Na osnovu člana 68 Zakona o visokom obrazovanju Republike Srpske (Službeni glasnik Republike Srpske br. 67/20) i na osnovu Statuta Panevropskog univerziteta ugovorne strane zaključuju

UGOVOR O STUDIRANJU

u akademskoj 2022/2023. godini br.     

zaključen dana 2022. godine u Banjaluci između:

1. Panevropskog univerziteta "APEIRON" sa sjedištem u Banjoj Xxxx Xxxx Xxxxx 13, xxx visokoškolske ustanove koja pruža obrazovne usluge, sa jedne strane (u daljem tekstu "Panevropski univerzitet") i

2. prebivalište

na adresi

upisan 2022/23. god. na studijskom programu

na treći ciklus studija (doktorski studiji) u trogo- dišnjem trajanju - 180 ECTS, kao studenta koji preuzima obrazovne usluge u cilju sticanja odgovarajuće diplome i naučnog zvanja ( u daljem tekstu "student").

Predmet ugovora

Član 1

Ovim Ugovorom uređuju se prava i obaveze između Panevropskog univerziteta i studenta u cilju obezbjeđenja kvaliteta studija i pruženih obrazovnih usluga u skladu sa normama i standardima kvaliteta propisanim xx xxxxxx nadležnog ministarstva i Pravilnikom o kvalitetu Panevropskog univerziteta, koje će u konačnom ishodu omogućiti preuzimanje kritične mase znanja, vještina i razvoj sposobnosti studenata za postizanje odgovarajućih stručnih i naučnih kompetencija, te sticanje odgovarajuće diplome i zvanja xx xxxxxx studenta.

Osnovni principi

Član 2

Studenti Panevropskog univerziteta uživaju slobodu govora, organizovanja u studentske i druge asocijacije i slobodu okupljanja što može biti ograničeno samo zakonom i što uključuje i pravo studenata da kritički razmatraju, ispituju i testiraju primljena znanja, da nude nove ideje i kontraverzna mišljenja a da se time ne izlažu opasnosti od gubitka svog statusa, ili gubitka drugih privilegija koje uživaju u okviru Univerziteta.

Subject of the Agreement Article 1

By this contract rights and obligations between the Pan- European University and the student are regulated in order to ensure the quality of studies and educational services, rendered in accordance with the standards of quality, prescribed under the authority of the Ministry and by the quality standards and assurance of Pan-European University. In the final outcome, it will provide to the student a xxxxxxxx xxxx of knowledge, skills and development of student's ability to achieve particular professional and scientific competencies and to acquire particular diploma degree and qualification.

Basic Principles Article 2

Students of the Pan-European University enjoy the freedom of speech, organisation of student's and other associations as well as the right to hold public meetings which might only be limited by the Law. They are also entitled to critically discuss, to question and to test the received knowledge, offer new ideas and controversial opinions by which they would not expose themselves to the risk of losing their status or other privileges that they enjoy at the University.

Student Panevropskog univerziteta neće biti diskriminisan u pogledu opštih i specijalnih ljudskih prava a posebno po osnovu rase, vjeroispovjesti, nacionalnog ili etničkog porjekla, životne dobi (nakon punoljetstva), pola, seksualne orjentacije, bračnog ili roditeljskog statusa, invalidnosti ili bilo kojeg fizičkog hendikepa, civilnog statusa i državljanstva, te materijalnog statusa, a posebno prava na upis na Univerzitet, prava na produžetak studija i prava na obrazovanje, uslova studiranja i ocjenjivanja postignuća studenta, pristupa istraživačkim i ostalim resursima Univerziteta, tretmana i angažovanja na Univerzitetu odn. mogućnosti zaposlenja na Univerzitetu.

Član 4

Nastava na Panevropskom univerzitetu za sve vidove studija izvodi se na jednom od jezika konstitutivnih naroda BiH i/ili na jednom od svjetskih jezika xxxx xx navedeno u kurikulumu predmeta. Studenti mogu polagati ispite na jednom od jezika konstitutivnih naroda, po vlastitom izboru. Na Panevropskom univerzitetu su u ravnopravnoj upotrebi ćirilično i latinično pismo.

Article 3

Student at the Pan-European University will not be discriminated against any of these particular human rights, especially in regard of race, religion, national or ethnical background, age, sex, sexual orientation, marital or parental status, disability or any other physical handicap, civil status and citizenship, as well as financial status, especially the rights to enrol at the University, right to continue studies and the right on education, transparent conditions of studying and objective evaluation of student's achievements, right to access the free research and other resources of the University, fair treatments regarding engagement at the University, and possibilities of the employment.

Article 4

Lecturing for all types of studies is organized at the Pan- European University on one of the languages of the constitutional nations in BiH and/or in foreign languages stated in subject curricula. Students are allowed, as a personal choice, to take exams in any language of the constitutional nationalities. Both, Cyrillic and Latin writing are equally used.

Status studenta

Član 5

Status studenta xxxxx xx upisom na odgovarajući studijski program Panevropskog univerziteta. Ostvarivanje prava i obaveza studenta u nastavnom i istraživačkom procesu prati se kontinuirano tokom studija. Student je upisan na redovne / vanredne studije (nepotrebno precrtati).

Član 6

Da bi student koji je upisan na odgovarajuću godinu trogodišnjih doktorskih studija trećeg ciklusa upisao narednu godinu studija xxxx ispuniti sve obaveze iz individualnog nastavnog plana i programa predviđene za tekuću godinu studija. Student koji ne ispuni navedene obaveze obnavlja tekuću godinu doktorskih studija, te po xxx osnovu plaća odgovarajuće naknade u skladu sa Pravilima o visini naknade za studiranje i cijeni usluga na Panevropskom univerzitetu.

Član 7

Student može tokom akademske godine da pređe xx xxxxx visokoškolske ustanove i da se upiše na Panevropskom univerzitetu. Studentu koji u toku godine prelazi xx xxxxx visokoškolske ustanove, ili studentu koji ima položenih ispita u prethodnom školovanju na studiju trećeg ciklusa, mogu da se priznaju položeni ispiti odlukom dekana Fakulteta na kojem je upisan, a na osnovu prijedloga Komisije za priznavanje ispita i vrednovanje studijskih programa.

