Recommendation
The Māori Affairs Committee has examined the Ngatikahu ki Whangaroa Claims Settlement Xxxx and recommends that it be passed with the amendments shown.
Introduction
The Ngatikahu ki Whangaroa Claims Settlement Bill seeks to give effect to the Deed of Settlement signed by the Crown and Ngatikahu ki Whangaroa agreeing to the final settlement of all the outstanding historical Treaty of Waitangi claims of Ngatikahu ki Whangaroa. It also records the acknowledgements and apology the Crown offered to Ngatikahu ki Whangaroa.
Ngatikahu ki Whangaroa’s historical claims relate mainly to pre-Treaty land transac- tions, Crown purchasing, the Crown’s surplus lands policy, its failure to protect Nga- tikahu ki Whangaroa reserves, the taking of land for public works, the operation and impact of native land laws, and landlessness.
Part 1 of the bill includes a summary of the historical account, acknowledgements, and the Crown’s acknowledgements and apology. Part 2 deals with cultural redress.
In the Deed of Settlement, the Crown agreed to provide certain redress in settlement of all of Ngatikahu ki Whangaroa’s historical Treaty claims. The bill includes only those parts of the redress in the settlement that require legislative authority.
This commentary covers the settlement issues we considered and the amendments that we recommend to the bill, most of which are minor and technical.

2 Ngatikahu ki Whangaroa Claims Settlement Bill Commentary
Background information about Ngatikahu ki Whangaroa
Ngatikahu ki Whangaroa is a claimant group of about 3,000 people whose area of in- terest lies in the Far North between the Mangonui Harbour and the Whangaroa Har- xxxx.
Ngatikahu ki Whangaroa’s area of interest overlaps with Ngāti Kahu (north-west) and Ngāpuhi (south-east).
On 20 September 2001, the Crown recognised the mandate of the Ngatikahu ki Whangaroa Trust Board to represent Ngatikahu ki Whangaroa in Treaty settlement negotiations with the Crown.
The beneficiaries for Ngatikahu ki Whangaroa are defined as the descendants of Ka- hukuraariki or any other recognised ancestor of the group defined in Part 1, clause 13 of the bill. This definition was jointly defined by the Crown and iwi.
We are aware of some concern that this definition might undermine customary owner- ship. We were advised that no submissions in the mandate process questioned the val- idity of Kahukuraariki as the ancestor from whom Ngatikahu ki Whangaroa descend. We are satisfied that the bill would not extinguish customary ownership rights.
Ratification process and participation
As part of our consideration of the bill, we requested information about the ratifica- tion process, and whether this was sufficient to support settlement. The level of par- ticipation in the ratification process was 30.9 percent. The process lasted seven weeks. Four ratification hui were held, and voting was open for 10 weeks and five days.
Of the 2,426 voting packs sent to registered adult members of Ngatikahu ki Whangar- oa, 750 votes were received. Although we are concerned that this is low, we under- stand that it is a “mid-range” level of participation.
The Crown considered that the ratification process was open and transparent, with ef- forts made to thoroughly advertise the ratification hui, disseminate voting packs wide- ly, and reschedule hui to suit registered voting members.
Settlement boundaries and the inclusion of Mangawhero Marae, Otangaroa
We heard that there was disagreement about whether Mangawhero Marae, Otangaroa, should be included in the settlement boundary. The Deed of Mandate for the trust board was submitted in 1999 and published in 2000. After publication, the trust board received objections, including whether Mangawhero Marae, Otangaroa, should be in- cluded in Ngatikahu ki Whangaroa’s mandate.
The Crown did not consider the boundary issue at Otangaroa an obstacle to negoti- ations because the Crown recognises general areas of interest, rather than a precise boundary, during the settlement process. The area of interest is used to help define the claimant group, and it is common for areas of interest to overlap.
Commentary Ngatikahu ki Whangaroa Claims Settlement Bill 3
Two hui were held to determine whether those affiliated to Mangawhero Marae are descended from Kahukuraariki and should be represented by the trust board. The Crown was satisfied from the hui reports that the majority of the Ngatikahu ki Whan- garoa people considered that Xxxxxxxxxx Xxxxx should be represented by the trust board.
This conclusion was based on the view of the Mangawhero people that their marae was a Ngatikahu ki Whangaroa marae, the significant support of the marae’s inclu- sion expressed at both hui, and confirmation by Xx Xxxxxxx-x-Xxx o Ngāti Kahu that it does not represent Mangawhero Marae.8
Ownership of Stony Creek Station
Stony Creek Assets are currently Crown property and are the key feature of redress in the Ngatikahu ki Whangaroa settlement package.9
We heard that Stony Creek Station has been illegally occupied by some members of Ngāti Aukiwa since late 2007.10 The occupation undermines the mandate of the trust board, and the relationship between the occupiers and the members of the trust board is strained. Stony Creek Station’s assets have devalued because the Crown has not been able to carry out standard maintenance on the property. We note that the total financial redress is in lieu of the Crown’s obligation to maintain Stony Creek Assets in substantially the same condition as they were in 2007 at the time the Agreement in Principle was signed.11
Several submitters argued that the Stony Creek Station should belong to Ngāti Auki- wa as a distinct tribal entity from Ngatikahu ki Whangaroa. However, Ngatikahu ki Whangaroa said that most hapū and marae have associations with the Stony Creek Station and the Thomson and Xxxxxx blocks, particularly Taemaro Marae, Waimahana Marae, and Mangatowai Marae, and Ngāti Roha, Ngāti Aukiwa, and Ngāti Rua. The Ngatikahu ki Whangaroa Post-Settlement Governance Entity (PSGE) has also told us that most members of Ngatikahu ki Whangaroa are also members of Ngāti Aukiwa.
We understand that repeated efforts have been made since 2007 to resolve the occupa- tion of Stony Creek Station and unite Ngāti Aukiwa with Ngatikahu ki Whangaroa. This led to several refinements to the Agreement in Principle and culminated in a whakapapa wānanga in January 2015. Although the outcome of the wānanga was that Stony Creek Station should belong to all Ngatikahu ki Whangaroa based on whakapa- pa, none of the Ngāti Aukiwa occupiers attended the wānanga.

