ether (BDE-99, CAS No: 32534-81-9) and other tetra- and pentabromodiphenyl ethers present in commercial pentabromodiphenyl ether.
3. Decides to insert a new part IV to Annex A as follows:
Part IV
Tetrabromodiphenyl ether and pentabromodiphenyl ether
1. A Party may allow recycling of articles that contain or may
contain tetrabromodiphenyl ether and pentabromodiphenyl ether, and the use and final disposal of articles manufactured from recycled materials that contain or may contain tetrabromodiphenyl ether and pentabromodiphenyl ether, provided that:
(a) The recycling and final disposal is carried out in an environmentally sound manner and does not lead to recovery of tetrabromodiphenyl ether and pentabromodiphenyl ether for the purpose of their reuse;

(b) The Party does not allow this exemption to lead to the export of articles containing levels/concentrations of tetrabromodiphenyl ether and pentabromodiphenyl ether that exceed those permitted to be sold within the territory of the Party; and
(c) The Party has notified the Secretariat of its intention to make use of this exemption.
2. At its sixth ordinary meeting and at every second ordinary meeting thereafter the Conference of the Parties shall evaluate the progress Parties made towards achieving their ultimate objective of elimination of tetrabromodiphenyl ether and Pentabromodiphenyl ether contained in articles and review the continued need for this specific exemption. This specific exemption shall in any case expire at the latest in 2030.
4. Decides to amend part I of Annex A of the Convention by inserting in note (iv), after the words "polychlorinated biphenyls in articles in use in accordance with the provisions of Part II", a comma and the words "and the use of tetrabromodiphenyl ether and pentabromodiphenyl ether in accordance with the provisions of Part IV of this Annex".

Uzimajući u obzirprocjenu rizika i ocjenu upravljanja rizicima za heksabromociklododekan kako je dostavljeno od strane Povjerenstva za razmatranje postojanih organskih onečišćujućih tvari.1
Uzimajući u obzir preporuke Povjerenstva za razmatranje postojanih organskih onečišćujućih tvari za unos heksabromociklododekana u Dodatak A Konvencije s posebnim izuzećem za proizvodnju i upotrebu u ekspandiranim polistirenima i ekstruditranim polistirenima u zgradarstvu.2

Svaka stranka koja se registrira za izuzeća sukladno članku 4. za proizvodnju i upotrebu u ekspandiranim polistirenima i ekstrudiranim polistirenima u zgradarstvu podnijet će odgovarajuće mjere da se osigura jednostavna identifikacija ekspandiranih polistirena i ekstrudiranih polistirena koji sadrže heksabromociklododekan tijekom cijelog njegovog životnog vijeka.

Provedba Dodatka G, Izmjena i dopuna Dodataka A, B i C, Izmjene i dopune Dodatka A iz travnja 2011. godine i Izmjene i dopune Dodatka A iz svibnja 2013. godine, iz članka 1. ove Uredbe u djelokrugu je središnjih tijela državne uprave nadležnih za poslove zaštite okoliša, zdravlja, poljoprivrede, šumarstva i vodnog gospodarstva, te gospodarstva.
Članak 7.
Dodatak G iz svibnja 2005. godine iz članka 1. ove Uredbe stupio je na snagu u odnosu na Republiku Hrvatsku 27. ožujka 2007. godine.
Izmjene i dopune Dodataka A, B i C iz svibnja 2009. godine iz članka 1. ove Uredbe stupile su na snagu u odnosu na Republiku Hrvatsku 26. kolovoza 2010. godine.
Izmjena i dopuna Dodatka A iz travnja 2011. godine iz članka 1. ove Uredbe u odnosu na Republiku Hrvatsku stupila je na snagu 27. listopada 2012. godine.
Izmjena i dopuna Dodatka A iz svibnja 2013. godine iz članka 1. ove Uredbe stupila je na snagu u odnosu na Republiku Hrvatsku 26. studenoga 2014. godine.
Članak 8.
Ova Uredba stupa na snagu osmoga dana od dana objave u Narodnim novinama.