Doktorskom kandidatu mogu da se priznaju i objavljeni radovi u naučnoj periodici, učešće u naučnim skupovima, seminarski radovi odn. pristupni rad ukoliko pripadaju naučnim oblastima matičnosti doktorskog studijskog programa.

Student xx xxxxx da u daljem doktorskom školovanju na Univerzitetu položi svu razliku ispita, završi naučna istraživanja predviđena doktorskim projektom, da uspješno završi sve obavezne studijske aktivnosti predviđene studijskim programom, da uspješno izradi i odbrani završni doktorski rad, te da stekne broj kredit-bodova predviđen za završetak studija trećeg ciklusa.

Predmeti i ostale obavezne programske aktivnosti na doktorskom studiju koji ne pripadaju ni osnovnim niti sporednim oblastima matičnosti studijskog programa ne mogu se priznati.

Član 8

Uslovi upisa na doktorske studije trećeg ciklusa definisani su Pravilnikom o studiranju na doktorskim studijama trećeg ciklusa i Konkursom za upis.

Student Status

Article 5

Student status is acquired through the enrolment at appropriate study program, of the Pan-European University. Recognition of rights and obligations of students in the lecturing and research process is continuously monitored during the study. Student is enrolled on regular full-time / part-time studies (strikethrough the option that is not valid).

Article 6

To be able to enrol the subsequent year of studies, student has to fulfil all of the individual obligations planed in the anticipated syllabus for the current academic year. Student who is enrolled on the three-year doctoral study program of 180 ECTS, and did not fulfil obligations for the current year of doctoral study program, must re-enrol the uncompleted academic year and must pay the expenses and fees defined for the renewed year in accordance with the Rules on fees and prices of services on Pan-European University.

Article 7

During the ongoing academic year student is allowed to transfer from the other higher education institutions to Pan- European University. Exams passed at the transferring university, or exams passed in the previous doctorial study will be recognized by the Xxxx'x decision based on the proposal of the Commission for recognition of courses and evaluation of study programs.

Articles published in scientific periodicals, attendance at the scientific conferences, seminars and entry papers will be subject of recognition if belonging to the scientific fields of doctorial study.

Student is obliged to take the remaining exams and to finish doctorial scientific researches. Also, student will finish successfully the other mandatory study units anticipated by the doctorial study program and to complete and defend the doctoral dissertation accumulating sufficient ECTS credit-points proscribed by the third cycle study program.

Courses and other academic units which do not fit to the core units of study at the enrolled study program, neither to the subject specific fields, could not be recognized.

Article 8

Requirements for the enrollment on doctoral studies are defined in the Rules on doctoral studies of Pan-European University and by the Public announcement for enrollment.

Član 9

U toku školovanja student ne može preći sa jednog na drugi smjer/studijski program doktorskih studija trećeg ciklusa unutar Panevropskog univerziteta.

Član 10

Student ima pravo da provede određeno vrijeme (semestar ili studijsku godinu) na drugoj visokoškolskoj ili istraživačkoj ustanovi u zemlji ili u inostranstuvu posredstvom programa za razmjenu studenata, ili na bazi bilaterarnih ugovora između ustanova.

U skladu sa bilaterarnim ugovorom studentu se priznaje ostvareni broj bodova i rezultati istraživanja sa ustanove na kojoj je boravio.

Član 11

Status studenta prestaje:

a) završetkom studijskog programa i dobijanjem naučnog zvanja;

b) ispisom iz visokoškolske ustanove prije završetka studija;

c) kada student ne upiše narednu godinu studija ili ne obnovi upis u istu godinu studija, a ne miruju mu prava i obaveze studenta;

d) izricanjem disciplinske mjere isključenja sa Panevropskog univerziteta xx xxxxxx disciplinskog organa Panevropskog univerziteta.

Obaveze Panevropskog univerziteta

Član 12

Panevropski univerzitet se obavezuje da će u akademskoj godini obezbijediti planirani nastavno-obrazovni proces sa svim planiranim predmetnim jedinicama, nastavnim modulima i ostalim planiranim programskim aktivnostima u skladu sa individualnim nastavnim planom i programom doktorskog kandidata koji je usvojen na Naučno-nastavnom vijeću fakulteta.

Član 13

Panevropski univerzitet zadržava pravo da u vremenskom rasporedu planiranih aktivnosti može da izvrši manje promjene zbog prilagođenja tekućoj raspoloživosti nastavnog osoblja. Studenti će biti blagovremeno informisani o svakoj promjeni rasporeda.

Tekuće promjene i prilagođenja rasporeda programskih aktivnosti neće mijenjati strukturu nastavnog plana, već se prvenstveno odnose na vremenski raspored nastavnih jedinica. Tekuća prilagođenja rasporeda neće mijenjati kvantitativne parametre različitih programskih aktivnosti za više od 30 %.

Tekuće promjene rasporeda neće promijeniti ukupno planirano godišnje opterećenje studenata i planirani iznos od 60 ECTS za akademsku godinu.

Article 9

Student is not allowed to transfer from one to another doctorial studying program/department licensed at the Pan- European University.

Article 10

Student is entitled to spend specific time (semester or academic year) at other higher education or research institution in the country or abroad through the students exchange program or based on Learning Agreement between institutions.

In accordance to the Learning Agreement, the ECTS credit points achieved during his/her studies at the other Institution and research results will be recognized to the student.

Article 11

Student status is terminated:

a. By the completion of the study program and awarding the scientific title.

b. By the withdraw from the University prior to the completion of the studies;

c. By the failure of the student to enrol for the subsequent study year or to renew the enrolment for the current study year while his/her rights and liabilities are not adjourning.

d. By the disciplinary action of exclusion from University pronounced by the disciplinary authority of the Pan-European University.

Obligations of the Pan-European University Article 12

The Pan-European University is obliged to ensure the academic year studding process of all the planned course units, lecturing modules and other study units in accordance with the individual lecturing plan and program of the doctorial candidate accepted by the College Academic Council.

Article 13

The Pan-European University reserves the right to perform minor changes in the schedule of planned actions, due to adjustment of availability of teaching stuff. Student will be promptly informed about every change in the schedule.

Existing changes as well as the adjustment of the schedule of lecturing activities will not affect the structure of syllabus in regard to content of the courses, although they can modify the schedule of lecturing units. Existing adjustments of the schedule will not modify quantitative parameters of different lecturing activities, in the scope of some courses, for more than 30 %.