After the wānanga, the Crown decided that the Māori Land Court was not an appro- priate avenue to determine ownership. In an attempt to reach a solution, the Stony Creek Station will be vested in the PSGE with the proviso that the PSGE be respon- sible for finalising ownership.
The PSGE trust deed includes conditions requiring a post-settlement decision about the final ownership of Stony Creek Station. The process allows all adult registered members of Ngatikahu ki Whangaroa to determine the final ownership. If the PSGE does not comply with these conditions within four years of the settlement date, any member of the beneficiary group can apply to the High Court to have them enforced.
Overlapping claims with Ngāti Kahu and Ngāpuhi
We received concerns that the bill would extinguish other hapū claims and relation- ships with the land, particularly with the maunga Whakaangi and the Whangaroa Har- xxxx.
The Whakaangi Scenic Reserve is adjacent to Whakaangi maunga, and the maunga is privately owned. There is an overlay classification on the Whakaangi Scenic Reserve that recognises a Ngatikahu ki Whangaroa relationship13. We note that the Department of Conservation is obliged to discuss its management with all iwi who have a custom- ary relationship with the site.
We were advised that the bill would not affect any claimants who do not fall within the claimant definition of Ngatikahu ki Whangaroa. It settles only the historical claims of the descendants of Xxxxxxxxxxxxx and does not include any redress relating to the Whangaroa Harbour.
Crown acknowledgements and apology
It was suggested that the Crown should make acknowledgements to individual hapū to properly reflect the consequences for the people. We note that the Crown’s ap- proach is generally to settle with large natural groups, so the acknowledgements and apology are usually directed at the whole group rather than individual hapū, unless a special request is made. In this case, no such request was received.

