Dispute resolution procedure. Any dispute, controversy or claim arising out of or in connection with the contract, in particular its conclusion, interpretation, performance, breach, termination or invalidity, shall be finally settled by the courts of Vicenza, Italy which will have exclusive jurisdiction
Dispute resolution procedure. In the event that a dispute arises it shall be dealt with in the following manner:
a) In the first instance discussion shall occur between the relevant CWU workplace delegate and the local management.
b) If unresolved the dispute shall then be discussed between the CWU, a representative from Human Resources and a higher level of management.
c) If unresolved either the CWU or Telstra may seek the assistance of the Australian Industrial Relations Commission.
d) In order to allow for the peaceful resolution of the disputes the parties shall use their best endeavours to ensure that pre-existing circumstances immediately prior to the dispute will be maintained. The parties shall be committed to avoid stoppages of work, lockouts or other bans or limitations while the procedures of negotiation and conciliation are being followed. This commitment shall not prejudice the position of either party in a genuine health and safety situation.