Present changes of schedule will not modify annual planned student's obligations and planned ECTS credits in amount of 60 per academic year.

Član 14

Individualni nastavni plan doktorskih studija trećeg ciklusa utvrđuje se odlukom Nastavno-naučnog vijeća Fakulteta na kojem se izvodi upisani studijski program, a na osnovu prijedloga kojeg utvrđuju student i njegov mentor zavisno od uže naučne oblasti xxxx xx student odabrao, izbornog programa studenta, programa istraživanja, kandidovane teze doktorskog rada i ostalih izvora ECTS bodovanja.

Article 14

Individual Syllabus of the student’s doctoral program is determined by the decision of the College Academic Council, based on the joint proposition of student and his/her mentor, depending on the chosen narrow scientific field, elective courses, research programme and other proposed sources of ECTS scoring.

Član 15

Student može da postavi posebne dodatne zahtjeve u smislu sticanja obrazovanja. U xxx slučaju student se pisanim podneskom obraća Senatu univerziteta.

Article 15

Student is allowed to set particular additional requests related to his/her educational needs and expectations. In this case student must address the university Senate with the written request.

Panevropski univerzitet se obavezuje da će za izvođenje nastavnog procesa obezbijediti potrebnu opremu i učila, te računarsku i informaciono-komunikacionu podršku, kao i potrebnu osnovnu literaturu sa direktnim pristupom pretraživačima baza naučnih časopisa u skladu sa propisanim standardima kvaliteta.

Zavisno od prirode istraživanja koja su planirana doktorskim istraživačkim projektom, Panevropski univerzitet se ne obavezuje da će obezbjediti svu neophodnu opremu i druga sredstva potrebna za istraživački projekt.

Univerzitet će zajedno sa doktorskim kandidatom uložiti napore da se obezbjedi oprema i finansiranje doktorskog istraživačkog projekta iz više dostupnih izvora kao što su: sredstava privrednih subjekata, sredstva za naučna istraživanja Ministarstva nauke i tehnologije RS, ili drugih vladinih izvora, sredstva međunarodnih stipendija za doktorske studije, xx xxxxx sredstva koja obezbjedi Panevropski univerzitet, naučno- istraživačke odn. visokoškolske ustanove – partneri u izvođenju doktorskog programa.

Član 17

Panevropski univerzitet će planirane nastavne i istraživačke aktivnosti vršiti u sjedištu Univerziteta i van sjedišta Univerziteta u skladu sa licencama Ministarstva prosvjete i kulture Republike Srpske i nastavnim planovima i programima, odnosno emitovanjem iz sjedišta u sistemu obrazovanja na daljinu, kao i u laboratorijskim i naučno-istraživačkim centrima, regionalnim internet centrima učenja na daljinu u visokoškolskim i istraživačkim ustanovama xx xxxxxx ima sklopljene Ugovore o mobilnosti studenata odn. Sporazume o akademskoj i naučno- tehničkoj saradnji, u ispitnim centrima van sjedišta univerziteta za predmete xxxx karakter to zahtjeva, kao i na drugim lokacijama u kojima ima pribavljenu dozvolu za obavljanje djelatnosti.

Prostor u kojem se obavljaju nastavne aktivnosti će zadovoljavati propisane uslove i standarde.

Prava i obaveze studenta

Član 18

Student ima pravo da koristi sve prostore sistema Panevropskog univerziteta namjenjene za specifične vrste rada i aktivnosti studenata, i da učestvuju u svim vidovima nastavnih, van-nastavnih, izbornih, fakultativnih i slobodnih aktivnosti.

Student ima pravo da sprovodi naučna istraživanja i da učestvuje na stručnim projektima Panevropskog univerziteta. Uslovi uključivanja studenata u istraživačkim i stručnim projektima regulisani su posebnim aktom Senata.

Student ima pravo da ostvaruje studij i da preuzme specifičnu edukativnu uslugu uključujući i pristup ispitnim aktivnostima u svim organizacionim jedinicama za ostvarivanje obrazovnih i drugih edukativnih djelatnosti Panevropskog univerziteta u kojima se takve aktivnosti organizuju.

Student ima pravo da učestvuje u radu funkcionalnih jedinica Univerziteta (biblioteka, laboratorija za informaciono- komunikacione tehnologije i učenje na daljinu, istraživačke laboratorije i kabineti, centar za izdavačku djelatnost, centar za vođenje karijere, centar za odnose sa javnošću Univerziteta, sportski centar Univerziteta), u skladu sa Poslovnicima i pravilima o radu tih organizacionih jedinica.

Član 19

Student ima pravo da Senatu Panevropskog univerziteta podnese prigovore i prijedloge koji se odnose na kvalitet

The Pan-European University is obliged to provide necessary equipment and teaching aid needed for performing of the lecturing processes, as well as computer and communication resources and required primary literature with direct entry to the scientific periodicals information bases in accordance with quality standards.

Depending on the nature of the doctorial research project, university will not be obliged to ensure all the necessary equipment and other means required for the project.

University will make all the efforts in cooperation with the doctorial candidate to ensure the equipment and finances for doctorial researches from several available sources such as: corporative aids, assets of the Ministry of science and technology and other governmental sources aimed for scientific researches, international scientific and research scholarships, grant-assets provided by the Pan-European University or its research or higher education partners.

Article 17

The Pan-European University will perform the planned lecturing and research activities at the main university campus and at the other premises outside the campus in accordance with the licenses issued by the Ministry of Education and Culture Republic of Srpska and by the provisions of the Study program's Curriculum and Syllabus, also by the emission and broadcasting of the distance learning contents from the University seat as well as at the laboratories and scientific research centres. University will also perform a learning process at the regional distance learning internet centres located in the higher education and research institutions which have closed Learning Agreements and/or Agreements on academic and scientific cooperation with Pan-European university as well as in the licensed testing centres and other locations where Pan-European University has permission to do studding activities.

The space, where the lectures will take place, fulfils legal conditions and standards.

Students Rights & Obligations

Article 18

Student is entitled to use all premises and spaces of the Pan- European University, which are intended for specific types of work and student's activities, as well as to participate in all types of lecturing, extracurricular, optional, and open activities.