Commentary Ngatikahu ki Whangaroa Claims Settlement Bill 5
The Crown apology is based on the historical account agreed by the trust board and the Crown. Several submissions expressed concern about the content of the historical account, which contains a detailed account of the history leading up to the settlement negotiations. However, we note that the historical account is just one contribution to the understanding of Ngatikahu ki Whangaroa’s past. The Crown’s apology and ac- knowledgements show that the Crown accepts its responsibility for breaches of the Treaty of Waitangi.
We acknowledge that some Ngāti Aukiwa assert that they did not cede sovereignty and are the rightful owners of the lands and natural resources in their traditional xxxx- xxxxxx. However, as already noted, it is the Crown’s preference to settle with large natural groups of tribal interests, rather than individual hapū or whānau within an iwi.
Suggested amendments relating to the overlay classification in Deed Document Schedule and the Conservation Protocol
It was submitted that clauses 1.3 and 3 of the Deed of Settlement Schedule be amended. However, we were advised that the current wording in clause 1.3 has a higher legal status than the suggested change. The suggested amendment to clause 3 is not necessary as section 4 of the Conservation Act requires the Act to be interpre- xxx and administered to give effect to the principles of the Treaty of Waitangi.
It was also suggested that an “Accidental Discovery Protocol” be developed for kōiwi (human remains) and that Ngatikahu ki Whangaroa be engaged in developing an indi- genous species management programme. However, we are aware that a protocol has already been agreed in the Deed of Settlement. Part of this protocol includes regular meetings between the Department of Conservation and Ngatikahu ki Whangaroa. This would be an appropriate forum for discussing such issues as discovery of kōiwi and indigenous species management programmes. The current bill allows for these processes to be developed and implemented after settlement.
Disposal of Reserve Land
We were asked to recommend giving xxx a first right of refusal on any land the Crown wishes to dispose of. The committee recognises that the process for the disposal of Crown land is already covered by other legislation. We looked at a possible amend- ment arising from clause 4.1.2 of the Deed Document Schedule of the Deed of Settle- ment, which is the disposal clause referred to in the Deed of Recognition for the Aka- tārere Historic Reserve.
We note that the Deed of Recognition referred to in the submission applies to an his- toric reserve that is subject to the Reserves Act 1977. The Act sets out the disposal process for reserve land.
Technical changes to land descriptions
As a result of surveys completed for a number of the cultural redress properties, we recommend several technical amendments to Schedule 3 of the bill. These amend- ments will update the legal descriptions for those properties.

This Act comes into force on the day after the date on which it receives the 5 Royal assent.

Preliminary matters, acknowledgements and apology, and settlement of historical claims
The purpose of this Act is— 5
(a) to record in English and te reo Māori the acknowledgements and apolo- gy given by the Crown to Ngatikahu ki Whangaroa in the deed of settle- ment; and | ||
(b) to give effect to certain provisions of the deed of settlement that settles the historical claims of Ngatikahu ki Whangaroa. | 10 | |

(i) protocols for conservation and taonga tūturu on the terms set out in the documents schedule; and
(ii) a statutory acknowledgement by the Crown of the statements made by Xxxxxxxxx xx Xxxxxxxxx of their cultural, historical, spiritual, and traditional association with certain statutory areas 15
and the effect of that acknowledgement, together with the deed of recognition for the specified area; and
(iii) an overlay classification applying to a certain area of land; and
(iv) the provision of official geographic names; and
(b) cultural redress requiring vesting in the trustees of the fee simple estate 20
in certain cultural redress properties.
(4) There are 3 schedules, as follows:
(a) Schedule 1 describes the statutory areas to which the statutory acknow- ledgement relates and, in 1 case, for which a deed of recognition is issued: 25