OBRAZLOŽENJE
Prijedloga Uredbe o objavi Dodatka G od 6. svibnja 2005. godine, Izmjena i dopuna Dodataka A, B i C iz svibnja 2009. godine, Izmjene i dopune Dodatka A iz travnja 2011. godine i Izmjene i dopune Dodatka A iz svibnja 2013. godine Stockholmske konvencije o postojanim organskim onečišćujućim tvarima
Republika Hrvatska je ratificirala Stockholmsku konvenciju o postojanim organskim onečišćujućim tvarima s dodacima A do F kao sastavnim dijelom u studenom 2006. godine Zakonom o potvrđivanju Stockholmske konvencije o postojanim organskim onečišćujućim tvarima (Narodne novine-Međunarodni ugovori 11/06), a stranka je Konvencije od 30. travnja 2007. godine (Narodne novine-Međunarodni ugovori 2/07) (u daljnjem tekstu: Konvencija).
Provedba Zakona o potvrđivanju Konvencije u djelokrugu je središnjih tijela državne uprave nadležnih za poslove zaštite okoliša, poljoprivrede, šumarstva i vodnog gospodarstva, zdravstva te gospodarstva, rada i poduzetništva.
Člankom 22. stavkom 3. Zakona opisan je postupak predlaganja, usvajanja i stupanja na snagu daljnjih dodataka Konvenciji.
31. listopada 2007. godine glavni tajnik Ujedinjenih naroda/depozitar dostavio je strankama Konvencije obavijest o stupanju na snagu Dodatka G na dan 27. ožujka 2007. godine. Taj je dodatak stupio na snagu i za Republiku Hrvatsku sukladno članku 22. stavku 3(c) kao stranku Konvencije. Navedeni tekst Dodataka G postaje sastavni dio K onvencije za sve stranke Konvencije.
Republika Hrvatska nije u svojoj ispravi o ratifikaciji izjavila da će svaka izmjena i dopuna Dodataka A, B ili C stupiti na snagu nakon polaganja njezine isprave o ratifikaciji, prihvatu odobrenju ili pristupu u odnosu na istu sukladno članku 25. stavku 4. Konvencije. Republika Hrvatska nije podnijela izjavu o neprihvaćanju Dodataka G te je isti stupio na snagu za sve države stranke (dakle i Republiku Hrvatsku).
Izmjene i dopune Dodataka A, B, i C stupile su na snagu 26. kolovoza 2010. godine. Dodatne izmjene i dopune Dodatka A stupile su na snagu 27. listopada 2012. godine sukladno članku
22. stavku 3(c) Konvencije te 26. studenoga 2014 godine.

The Secretary-General of the United Nations, acting in his capacity as depositary, communicates the following:
At the First Meeting of the Conference of the Parties to the above Convention, held in Punta del Esle, Uruguay, from 2 to 6 May 2005, the Parties adopted on 6 May 2005 a new annex to the Convention (Annex G) (see Decision SC-1/2).
In accordance with paragraph 3 (c) of article 22 of the Convention, on the expiry of one year from the date of this notification, the adoption of Annex G shall become effective for all Parties to the Convention which have not submitted a notification in accordance with the provisions of paragraph 3
(b) of the same article.