Student is entitled to perform scientific researches as well as to participate in professional projects of the Pan-European University. The conditions for participation of students in research and professional projects are regulated by particular Senate Act.

Student is entitled to study and to get benefits of a specific educational service, including the access to evaluation and exam activities in all organizational units where educational and other program activities of the Pan-European University are organized and accomplished.

Student is entitled to participate at the functional units of the university such as: Library, Laboratory for ICT and distance learning, research laboratories and cabinets, University Publishing Centre, Business incubation, Career guidance, PR and sports centres of the University, in accordance with the Rule-books of those organizational units.

Article 19

Student is entitled to raise an objection and to make proposal on the quality of the lecturing, organization and the educational performances, to the University Senate, as well as to object on violation of any particular and general rights which originate from

nastavnog procesa, na organizaciju i način izvođenja nastave, te na povredu bilo kojih specifičnih i opštih prava koja proizilaze iz njihovog statusa.

Senat Univerziteta xxxxx xx da razmotri prigovore, odnosno prijedloge iz stava 1. ovog člana i pismeno obavijesti podnosioca prigovora o svom stavu u roku koji ne može biti duži od 30 xxxx.

Član 20

Student može podnijeti prigovor odn. podnesak neposredno rektoru Panevropskog univerziteta:

⮚ na ocjenu dobijenu na ispitu ako smatra da ispit nije obavljen u skladu sa Zakonom i Statutom univerziteta;

⮚ na akt kojim mu nije dozvoljen upis u narednu godinu studija, ako smatra da isti nije donijet u skladu sa Zakonom i Statutom univerziteta.

⮚ zahtjev za mirovanje prava i obaveza u slučaju teže bolesti, upućivanja na stručnu praksu, njege djeteta do godinu xxxx, održavanja trudnoće i u drugim slučajevima u kojima se ocjeni opravdanost.

Rektor donosi rješenje po prigovoru studenta u roku od pet xxxx od xxxx prijema prigovora odn. donosi rješenje o podnesku u roku od 10 xxxx od xxxx prijema podneska.

Univerzitet odnosno organizacione jedinice Univerziteta postupaju po Zakonu o upravnom postupku kada rješavaju o pojedinačnim pravima i obavezama studenata.

Član 21

Student odgovara za povredu obaveze u skladu sa Pravilnikom o disciplinskoj odgovornosti studenata kojim se pružaju pravični i nepristrasni mehanizmi rješavanja disciplinskih pitanja, definišu lakše i teže povrede obaveza studenata, disciplinski organi i propisuje disciplinski postupak.

Za lakše povrede obaveza studenata izriče se disciplinska mjera "opomena" ili "ukor", a za teže povrede izriče se disciplinska mjera "strogog ukora" ili "isključenja" sa Panevropskog univerziteta.

Pedagoške obaveze i prava studenata

Član 22

Godišnja nastava se organizuje u dva semestra ili u najviše osam nastavnih blokova koji pojedinačno nisu veći od 6 sedmica. Nastavna xxxxxx xx određena metrikom studija koja zadovoljava uslove definisane Statutom univerziteta.

Član 23

Univerzitet će radno opterećenje studenata i obračun odgovarajućih ECTS bodova pojedinih predmetnih jedinica vršiti na osnovu sljedećih parametara metrike studija:

• Ukupan fond xxxx xxxx školske godine sati

• Ukupno xxxx xxxx po jednom ECTS sati

• Trajanje nastavnog bloka .................................≤ 6 sedmica

• Trajanje semestra ≥ 15 sedmica

• Ukupno radnih sedmica u akademskoj godini 45 sedmica

• Standardni godišnji broj ECTS bodova 60 ECTS

• Standardni semestralni broj ECTS bodova 30 ECTS

• Intenzivan studij (pune kalendarske godine) ≤ 75 ECTS

• Pristupni rad (< 300 xxxx xxxx) < 10 ECTS

Senate of the University is obliged to consider objections / proposals from the previous paragraph of this article and to inform the submitter of the objection / proposal about its position within a period not later than 30 days.

Article 20

Student is able to raise an objection or request directly to the Xxxxxx of Pan-European University:

⮚ on the grade he/she was given at the exam if he/she considers that the exam was not completed in accordance with the Law and the Statute of the University;

⮚ on the document which prevents him/her to enrol the subsequent year of studies, if he/she believes that it has not been made in accordance with the Law and the Statute of the University;

⮚ on the request for adjournment of the rights and obligations in the case of serious illness, performing of professional practice, infant care, pregnancy, and any other cases which are found justified.

The Xxxx will make a decision on student's objection in a period of five days since the day of receiving the objection, or in a period of 10 days since the day of receiving the official request.

University or the organizational units of the University will act in accordance with the Law on administrative procedure, when deciding on individual rights and liabilities of the student.

Article 21

Student is responsible for the violation of the study obligations in accordance with the Rules on disciplinary accountability of students, which proposes fair and objective processes of decision on disciplinary questions, defines minor and severe violation of student's obligations, as well as discipline bodies and regulates disciplinary action.

For minor violations of student's obligations, a disciplinary fine such as "warning" or "reprimand" is pronounced, but for the severe violations of student's obligations, a disciplinary fine such as "strict reprimand" or "expelling" from the Pan-European University is pronounced.

Pedagogical obligations and rights of student Article 22

Annual lecturing is organized in two semesters or in a maximum of eight modules that are smaller than 6 weeks. Academic year is defined by metrics of studies which fulfils clauses from the University Statute.

Article 23

The University will decide on the student's workload and calculation of appropriate ECTS credits of particular units on the basis of the following parameters of study metrics:

• Total number of working hours per school year. 1.800 hours

• Total workload per one ECTS credit point 30 hours

• The block unit duration ...................................... ≤ 6 weeks

• Semester duration ≥ 15 weeks

• Total working weeks in the school year 45 weeks

• Standard annual ECTS (European standard) 60 ECTS

Član 24

Vrijeme i način ostvarivanja planiranih oblika nastave i drugih pedagoških aktivnosti te polaganja ispita i evaluacije znanja studenata u toku akademske godine utvrđuje se godišnjim rasporedom xxxx xxxx se definiše za svaki studijski program zasebno.