Summary of historical account | ||
(1) | Prior to 1840, Europeans and Māori conducted land transactions within the Ngatikahu ki Whangaroa xxxx. The majority of these involved other iwi who asserted some authority over the region. The Crown was meant to investigate the legitimacy of these transactions in the 1840s, but in most cases failed to do | 5 |
so because of concerns this would aggravate inter-tribal conflict. In the 1850s, the Crown investigated some Mangonui land claims, but did not investigate others. Though Ngatikahu ki Whangaroa occupied many of these blocks, the Crown failed to adequately consider their customary interests. | ||
(2) | The Crown considered all customary title was extinguished if a land commis- sioner confirmed the transaction. It assumed ownership of an estimated 11 000 acres of Ngatikahu ki Whangaroa ancestral lands through its “surplus” land policy. Māori evidence regarding these transactions was not always heard in an open, public inquiry. | 10 |
(3) | In 1841, the Crown sought to settle a dispute between two Māori rangatira by acquiring their interests in the area between Mangonui, Taemaro, and Otangar- oa. Though these transactions involved Ngatikahu ki Whangaroa’s ancestral lands, there is no evidence of their involvement or of the Crown sufficiently in- vestigating their customary interests. | 15 |
(4) | In 1863, the Crown signed the Mangonui purchase to settle outstanding Māori claims in the eastern Mangonui area. The Crown agreed to set aside Taemaro and Waiaua as Māori reserves, but it reduced the size of Taemaro reserve—ex- cluding some areas occupied and cultivated by Ngatikahu ki Whangaroa. A Ngatikahu ki Whangaroa petitioner later claimed that the Mangonui purchase of approximately 22 000 acres only involved about 2 000 acres at Kopupene. | 20 25 |
(5) | The establishment of the Native Land Court in 1865 altered Māori customary tenure by allowing individual ownership. The 500-acre Motukahakaha block was awarded to 2 Māori owners and was later sold to private interests. The Na- tive Land Court awarded Māori title to the 977-acre Takerau block, but then cancelled it after deciding Takerau was Crown land. | 30 |
(6) | Māori were awarded title to the 3 990-acre Taemaro block in 1870, which lay within the boundaries of the 1863 Mangonui purchase. The Crown believed it owned the block, but failed to attend the court hearing. Māori later surrendered title to Taemaro in exchange for an enlarged 99-acre reserve at Taemaro and a 649-acre reserve at Waimahana. The Crown passed the Taimaro and Waimaha- | 35 |

(8) After Crown officials approached them about gifting an area Lord Ranfurly had picnicked at for a scenic reserve, Motukiwi Hone Tua and other Ngatikahu ki Whangaroa offered the Crown approximately 10 acres for this purpose. The Crown, however, eventually decided to take 706 acres for the Ranfurly Bay Scenic Reserve, including important Ngatikahu ki Whangaroa wāhi tapu and 5 urupā. Māori owners received a total of £1,060 from the Crown as compensa- tion, but lost £40 per year from a 30-year lease of the block.
(9) Following World War II, the Crown took land at Matakaraka that the navy had occupied during the conflict. In 1983, the Crown transferred the land to the Lands and Survey Department, and only revested it in Māori ownership in 10 1990. The Crown purchased other land at Matakaraka for scenic reserve pur- poses without getting the consent of all owners. Ngatikahu ki Whangaroa were
left virtually landless and the majority of their people now live outside their xxxx.

(a) the operation and impact of the native land laws, in particular the award- ing of the important Ngatikahu ki Whangaroa blocks of Taemaro, Taupo, Matakaraka B, and Motukahakaha to individuals rather than iwi or hapū, made Ngatikahu ki Whangaroa lands more susceptible to partition, frag- mentation, and alienation; and | 30 | |
(b) this contributed to the erosion of Ngatikahu ki Whangaroa tribal struc- tures, which were based on collective tribal custodianship of land. (5) The Crown acknowledges that the compulsory taking of more than 700 acres for a scenic reserve at Ranfurly Bay in 1919—
(a) caused Ngāti Kaitangata to lose many sites of significance and important urupā and wāhi tapu sites, including an urupā which was partitioned from the surrounding land by the Native Land Court in 1917; and 5
(b) deprived the owners of the significant income they had expected to re- ceive from a 30-year lease of this land; and
(c) was excessive and therefore a breach of Te Tiriti o Waitangi/the Treaty of Waitangi and its principles.
(6) The Crown acknowledges that it took 6 acres at Matakaraka in 1946 for public 10
works, which it retained long after the land was no longer used for the purpose for which it was acquired, and only returned the land in 1990 following appeals from descendants of the block’s former owners.
(7) The Crown acknowledges that it continued negotiations to purchase Matakara-
ka B despite a meeting of assembled owners informing the Crown in 1949 that 15
they wished to retain this land. In 1958, the majority of Matakaraka B was de- clared Crown land after a small number of owners had approved a Crown offer at an assembled owners’ meeting in 1952.
(8) The Crown acknowledges that the cumulative effect of its acts and omissions, including Crown purchases, public works takings, and the operation and impact 20
of the native land laws, left Ngatikahu ki Whangaroa virtually landless. The Crown’s failure to ensure that Ngatikahu ki Whangaroa retained sufficient land for their present and future needs was a breach of Te Tiriti o Waitangi/the Trea- ty of Waitangi and its principles.