SC-1/2: Settlement of disputes
The Conference of the Parties,
Adopts, as Annex G to the Convention, the following arbitration procedure for purposes of paragraph 2 (a) of Article 18 of the Convention and conciliation procedure for purposes of paragraph 6 of Article 18 of the Convention.
Annex G
I. Arbitration procedure
The arbitration procedure for purposes of paragraph 2 (a) of Article 18 of the Convention shall be as follows:
Article 1
1. A Party may initiate recourse to arbitration in accordance with Article 18 of the Convention by written notification addressed to the other party to the dispute. The notification shall be accompanied by a statement of the claim, together with any supporting documents, and state the subject-matter of arbitration and include, in particular, the articles of the Convention the interpretation or application of which are at issue.
2. The claimant party shall notify the Secretariat that the parties are referring a dispute to arbitration pursuant to Article 18. The notification shall be accompanied by the written notification of the claimant party, the statement of claim and the supporting documents referred to in paragraph 1 above. The Secretariat shall forward the information thus received to all Parties.
Article 2
1. If a dispute is referred to arbitration in accordance with Article 1 above, an arbitral tribunal shall be established. It shall consist of three members.
2. Each of the parties to the dispute shall appoint an arbitrator and the two arbitrators so appointed shall designate by common agreement the third arbitrator, who shall be the President of the tribunal. The President of the tribunal shall not be a national of one of the parties to the dispute, nor have his or her usual place of residence in the territory of one of those parties, nor be employed by any of them, nor have dealt with the case in any other capacity.
3. In disputes between more than two parties, parties in the same interest shall appoint one arbitrator jointly by agreement.
4. Any vacancy shall be filled in the manner prescribed for the initial appointment.
5. If the parties do not agree on the subject-matter of the dispute before the President of the arbitral tribunal is designated, the arbitral tribunal shall determine the subject-matter.
Article 3
1. If one of the parties to the dispute does not appoint an arbitrator within two months of the date on which the respondent party receives the notification of the arbitration, the other party may inform the Secretary-General of the United Nations, who shall make the designation within a further two-month period.
2. If the President of the arbitral tribunal has not been designated within two months of the date of the appointment of the second arbitrator, the Secretary-General of the United Nations shall, at the request of a party, designate the President within a further two-month period.
Article 4
The arbitral tribunal shall render its decisions in accordance with the provisions of the Convention and international law.
Article 5
Unless the parties to the dispute otherwise agree, the arbitral tribunal shall determine its own rules of procedure.
Article 6
The arbitral tribunal may, at the request of one of the parties, indicate essential interim measures of protection.
Article 7
The parties to the dispute shall facilitate the work of the arbitral tribunal and, in particular, using all means at their disposal, shall:
(a) Provide it with all relevant documents, information and facilities; and
(b) Enable it, when necessary, to call witnesses or experts and receive their evidence.
Article 8
The parties and the arbitrators are under an obligation to protect the confidentiality of any information they receive in confidence during the proceedings of the arbitral tribunal.
Article 9
Unless the arbitral tribunal determines otherwise because of the particular circumstances of the case, the costs of the tribunal shall be borne by the parties to the dispute in equal shares. The tribunal shall keep a record of all its costs, and shall furnish a final statement thereof to the parties.
Article 10
A party that has an interest of a legal nature in the subject matter of the dispute which may be affected by the decision in the case may intervene in the proceedings with the consent of the tribunal.
Article 11
The tribunal may hear and determine counterclaims arising directly out of the subject matter of the dispute.
Article 12
Decisions both on procedure and substance of the arbitral tribunal shall be taken by a majority vote of its members.
Article 13
1. If one of the parties to the dispute does not appear before the arbitral tribunal or fails to defend its case, the other party may request the tribunal to continue the proceedings and to make its award. Absence of a party or a failure of a party to defend its case shall not constitute a bar to the proceedings.
2. Before rendering its final decision, the arbitral tribunal must satisfy itself that the claim is well founded in fact and law.
Article 14
The tribunal shall render its final decision within five months of the date on which it is fully constituted unless it finds it necessary to extend the time limit for a period which should not exceed five more months.
Article 15
The final decision of the arbitral tribunal shall be confined to the subject matter of the dispute and shall state the reasons on which it is based. It shall contain the names of the members who have participated and the date of the final decision. Any member of the tribunal may attach a separate or dissenting opinion to the final decision.
Article 16
The award shall be binding on the parties to the dispute. The interpretation of the Convention given by the award shall also be binding upon a Party intervening under Article 10 above insofar as it relates to matters in respect of which that Party intervened. The award shall be without appeal unless the parties to the dispute have agreed in advance to an appellate procedure.
Article 17
Any controversy which may arise between those bound by the final decision in accordance with Article 16 above, as regards the interpretation or manner of implementation of that decision, may be submitted by any of them for decision to the arbitral tribunal which rendered it.
Conciliation procedure
The conciliation procedure for purposes of paragraph 6 of Article 18 of the Convention shall be as follows:
Article 1
1. A request by a party to a dispute to establish a conciliation commission in consequence of paragraph 6 of Article 18 shall be addressed in writing to the Secretariat. The Secretariat shall forthwith inform all Parties to the Convention accordingly.
2. The conciliation commission shall, unless the parties otherwise agree, be composed of three members, one appointed by each party concerned and a President chosen jointly by those members.
Article 2
In disputes between more than two parties, parties in the same interest shall appoint their members of the commission jointly by agreement.
Article 3
If any appointments by the parties are not made within two months of the date of receipt by the Secretariat of the written request referred to in Article 1, the Secretary-General of the United Nations shall, upon request by a party, make those appointments within a further two-month period.
Article 4
If the President of the conciliation commission has not been chosen within two months of the second member of the commission being appointed, the Secretary-General of the United Nations shall, upon request by a party, designate the President within a further two-month period.
Article 5
1. The conciliation commission shall, unless the parties to the dispute otherwise agree, determine its own rules of procedure.
2. The parties and members of the commission are under an obligation to protect the confidentiality of any information they receive in confidence during the proceedings of the commission.
Article 6
The conciliation commission shall take its decisions by a majority vote of its members.
Article 7
The conciliation commission shall render a report with recommendations for resolution of the dispute withm twelve months of being established, which the parties shall considei m good faith
Article 8
Any disagreement as to whether the conciliation commission has competence to consider a matter referred to it shall be decided by the commission
Article 9
The costs of the commission shall be borne by the parties to the dispute in shares agreed by them The commission shall keep the record of all its costs and shall furnish a final statement thereof to the parties