Član 25

Obavezni, izborni, diferencijalni i fakultativni program, program istraživanja sa elaboratom istraživačkog projekta, javni izvještaji o razultatima istraživanja, učešće na naučnim skupovima i objava razultata istraživanja u naučnoj periodici, pristupni i doktorski rad čine jedinstven studijski program trećeg ciklusa koji je procjenjen na 180 ECT kredit-bodova.

Član 26

Student Panevropskog univerziteta, tokom jedne akademske godine, po svim programskim i studijskim osnovama navedenim u prethodnom članu u režimu intenzivnih studija ne može steći više od 75 ECTS kredit-bodova uvećanih za alikvotni dio kredit- bodova zadnjeg ispita položenog te studijske godine u skladu sa odredbama Statuta univerziteta.

Član 27

Student slobodno bira izborne predmete iz studijskog programa za kojeg se opredijelio uz konsultaciju sa mentorom i dekanom fakulteta.

Student može da ostvaruje izborni program i iz drugih izvora u skladu sa individualnim nastavnim planom izbornog i

fakultativnog programa doktorskog kandidata koji usvaja Naučno-nastavno vijeće fakulteta do nivoa od 50 % ECTS bodova koji su planirani izbornim programom.

Član 28

Da bi se obezbjedila potrebna efikasnost i kredibilitet doktorskih studija trećeg ciklusa, studentu se najkasnije u drugom semestru obezbjeđuje mentor.

Zadatak mentora je da pomogne studentu doktorskih studija trećeg ciklusa u izboru i definisanju teme završnog rada i analizi kredibiliteta teze, da zajedno sa kandidatom profiliše plan i program studija, te da definiše pedagoške i didaktičke specifičnosti izbornog programa, da asistira kod organizacije i izvođenja studija i koordinira sa nastavnim osobljem angažovanim na studiju i različitim akademskim tijelima koja su involvirana u različitim fazama doktorskog studija, da pruži pomoć u definisanju, organizaciji i izvođenju istraživanja koja su predviđena u okviru doktorskih studija, pomoć kod izbora osnovne i pomoćne literature i u selekcionisanju i pronalaženju ostalih izvora potrebnih za uspješno završavanje rada, da pomogne studentu u izradi Elaborata istraživačkog projekta i u izradi prolaznog i finalnog naučnog izvještaja o realizaciji istraživanja, te da obezbjedi koordinaciju sa komisijama koje su involvirane u raznim fazama studija. Mentor ima obavezu da podnose Vijeću za doktorske studije bar dva izvještaja o realizaciji doktorskkih studija kandidata. Mentor je obavezan da vrši reviziju doktorskog rada po fazama i recenziju gotovog rada,

Article 24

Period and methods of completion of planned lecturing and other pedagogical activities as well as exams and evaluation of learning outcomes during an academic year is defined by Annual Work Schedule which is created for every study program individually.

Article 25

Mandatory and elective course-units, together with differential and facultative syllabus and program of scientific researches with Research Project Survey, public scientific reports, attendance at the scientific conferences, publishing of the research articles in scientific periodicals, entry papers and doctorial dissertation create unique studying program of doctorial studies assessed on 180 ECTS credit-points.

Article 26

In the regime of intense studying, students of the Pan- European University during one academic year, cannot accomplish more than 75 ECTS credit-points on all curricular and studying basis defined in the previous article, increased with the aliquot of credit-points earned in the last exam and in accordance with the provisions of the Pan-European University Statute.

Article 27

Student decides on elective courses from the curriculum which he/she has chosen, consulting with mentor and the xxxx.

Student is able to achieve the elective program from the other academic sources according to the individual Syllabus of the elective and facultative program which is brought by the College Academic Council, up to the level of 50 % of ECTS credit-points that were planned in the elective program.

Article 28

To ensure the necessary efficiency and credibility of the doctorial studies student is provided with a mentor during the first year of study.

Xxxxxx is obliged to help the student in credibility analysis and definition of the theme of doctorial work and to profile, a plan and program of the studies together with the student. Xxxxxx is also obliged to define didactic requirements of the selective courses, to assist on the organization and performance of the studies and to coordinate the study process with engaged academic personnel and different academic bodies involved in various phases of the study process. Furthermore, mentor should help the doctorial candidate in defining, organization and realization of the researches, to assist in selection of the primary and secondary literature and other sources necessary for successful finalization of the doctoral work. Xxxxxx is obliged to assist the student in creation of the Research Project Survey and the scientific research reports. Xxxxxx must submit his own two reports on the progress of the doctorial candidate to the Council of the doctorial study. Xxxxxx is also obliged to revise the doctoral dissertation paper according to the defined progress phases and to provide the final review of the doctorial work as well as the preparation of the candidate for defence.

Ukoliko je student-kandidat nezadovoljan radom mentora tokom trajanja studija, može da se obrati Senatu Panevropskog univerziteta sa zahtjevom za promjenu mentora.

Član 29

Student definiše zajedno sa mentorom Plan i program studija koji sadrži izborni program studenta, detaljnu specifikaciju ostalih izvora koji se vrednuju u sistemu ECTS, program istraživanja sa dijagramom vremenskog toka istraživanja, te dijagram toka izrade završnog rada.

Finansijske obaveze studenta

Član 30

Student xx xxxxx da za obrazovne i druge intelektualne i edukativne usluge odn. servise koje studentu isporučuje Panevropski univerzitet, odn. njegove ovlaštene organizacione jedinice, izvrši plaćanje u iznosu i prema uslovima Fakture za školarinu i za ostale obrazovne usluge u akademskoj 2022/23. godini. Faktura za školarinu i za ostale obrazovne usluge ispostavlja se studentu prilikom upisa akademske godine i čini sastavni dio ovog Ugovora. Cijene usluga koje se fakturišu definisane su Konkursom za upis i usklađene su sa Pravilima o visini naknade za studiranje i cijeni usluga na Panevropskom univerzitetu. Cijene usluga ažurira i donosi Upravni odbor Panevroposkog univerziteta za svaku akademsku godinu.

Student uplaćuje neposredno jednokratne usluge koje se ne fakturišu, u skladu sa Pravilima o visini naknade za studiranje i cijeni usluga koje se naplaćuju na Panevropskom univerzitetu.

Naknade za školarinu i druge edukativne usluge zavise od studijskog programa kojeg je upisao student, tipa studija, obima dopunskih obrazovnih usluga, godine studija, geografske regije u kojoj se nalazi mjesto boravka studenta ili drugih parametara koji utiču na tržišnu poziciju Panevropskog univerziteta i njegovih organizacionih jedinica u kojima se organizuje studijski proces.