11 Interpretation of Act generally
It is the intention of Parliament that the provisions of this Act are interpreted in 35
a manner that best furthers the agreements expressed in the deed of settlement.
In this Act, unless the context otherwise requires,—
administering body has the meaning given in section 2(1) of the Reserves Act 1977 40

attachments means the attachments to the deed of settlement
Commissioner of Crown Lands means the Commissioner of Crown Lands appointed in accordance with section 24AA of the Land Act 1948
computer register—
(a) has the meaning given in section 4 of the Land Transfer (Computer 5 Registers and Electronic Lodgement) Amendment Act 2002; and
(b) includes, where relevant, a certificate of title issued under the Land Transfer Act 1952
consent authority has the meaning given in section 2(1) of the Resource Man- agement Act 1991 10
conservation area has the meaning given in section 2(1) of the Conservation Act 1987
conservation legislation means—
(a) the Conservation Act 1987; and
(b) the enactments listed in Schedule 1 of that Act 15
conservation management plan has the meaning given in section 2(1) of the Conservation Act 1987
conservation management strategy has the meaning given in section 2(1) of the Conservation Act 1987
Crown has the meaning given in section 2(1) of the Public Finance Act 1989 20
cultural redress property has the meaning given in section 61
deed of recognition—
(a) means a deed of recognition issued under section 36 by the Minister of Conservation and the Director-General; and
(b) includes any amendments made under section 36(3) 25
deed of settlement—
(a) means the deed of settlement dated 18 December 2015 and signed by—
(i) the Honourable Xxxxxxxxxxx Xxxxxxxxx, Minister for Treaty of Waitangi Negotiations, and the Honourable Xxxxx Xxxxxxx Xxx-
xxxx, Minister of Finance, for and on behalf of the Crown; and 30

documents schedule means the documents schedule of the deed of settlement
effective date means the date that is 6 months after the settlement date
freshwater fisheries management plan has the meaning given in section 2(1) 5 of the Conservation Act 1987
historical claims has the meaning given in section 14
interest means a covenant, easement, lease, licence, licence to occupy, tenancy, or other right or obligation affecting a property
Kahukuraariki Trust means the trust of that name established by a trust deed 10 dated 7 November 2015
LINZ means Land Information New Zealand
local authority has the meaning given in section 5(1) of the Local Government Act 2002
member of Ngatikahu ki Whangaroa means an individual referred to in sec- 15
tion 13(1)(a)
national park management plan has the meaning given to management plan
in section 2 of the National Parks Act 1980
overlay classification has the meaning given in section 41
property redress schedule means the property redress schedule of the deed of 20 settlement
Registrar-General means the Registrar-General of Land appointed in accord- ance with section 4 of the Land Transfer Act 1952
representative entity means—
(a) the trustees; and 25
(b) any person, including any trustee, acting for or on behalf of—
(i) the collective group referred to in section 13(1)(a); or
(ii) 1 or more members of Ngatikahu ki Whangaroa; or
(iii) 1 or more of the whānau, hapū, or groups referred to in section 13(1)(c) 30
reserve has the meaning given in section 2(1) of the Reserves Act 1977
reserve property has the meaning given in section 61
resource consent has the meaning given in section 2(1) of the Resource Man- agement Act 1991
settlement date means the date that is 40 working days after the date on which 35
this Act comes into force
statutory acknowledgement has the meaning given in section 27

