Layoff. In the event an employee is scheduled to be laid off and there exists a vacant position which the Employer intends to fill in an equal or lower-graded classification, upon timely application by the employee, seniority shall prevail in permitting such an employee to fill such position provided the employee has the ability to perform the work in a competent manner.
