AVAILABILITY OF THE SERVICE. The User acknowledges, renouncing to raise any kind of exception and / or dispute, that the Dadoda Service is available in the Dadoda Area 24 hours a day. Except in cases of force majeure or decisions of the competent authorities that involve a total or partial, temporary or definitive restriction of the use of one or more stations or of cycling on the Italian territory. Cube can never be held responsible for any negative effect or consequence suffered by the User (eg delays) resulting from the unavailability of the Scooters. The services may be made available or accessible in connection with third party services and content (including advertising) over which Cube has no control. Cube does not endorse such third party services and content and, within the maximum limits permitted by applicable law, Cube cannot be held responsible for any third party product or service. Access to services while using the Scooter Bicycles is subject to the terms and conditions applicable to third parties. Cube, its administrators, employees, agents, suppliers or licensors have taken all reasonable precautions in offering the services, but make no representations or warranties regarding the content of the application and the basic software, including but not limited to its accuracy, reliability, completeness or timeliness. Cube will not be responsible for delays or interruptions in data or the flow of information and does not guarantee that the application and other services will be available at all times. The Customer is aware that the Service may be subject to limitations and impediments that go beyond the control of Cube, such as, by way of example and not limited to: the malfunction of the Internet connection of the User and / or Cube; the malfunction of electronic equipment (e.g. GPS tracking systems) used by Cube to perform the Service and / or monitor the Scooters; the interruption of the Service as a result of natural disasters (eg earthquakes or floods) or causes of force majeure (eg strikes, lockouts) or other cause in no way attributable to Cube; damage to the scooter by third parties; failure to recharge the scooter.