trustees of the Kahukuraariki Trust and trustees mean the trustees, acting in their capacity as trustees, of the Kahukuraariki Trust
working day means a day other than—
(a) Saturday, Sunday, Waitangi Day, Good Friday, Easter Monday, Anzac 5 Day, the Sovereign’s birthday, and Labour Day:
(b) if Waitangi Day or Anzac Day falls on a Saturday or Sunday, the follow- ing Monday:
(c) a day in the period commencing with 25 December in any year and end-
ing with the close of 15 January in the following year: 10
(d) the days observed as the anniversaries of the provinces of Auckland and Wellington.
Meaning of Ngatikahu ki Whangaroa | ||
(1) | In this Act, Ngatikahu ki Whangaroa— | |
(a) means the collective group composed of individuals who are descended from an ancestor of Ngatikahu ki Whangaroa; and | 15 | |
(b) includes those individuals; and | ||
(c) includes any whānau, hapū, or group to the extent that it is composed of those individuals, including the following: | ||
(i) Ngāti Aukiwa: | 20 | |

(a) exercised customary rights by virtue of being descended from— | ||

(b) exercised the customary rights predominantly in relation to the area of interest at any time after 6 February 1840 | ||

(a) rights to occupy land; and
(b) rights in relation to the use of land or other natural or physical resources
descended means that a person is descended from another person by— 5
(a) birth; or
(b) legal adoption; or
(c) whāngai (Māori customary adoption) in accordance with Ngatikahu ki Whangaroa tikanga.
Meaning of historical claims | 10 | |
(1) | In this Act, historical claims— | |
(a) means the claims described in subsection (2); and | ||
(b) includes the claims described in subsection (3); but | ||
(c) does not include the claims described in subsection (4). | ||
(2) | The historical claims are every claim that Ngatikahu ki Whangaroa or a repre- | 15 |
sentative entity had on or before the settlement date, or may have after the | ||
settlement date, and that— | ||
(a) is founded on a right arising— | ||
(i) from the Treaty of Waitangi or its principles; or | ||
(ii) under legislation; or | 20 | |
(iii) at common law (including aboriginal title or customary law); or | ||
(iv) from a fiduciary duty; or | ||
(v) otherwise; and | ||
(b) arises from, or relates to, acts or omissions before 21 September 1992— | ||
(i) by or on behalf of the Crown; or | 25 | |
(ii) by or under legislation. | ||
(3) | The historical claims include— | |

19 Rule against perpetuities does not apply
(1) The rule against perpetuities and the provisions of the Perpetuities Act 1964—
(a) do not prescribe or restrict the period during which—
(i) the Kahukuraariki Trust may exist in law; or 5
(ii) the trustees may hold or deal with property or income derived from property; and
(b) do not apply to a document entered into to give effect to the deed of settlement if the application of that rule or the provisions of that Act would otherwise make the document, or a right conferred by the docu- 10 ment, invalid or ineffective.
(2) However, if the Kahukuraariki Trust is, or becomes, a charitable trust, the ap- plication (if any) of the rule against perpetuities or of any provision of the Per- petuities Act 1964 to that trust must be determined under the general law.
20 Access to deed of settlement 15
The chief executive of the Ministry of Justice must make copies of the deed of settlement available—
(a) for inspection free of charge, and for purchase at a reasonable price, at the head office of the Ministry of Justice in Wellington between 9 am
and 5 pm on any working day; and 20
(b) free of charge on an Internet site maintained by or on behalf of the Min- istry of Justice.
21 Interpretation In this subpart,— protocol—
Part 2 Cultural redress
Subpart 1—Protocols 25
(a) means each of the following protocols issued under section 22(1)(a):
(i) the conservation protocol: 30
(ii) the taonga tūturu protocol; and
(b) includes any amendments made under section 22(1)(b)
responsible Minister means,—
(a) for the conservation protocol, the Minister of Conservation:

General provisions applying to protocols
Issuing, amending, and cancelling protocols | ||
(1) | Each responsible Minister— | |
(a) must issue a protocol to the trustees on the terms set out in part 4 of the documents schedule; and | 10 | |

(a) the ability of the Crown to exercise its powers and perform its functions | ||