In accordance with paragraphs 3(b) and 3(c) and paragraph 4 of article 22 of the Convention, any Party that is unable to accept an amendment to Annex A, B or C shall so notify the depositary, in writing, within one year from the date of communication by the depositary of the adoption of the amendment. The depositary shall without delay notify all Parties of any such notification received. A Party may at any time withdraw a previous notification of non-acceptance in respect of any amendment to Xxxxx A, B or C, and the annex shall thereupon enter into force for that Party subject to paragraph 3(c) of article 22. On the expiry of one year from the date of the communication by the depositary of the adoption of the amendment to Annex A, B or C, the amendment shall enter into force for all Parties that have not submitted a notification in accordance with the provisions of paragraph 3(b) of article 22.
In accordance with paragraph 4 of article 22, an amendment to Annex A, B or C shall not enter into force with respect to any Party that has made a declaration with respect to amendment to those Annexes in accordance with paragraph 4 of article 25, in which case any such amendment shall enter

Part IV
Hexabromodiphenyl ether and heptabromodiphenyl ether
1. A Party may allow recycling of articles that contain or may contain hexabromodiphenyl ether and heptabromodiphenyl ether, and the use and final disposal of articles manufactured from recycled materials that contain* or may contain hexabromodiphenyl ether and heptabromodiphenyl ether, provided that:
(a) The recycling and final disposal is carried out in an environmentally sound manner and does not lead to recovery of hexabromodiphenyl ether and heptabromodiphenyl ether for the purpose of their reuse;
(b) The Party takes steps to prevent exports of such articles that contain levels/concentrations of hexabromodiphenyl ether and heptabromodiphenyl ether exceeding those permitted for the sale, use, import or manufacture of those articles within territory of the Party; and
(c) The Party has notified the Secretariat of its intention to make use of this exemption.
2. At its sixth ordinary meeting and at every second ordinary meeting thereafter the Conference of the Parties shall evaluate the progress that Parties have made towards achieving their ultimate objective of elimination of hexabromodiphenyl ether and heptabromodiphenyl ether contained in articles and review the continued need for this specific exemption. This specific exemption shall in any case expire at the latest in 2030.
4. Decides to amend part 1 of Annex A of the Convention by inserting in note (iv), after the words "polychlorinated biphenyls in articles in use in accordance with the provisions of Part H", a comma and the words "and the use of hexabromodiphenyl ether and heptabromodiphenyl ether in accordance with the provisions of Part IV of this Annex".