Naknade za školarinu i druge edukativne usluge u tekućoj godini mogu da se razlikuju u odnosu na ranije školske godine.

U slučaju promjene kursa KM u odnosu na EURO u toku studija, Panevropski univerzitet zadržava pravo da sve preostale obaveze studenta preračuna u EURO valutu prema srednjem kursu CBBiH koji je bio važeći na xxx sklapanja Ugovora o studiranju, a student se obavezuje da sve dalje uplate obaveza na ime školarine vrši u KM valuti primjenjujući srednji kurs CBBiH za EURO na xxx izvršene uplate.

Član 31

Student može da uplati školarinu i/ili druge usluge Univerziteta u ratama u skladu sa Pravilima o visini naknade za studiranje i cijeni usluga na Univerzitetu.

Ukoliko student obaveze po osnovu školarine uplaćuje u ratama, xxxxx xx da alikvotne iznose uplaćuje prema dinamici predviđenoj u Pravilima o visini naknade za studiranje i cijeni usluga na Univerzitetu. Izmirenje obaveze uplate prve rate xx xxxxx upisa akademske godine. Izmirenje obaveza uplate srednje rate xx xxxxx za ovjeru prvog semestra i produžetak studija u drugom semestru. Izmirenje obaveze uplate zadnje rate xx xxxxx za ovjeru i za završetak tekuće akademske godine odn. studija trećeg ciklusa.

Studentu neće biti dozvoljeno polaganje ispita u pojedinim ispitnim rokovima ukoliko nije izmirio obaveze uplate svih rata prispjelih prije datuma zakazanog ispitnog roka.

Student ne može da upiše narednu akademsku godinu ukoliko nije izmirio sve finansijske obaveze prema Univerzitetu iz prethodnih xxxxxx.

Article 29

Student defines the syllabus and curriculum of the studies together with mentor. Syllabus includes elective study program, detailed specification of the other sources of ECTS scoring, research program with xxxxx and flow charts of the research activities, and the xxxxx chart of the final doctoral work.

Financial obligations of student Article 30

Student is obliged to make a payment for educational and other intellectual services provided by the Pan-European University in the amount defined by the authorised body of Pan- European University and according to the conditions of the Tuition Fee Invoice for the academic year 2022/2023. The Tuition Fee Invoice is issued to the student when enrolling the University and composes integral part of this Contract. The costs of the services which are invoiced are defined by the Public announcement for enrollment in accordance with the Rules on tuition fees and prices of services, to be charged at the Pan- European University. The costs of services are defined and brought up to date by the Managing Board of the Pan-European University for every academic year.

Student makes payment immediately for the services occurring once which are not invoiced, in accordance with the Rules on tuition amounts and prices of services charged at the Pan-European University.

Compensations for tuition fee and other educative services in the current year can differ from the previous years depending on the type of the study program, amount of the additional educational services that are delivered, study year, region of the student residence and other parameters that influence on the University market position.

If the exchange rate of KM currency was modified towards EURO, Pan-European University reserves the right to recalculate the students' remaining liabilities, according to the middle exchange rate applied in Central Bank BiH valid for the day of the conclusion of this contract. In this case the further students' payments will be executed in KM currency xxxxxxx the EURO middle exchange rate of the Central Bank when the payment was done.

Article 31

Student can make a payment on tuition fee and/or other services provided by the Pan-European University in instalments, in accordance with the Rules on tuition fees and prices of services charged at the University.

If student makes his/her payments on tuition fee in instalments, he/she is obliged to pay the consecutive instalments by the dynamics anticipated in the Rules on tuition fees and prices of services charged at the Pan-European University. Fulfilling of obligations of paying the first instalment is a condition for enrolment in the current school year. Fulfilling of obligations of paying the middle instalment is a condition for attesting of the first semester and enrolling the second. Fulfilling of obligations of paying the last instalment is a condition for attesting and ending of current academic year or complete doctoral study program.

Student will not be allowed to take the exams in particular periods if he/she did not fulfil his/her obligations of paying all instalments which were due before that exam period.

Student will not be allowed to enrol the following academic year if he/she did not fulfil his/her obligations of paying all instalments from the previous years.

Član 32

Za upisanu godinu studija po osnovu prelaska xx xxxxx visokoškolske ustanove, ili po osnovu produžetka školovanja, student plaća punu naknadu školarine.

Član 33

Studenti imaju pravo na odgovarajuće popuste /povlastice odn. pravo na utvrđivanje specifičnog iznosa školarine u skladu sa kriterijumima razrađenim u Pravilima o visini naknade za studiranje i cijeni usluga.

Član 34

Student koji se ispisuje sa Univerziteta ima pravo na povrat uplaćene školarine umanjenog za iznos manipulativnih troškova vezanih za izradu indeksa i ažuriranja matičnih podataka zbog ispisa, ako se zahtjev za ispis podnese u roku od mjesec xxxx od xxxx početka akademske godine;

Panevropski univerzitet neće izvršiti povrat uplaćene školarine ukoliko student pravosnažnom odlukom disciplinske komisije bude ispisan ili ukoliko svojevoljno napusti školovanje.

Student koji obnovi godinu studija zbog ispunjavanja ispitnih obaveza iz prethodnog školovanja, po osnovu upotpunjavanja redovnog programa studija ili izvršavanja diferencijalnog programa, ili zbog izvršavanja obaveza po osnovu fakultativnih studija, ili zbog xxxxx u studiju odn. zamrzavanja studija u tekućoj školskoj godini, ili zbog obimnosti programa istraživanja, plaća propisane naknade koje su predviđene Pravilima o visini naknada i cijenama usluga za tekuću akademsku godinu.

Član 35

Student xx xxxxx da se pismenim podneskom obrati Upravnom odboru Panevropskog univerziteta radi ostvarivanja popusta i povlastica u finansiranju studija, povrata školarine ili prava po osnovu završetka školovanja.