(3) | Despite subsection (2), damages or other forms of monetary compensation are not available as a remedy for a failure by the Crown to comply with a | |

Conservation protocol | ||
(1) | The Director-General must note a summary of the terms of the conservation protocol in any conservation management strategy, conservation management plan, freshwater fisheries management plan, or national park management plan that affects the conservation protocol area. | 10 |
(2) | The noting of the summary is— | |
(a) for the purpose of public notice only; and | ||
(b) not an amendment to a strategy or plan for the purposes of section 17I of the Conservation Act 1987 or section 46 of the National Parks Act 1980. | ||
(3) | The conservation protocol does not have the effect of granting, creating, or pro- viding evidence of— | 15 |
(a) rights relating to the common marine and coastal area; or | ||
(b) an estate or interest in land held, managed, or administered under the conservation legislation; or | ||

(1) The taonga tūturu protocol does not have the effect of granting, creating, or providing evidence of an estate or interest in, or rights relating to, taonga tū- 30 turu.
(2) In this section, taonga tūturu—
(a) has the meaning given in section 2(1) of the Protected Objects Act 1975; and
(b) includes ngā taonga tūturu, as defined in section 2(1) of that Act. 35

Subpart 2—Statutory acknowledgement and deed of recognition
In this subpart,—
relevant consent authority, for a statutory area, means a consent authority of
a region or district that contains, or is adjacent to, the statutory area 5
statement of association, for a statutory area, means the statement—
(a) made by Ngatikahu ki Whangaroa of their particular cultural, historical, spiritual, and traditional association with the statutory area; and
(b) set out in part 2 of the documents schedule
statutory acknowledgement means the acknowledgement made by the Crown 10
in section 28 in respect of the statutory areas, on the terms set out in this sub- part
statutory area means an area described in Schedule 1, the general location of which is indicated on the deed plan for that area
statutory plan— 15
(a) means a district plan, regional coastal plan, regional plan, regional poli- cy statement, or proposed policy statement as defined in section 43AA of the Resource Management Act 1991; and
(b) includes a proposed plan, as defined in section 43AAC of that Act.
28 Statutory acknowledgement by the Crown
The Crown acknowledges the statements of association for the statutory areas.
29 Purposes of statutory acknowledgement
The only purposes of the statutory acknowledgement are—
(a) to require relevant consent authorities, the Environment Court, and Her- 25 itage New Zealand Pouhere Taonga to have regard to the statutory ac- knowledgement, in accordance with sections 30 to 32; and
(b) to require relevant consent authorities to record the statutory acknow- ledgement on statutory plans that relate to the statutory areas and to pro-
vide summaries of resource consent applications or copies of notices of 30
applications to the trustees, in accordance with sections 33 and 34; and
(c) to enable the trustees and any member of Ngatikahu ki Whangaroa to cite the statutory acknowledgement as evidence of the association of
Ngatikahu ki Whangaroa with a statutory area, in accordance with sec- 35
tion 35.