2. Also decides to create a new part III in Annex B called "Perfluorooctane sulfonic acid (PFOS), its salts, and perfluorooctane sulfonyl fluoride (PFOSF)", which reads:
Part HI
Perfluorooctane sulfonic acid, Its salts and perfluorooctane sulfonyl fluoride
1. The production and use of perfluorooctane sulfonic acid (PFOS), its salts and perfluorooctane sulfonyl fluoride (PFOSF) shall be eliminated by all Parties except as provided in part I of this Annex for Parties that have notified the Secretariat of their intention to produce and/or use them for acceptable purposes. A Register of Acceptable Purposes is hereby established and shall be available to the public. The Secretariat shall maintain the Register of Acceptable Purposes. In the event that a Party not listed in the Register determines that it requires the use of PFOS, its salts or PFOSF for the acceptable purposes listed in part I of this Annex it shall notify the Secretariat as soon as possible in order to have its name added forthwith to the Register.
2. Parties that produce and/or use these chemicals shall take into account, as appropriate, guidance such as that given in the relevant parts of the general guidance on best available techniques and best environmental practices given in part V of Annex C of the Convention.
3. Every four years, each Party that uses and/or produces these chemicals shall report on progress made to eliminate PFOS, its salts and PFOSF and submit information on such progress to the Conference of the Parties pursuant to and in the process of reporting under Article 15 of the Convention.
4. With the goal of reducing and ultimately eliminating the production and/or use of these chemicals, the Conference of the Parties shall encourage:
(a) Each Party using these chemicals to take action to phase out uses when suitable alternatives substances or methods are available;
(b) Each Party using and/or producing these chemicals to develop and implement an action plan as part of the implementation plan specified in Article 7 of the Convention;
(c) The Parties, within their capabilities, to promote research on and development of safe alternative chemical and non-chemical products and processes, methods and strategies for Parties using these chemicals, relevant to the conditions of those Parties. Factors to be promoted when considering alternatives or combinations of alternatives shall include the human health risks and environmental implications of such alternatives.
5. The Conference of the Parties shall evaluate the continued need for these chemicals for the various acceptable purposes and specific exemptions on the basis of available scientific, technical, environmental and economic information, including:
(a) Information provided in the reports described in paragraph 3;
(b) Information on the production and use of these chemicals;
(c) Information on the availability, suitability and implementation of alternatives to these chemicals;
(d) Information on progress in building the capacity of countries to transfer safely to reliance on such alternatives.
6. The evaluation referred to in the preceding paragraph shall take place no later than in 2015 and every four years thereafter, in conjunction with a regular meeting of the Conference of the Parties.
7. Due to the complexity of the use and the many sectors of society involved in the use of these chemicals, there might be other uses of these chemicals of which countries are not presently aware. Parties which

become aware of other uses are encouraged to inform the Secretariat as soon as possible,
8. A Party may, at any time, withdraw its name from the Register of acceptable purposes upon written notification to the Secretariat. The withdrawal shall take effect on the date specified in the notification.
9. The provisions of note (iii) of part I of Annex B shall not apply to these chemicals.
SC-4/18: Listing of tetrabroraodiphenyl ether and pentabromodiphenyl ether

Taking note of the recommendation by the Persistent Organic Pollutants Review Committee to list tetrabromodiphenyl ether and pentabromodiphenyl ether in Annex A of the Convention,"
1. Decides to amend part I of Annex A of the Convention by listing therein tetrabromodiphenyl ether and pentabromodiphenyl ether, as defined in paragraph 2 of the present decision, with a specific exemption for articles containing tetrabromodiphenyl ether and pentabromodiphenyl ether in accordance with the provisions of part IV of the Annex, by inserting the following row:

For the purpose ofthis Annex:
"Tetrabromodiphenyl ether and pentabromodiphenyl ether" means 2,2',4,4'-tetrabromodiphenyl ether (BDE-47, CAS No: 40088-47-9) and 2,2',4,4',5-pentabromodiphenyl ether (BDE-99, CAS No: 32534-81-9) and other tetra- and pentabromodiphenyl ethers present in commercial pentabromodiphenyl ether.
3. Decides to insert a new part IV to Annex A as follows:
Part IV
Tetrabromodiphenyl ether and pentabromodiphenyl ether
1. A Party may allow recycling of articles that contain or may contain tetrabromodiphenyl ether and pentabromodiphenyl ether, and the use andfinaldisposal of articles manufactured from recycled materials that contain or may contain tetrabromodiphenyl ether and pentabromodiphenyl ether, provided that:
(a) The recycling andfinaldisposal is carried out in an environmentally sound manner and does not lead to recovery of tetrabromodiphenyl ether and pentabromodiphenyl ether for the purpose of their reuse;