Ispiti i evaluacija znanja

Član 36

Panevropski univerzitet je obavezan da obezbijedi kontinuirano praćenje uspješnosti studenata u savlađivanju pojedinih predmetnih jedinica i da vrednuje rezultate ukupnog rada studenta tokom obrade odnosnog predmeta ili ostalih planiranih jedinica programa odn. programskih aktivnosti doktorskog studija u skladu sa Zakonom o visokom obrazovanju, te odredbama Pravilnika o doktorskom studiju i Statuta Panevropskog univerziteta.

Predmetni nastavnik je obavezan da studente na početku nastave upozna sa specifičnim zahtjevima i metodologijom organizacije nastave, praćenja i ocjenjivanja, karakterom i sadržinom završnog ispita, strukturom ukupnog broja poena i načinom formiranja ocjene.

Student xxxxx pravo da polaže ispit iz nastavnog predmeta kada izvrši sve predispitne obaveze utvrđene nastavnim programom, ovjeri semestar i ispuni druge uslove propisane Statutom univerziteta i Nastavnim planom i programom. Provjera znanja studenata u toku školske godine vrši se na način utvrđen programom nastavnog predmeta.

Student ne može pristupiti polaganju ispita bez odgovarajućeg dokumenta o prijavi ispita.

Član 37

Sve provjere znanja i kompetencija studenta su javne i transparentne. Provjera znanja studenata u toku školske godine vrši se na način utvrđen programom nastavnog predmeta. Ispit iz svakog nastavnog predmeta polaže se u kontrolisanim uslovima

Article 32

For the enrolled academic year, on the basis of transferring from other University, or on the basis of extending the studies, student has to pay for the whole tuition fee.

Article 33

Students are entitled to appropriate discounts and benefits in regard of fulfilling the financial obligations at the Pan-European University in accordance with the criteria defined by Rules on tuition amounts and prices of services, to be charged at the Pan-European University.

Article 34

Student who withdraws the University, is entitled to reimbursement of the whole tuition fee paid by the student, reduced for the amount of operational expenses if the requirement for the withdrawing is submitted in a period of 30 days since the beginning of the academic year;

Pan-European University will not make the refund of the previously paid tuition if a student is expelled by the decision of the disciplinary commission, or if he or she leaves schooling willingly.

Student who resumes the academic year, due to fulfilment of lagged exams from the previous education, or on the basis of fulfilment of lagged regular studying curricula or fulfilment of the regular or differential program, or due to fulfilment of obligation of elective studies, or because of the adjournment of study, or because of the size of the research program, will pay appropriate fee according to the Rules on tuition amounts and prices of services, to be charged at the Pan-European University.

Article 35

Student is obliged to address the Managing Board of the Pan- European University in written form, in order to realize the discount and benefits in payment of tuition fees, partly refunding of the tuition fee or reimbursements based on completing the education.

Exam and knowledge grading Article 36

The Pan-European University is obliged to provide continuing monitoring of student's success in accomplishing particular lecturing units and to evaluate the results of student's work on particular course or to evaluate the other study units and activities planned at the doctorial study in accordance with the Law on higher education, and the Regulations of doctorial study and the Pan-European University Statute.

The professor on a particular course is obliged to introduce students, at the beginning of the lectures, with specific demands and methodology of organization of the lectures, monitoring and evaluating, character and content of the final exam, the structure of the total number of points and the method of grade forming.

Student is entitled to take the exam from a particular course once he/she finishes all prerequisites given in the syllabus, to verify a semester and fulfil other obligations stated in the Pan- European University Statute and syllabus. Testing of student's knowledge during academic year is performed in accordance with provisions defined in syllabus.

A student cannot take any exam without an appropriate exam application document.

Article 37

All the assessments of knowledge and other competencies of the student are public and transparent and performed in a way determined by course curriculum. Controlled conditions of exams are provided by the authorised person who acts as an exam

Article 38

Studentu su omogućena tri redovna ispitna roka koja sadrže po dva ispitna termina, kao i dva dopunska ispitna roka koji sadrže po jedan ispitni termin i koji su organizovani za sve predmete. Studenti imaju pravo polagati ispite u oba ispitna termina jednog ispitnog roka. Student polaže ispit u određenom ispitnom roku neposredno po završetku nastave iz tog predmeta odn. u svim kasnijim ispitnim rokovima. Drugi ispitni termin u jednom ispitnom roku organizuje se ne ranije od 7 xxxx i ne kasnije od 15 xxxx xxxxx prvog termina.

Član 39

Poslije dva neuspjela polaganja istog ispita, student ima pravo na lični zahtjev polagati ispit pred ispitnom komisijom koju imenuje rektor Univerziteta. Student snosi troškove komisijskog polaganja ispita prema Pravilima o visini naknade za studiranje i cijeni usluga koje se naplaćuju na Univerzitetu.

Poslije tri neuspjela ponavljanja istog ispita student plaća troškove svakog narednog polaganja istog ispita u skladu sa Pravilima o visini naknade za studiranje i cijeni usluga koje se naplaćuju na Univerzitetu.

Član 40

Student koji je nezadovoljan visinom pozitivne ocjene utvrđene u redovnom ispitnom roku, može izraziti svoje neslaganje sa visinom ocjene neposredno nakon završetka ispita i tražiti da se pozitivna ocjena ne uvaži. Student je obavezan da ispit iz predmeta iz koga mu je poništena ocjena ponovo polaže do kraja tekuće akademske godine i da snosi troškove vanrednog polaganja.

Studenti koji nisu položili pismeni dio ispita imaju pravo uvida u svoj rad neposredno poslije objavljivanja ispitnih rezultata.

Član 41

Istoga xxxx student može polagati najviše dva ispita iz istog studijskog programa.

Student is enabled with at least three regular exam terms each having two exam sessions, as well as two additional exam terms having one exam sessions which is organized for all the university courses. Student is able to take the exam in both exam sessions of the same exam term. Student is able to take the exam of the single course in a specific term after the finalisation of lectures planned for the course unit, in all the later terms and exam sessions. Complementary term is organised not earlier than 7 days and not later than 15 days after the first term.

Article 39

If student does not pass the exam the second time he/she is entitled to take the exam in the presence of exam commission appointed by the xxxxxx of the University. Student bears the expenses of taking the exam in the presence of exam commission according to the Rules on tuition amounts and prices of services, charged at the Pan-European University.

After three failures in taking the same exam, student is obliged to bear the costs of each subsequent exam term according to the Rules on tuition amounts and prices of services, to be charged at the Pan-European University.

Article 40

Student who is not satisfied with the grade earned in regular term is allowed to object immediately after the exam and to ask cancellation of that particular grade. Student is obliged to pass the exam, for the grade he previously revoked, until the end of the current academic year and to bear the expenses of additional passing.

Students who did not pass the written part of the exam are allowed to examine their paper after the results are announced.

Article 41

Student is allowed to take maximum two exams in the same day from the same studying curricula.

Član 42

Tokom prve godine studija student ima obavezu da izradi i odbrani pristupni rad ili bar jedan seminarski rad koji se tretira kao pristupni rad.

Student ima obavezu da u zadnjoj godini studija izradi i odbrani završni doktorski rad koji je rezultat samostalnog istraživanja i predstavlja orginalni naučni doprinos. Mentor xx xxxxx da pregleda završni doktorski rad studenta i mišljenje o gotovosti rada uputi dekanu fakulteta radi zakazivanja odbrane.

Procedura odbrane pristupnog rada i završnog doktorskog rada definisana je Pravilnikom o doktorskim studijma.

Naknade za mentora, komisije i odbranu završnog doktorskog rada definisane su Pravilima o visini naknade za studiranje i cijeni usluga koje se naplaćuju na Univerzitetu.

Zvanja

Član 43.

Studenti stiču akademske titule odn. naučna zvanja prema nazivima zvanja koji su licencirani odn. akreditovani u okviru dozvole za izvođenje studijskog programa koji su usklađeni sa Zakonom o zvanjima Republike Srpske i definisani Pravilnikom o listi strukovnih akademskih i naučnih zvanja, te Nomenklaturom

Article 42

Student is obliged to write and to defend the entry paper or at least one seminar work treated as the entry paper, during the first year of study.

Student is obliged to write and to defend final doctoral work in the last year of the doctoral study cycle. Doctorial dissertation is the result of independent scientific researches and represents the original scientific contribution. Student mentor is obliged to examine and review the final doctoral work and to provide to the College xxxx its opinion on readiness and finalization status of the dissertation in order to schedule the defence.

Procedure of defence of the doctoral work is defined in the Regulations on doctoral studies at the Pane-European university.

Allowances paid for the mentor, academic commissions involved in the process and doctoral work itself are defined in Rules on tuition amounts and prices of services, charged at the Pan- European University.

Titles Article 43.

Students will earn the accademic and scientific titles accoriding to the names of the titles licensed and/or accredited within the Allowance for performance of the study program issued by the Ministry on Education and Culture Republic of Srpska, and coherent with the Law on titles and Rules on list of

stručnih, akademskih i naučnih naziva koji se stiču na studijskim programima Panevropskog univerziteta.

Prelazne odredbe

Član 44.

Student neće polagati autorska prava na radove koje je izradio kao dio procesa evaluacije znanja tokom studija i dozvoljava da se navedeni radovi publikuju xx xxxxxx Panevropskog univerziteta u elektronskom i u pisanom obliku. Student xx xxxxx da sve radove koji su xx xxxxxx matičnog profesora odn. uređivačkog kolegija kandidovani za objavljivanje, dostavi u pisanom i u elektronskom obliku u biblioteci Panevropskog univerziteta. Panevropski univerzitet nema ekskluzivna prava na studentske radove.

Studentski radovi mogu da se koriste za edukacione potrebe studenata univerziteta samo u skladu sa Politikom prevencije plagijarizma na Pan-Evropskom univerzitetu.

Panevropski univerzitet može da koristi slike, video-snimke i druge multimedijalne materijale na kojima se nalazi student, a koji su napravljeni u prostorima Univerziteta, ili u drugim prostorima u kojima se odvija nastavno-naučni proces, za edukativne, promotivne i marketinške potrebe Univerziteta, bez novčanih i drugih naknada i bez traženja posebnih odobrenja studenta.

Član 45.

Prilikom regulisanja međusobnih odnosa ugovornih strana koji nisu definisani ovim Ugovorom primjenjivat će se Zakon i podzakonski akti koji regulišu oblast visokog obrazovanja, te Statut i ostali opšti i pojedinačni akti koji su donešeni na Panevropskom univerzitetu.

U slučaju prestanka rada Panevropskog univerziteta

„APEIRON“ Banja Luka ili prestanka izvođenja studijskog programa na koji je student upisan, Panevropski univerzitet će obezbijediti studentu nastavak školovanja na srodnom studijskom programu koji se izvodi u okviru Panevropskog univerziteta, ili na srodnom studijskom programu na drugoj licenciranoj ili akreditovanoj visokoškolskoj ustanovi sa kojom je Panevropski univerzitet sklopio sporazum.

Član 46.

Sve sporove po ovom Ugovoru ugovorne xxxxxx xx rješavati sporazumno, a za slučaj da to ne bude moguće obje ugovorne strane priznaju nadležnost Osnovnog suda u Banjoj Luci.

Član 47.

Transitional provisions Article 44

Student will not lay copy rights to the works he/she does as a part of process of evaluation of knowledge during the studies and allows these works to be published by the Pan-European University in electronic and written form. Student is obliged to hand out the works for publishing in written and electronic form and to provide it to the library of the Pan-European University. The Pan-European University does not have exclusive rights to student's works.

Student works could be used for further educational purposes only according to the Policy of preventing the plagiarism on the Pan-European University.

Pan-European University is entitled to use pictures, video- clips and other multimedia materials taken at the university premises or at the other premises where the student is recorded and used for educational, promotional and marketing purposes, without any financial obligations to the student or other allowances and without specific approval of such action from the student.

Article 45

Relations of the contracting parties which are not defined by this Agreement, are regulated by the Law and other legal documents provided in the field of higher education and the Pan- European University Statute and other Rulebooks and specific acts brought on the University.

In the case of closing Pan-European University „APEIRON“ Banja Luka or closing of a certain department attended by a student, Pan-European University will provide students with education on the similar study programme that exists within the Pan-European University, or similar study programme at other licensed or accredited institution of higher education which the Pan-European University signed a contract with.

Article 46

All disputes according to this Contract will be settled by mutual consent, by the contracting parties. In the case that is not possible, both contracting parties recognise jurisdiction of Banja Luka District Court.

Article 47

The contract is created in two copies from which one copy belongs to student and other to the Pan-European University.