(b) The Party does not allow this exemption to lead to the export of articles containing levels/concentrations of tetrabromodiphenyl ether and pentabromodiphenyl ether that exceed those permitted to be sold within the territory of the Party; and
(c) The Party has notified the Secretariat of its intention to make use of this exemption.
2. At its sixth ordinary meeting and at every second ordinary meeting thereafter the Conference of the Parties shall evaluate the progress Parties made towards achieving their ultimate objective of elimination of tetrabromodiphenyl ether and pentabromodiphenyl ether contained in articles and review the continued need for this specific exemption. This specific exemption shall in any case expire at the latest in 2030.
4. Decides to amend part I of Annex A of the Convention by inserting in note (iv), after the words "polychlorinated biphenyls in articles in use in accordance with the provisions of Part II", a comma and the words "and the use of tetrabromodiphenyl ether and pentabromodiphenyl ether in accordance with the provisions of Part IV of this Annex".

At its fifth meeting held in Geneva from 25 to 29 April 2011, the Conference of the Parties to the above Convention adopted an amendment to Annex A by decision SC-5/3 to list the chemical "technical endosulfan and its related isomers" in the annex
In accordance with paragraphs 3 (b) and 3 (c) and paragraph 4 of article 22 of the Convention, any Party that is unable to accept an amendment to Annex A, B or C shall so notify the depositary, in writing, within one year from the date of communication by the depositary of the adoption of the amendment The depositary shall without delay notify all Parties of any such notification received A Party may at any time withdraw a previous notification of non-acceptance in respect of any amendment to Annex A, B or C, and the amendment shall thereupon enter into force for that Party subject to paragraph 3 (c) of article 22 On the expiry of one year from the date of the communication by the depositary of the adoption of the amendment to Annex A, B or C, the amendment shall enter into force for all Parties that have not submitted a notification in accordance with the provisions of paragraph 3 (b) of article 22
In accordance with paragraph 4 of article 22, an amendment to Annex A, B or C shall not enter into force with respect to any Party that has made a declaration with respect to any amendment to those Annexes in accordance with paragraph 4 of article 25, in which case any such amendment shall enter into force for such a Party on the ninetieth day after the date of deposit with the depositary of its instrument of ratification, acceptance, approval or accession with rebpect to such amendment

Taking note of the recommendation by the Persistent Organic Pollutants Review Committee to list technical endosulfan, its related isomers and endosulfan sulfate in Annex A to the Convention, with specific exemptions,2
1. Decides to amend part 1 of Annex A to the Stockholm Convention on Persistent Organic Pollutants to list therein technical endosulfan and its related isomers, with specific exemptions for production as allowed for the parties listed in the Register of Specific Exemptions and/or for use on crop-pest complexes as listed in accordance with the provisions of a new part VI of the annex by inserting the following row:

At its sixth meeting held in Geneva from 28 April to 10 May 2013 the Confeience of the Parties to the above Convention adopted an amendment to Annex A in its decision SC-6/13 to list the chemical hexabromocyclododecanc*' in the annex

Decides to amend part I of Annex A to the Stockholm Convention on Persistent Organic Pollutants to list therein hexabromocyclododecane, with specific exemptions for production as allowed for the parties listed in the register of specific exemptions and for use in expanded polystyrene and extruded polystyrene in buildings by inserting the following row:

3. Further decides to insert a new part VII in Annex A as follows:

Each Party that has registered for the exemption pursuant to Article 4 for the production and use of hexabromocyclododecane for expanded polystyrene and extruded polystyrene in buildings shall take necessary measures to ensure that expanded polystyrene and extruded polystyrene containing hexabromocyclododecane can be easily identified by labelling or other means throughout its lite cycle.