Relevant consent authorities to have regard to statutory acknowledgement | ||
(1) | This section applies in relation to an application for a resource consent for an | |
activity within, adjacent to, or directly affecting a statutory area. | ||
(2) | On and from the effective date, a relevant consent authority must have regard | |
to the statutory acknowledgement relating to the statutory area in deciding, | 5 | |
under section 95E of the Resource Management Act 1991, whether the trustees | ||
are affected persons in relation to the activity. | ||
(3) | Subsection (2) does not limit the obligations of a relevant consent authority under the Resource Management Act 1991. | |
Environment Court to have regard to statutory acknowledgement | 10 | |
(1) | This section applies to proceedings in the Environment Court in relation to an | |
application for a resource consent for an activity within, adjacent to, or directly | ||
affecting a statutory area. | ||
(2) | On and from the effective date, the Environment Court must have regard to the | |
statutory acknowledgement relating to the statutory area in deciding, under sec- | 15 | |
tion 274 of the Resource Management Act 1991, whether the trustees are per- | ||
sons with an interest in the proceedings greater than that of the general public. | ||
(3) | Subsection (2) does not limit the obligations of the Environment Court under the Resource Management Act 1991. | |
Heritage New Zealand Pouhere Taonga and Environment Court to have | 20 | |
regard to statutory acknowledgement | ||
(1) | This section applies to an application made under section 44, 56, or 61 of the | |
Heritage New Zealand Pouhere Taonga Act 2014 for an authority to undertake | ||
an activity that will or may modify or destroy an archaeological site within a | ||
statutory area. | 25 | |
(2) | On and from the effective date, Heritage New Zealand Pouhere Taonga must | |
have regard to the statutory acknowledgement relating to the statutory area in | ||
exercising its powers under section 48, 56, or 62 of the Heritage New Zealand | ||
Pouhere Taonga Act 2014 in relation to the application. | ||
(3) | On and from the effective date, the Environment Court must have regard to the | 30 |
statutory acknowledgement relating to the statutory area— | ||
(a) in determining whether the trustees are persons directly affected by the | ||
decision; and | ||
(b) in determining, under section 59(1) or 64(1) of the Heritage New Zea- | ||
land Pouhere Taonga Act 2014, an appeal against a decision of Heritage | 35 | |
New Zealand Pouhere Taonga in relation to the application. | ||
(4) | In this section, archaeological site has the meaning given in section 6 of the | |
Heritage New Zealand Pouhere Taonga Act 2014. |

Recording statutory acknowledgement on statutory plans | ||
(1) | On and from the effective date, each relevant consent authority must attach in- | |
formation recording the statutory acknowledgement to all statutory plans that | ||
wholly or partly cover a statutory area. | ||
(2) | The information attached to a statutory plan must include— | 5 |
(a) a copy of sections 28 to 32, 34, and 35; and | ||
(b) descriptions of the statutory areas wholly or partly covered by the plan; | ||
and | ||
(c) the statement of association for each statutory area. | ||
(3) | The attachment of information to a statutory plan under this section is for the | 10 |
purpose of public information only and, unless adopted by the relevant consent | ||
authority as part of the statutory plan, the information is not— | ||
(a) part of the statutory plan; or | ||
(b) subject to the provisions of Schedule 1 of the Resource Management Act | ||
1991. | 15 | |
Provision of summary or notice to trustees | ||
(1) | Each relevant consent authority must, for a period of 20 years on and from the | |
effective date, provide the following to the trustees for each resource consent | ||
application for an activity within, adjacent to, or directly affecting a statutory | ||
area: | 20 | |
(a) if the application is received by the consent authority, a summary of the | ||
application; or | ||
(b) if notice of the application is served on the consent authority under sec- | ||
tion 145(10) of the Resource Management Act 1991, a copy of the no- | ||
xxxx. | 25 | |
(2) | A summary provided under subsection (1)(a) must be the same as would be given to an affected person by limited notification under section 95B of the Re- | |
source Management Act 1991 or as may be agreed between the trustees and the | ||
relevant consent authority. | ||
(3) | The summary must be provided— | 30 |
(a) as soon as is reasonably practicable after the relevant consent authority | ||
receives the application; but | ||
(b) before the relevant consent authority decides under section 95 of the Re- | ||
source Management Act 1991 whether to notify the application. | ||
(4) | A copy of a notice must be provided under subsection (1)(b) not later than 10 working days after the day on which the consent authority receives the no- | 35 |

(5) | The trustees may, by written notice to a relevant consent authority,— |

(a) under section 95 of the Resource Management Act 1991, whether to no- tify an application:
(b) under section 95E of that Act, whether the trustees are affected persons in relation to an activity.
Use of statutory acknowledgement | 10 | |
(1) | The trustees and any member of Ngatikahu ki Whangaroa may, as evidence of | |
the association of Ngatikahu ki Whangaroa with a statutory area, cite the statu- | ||
tory acknowledgement that relates to that area in submissions concerning activ- | ||
ities within, adjacent to, or directly affecting the statutory area that are made to | ||
or before— | 15 | |
(a) the relevant consent authorities; or | ||
(b) the Environment Court; or | ||
(c) Heritage New Zealand Pouhere Taonga; or | ||
(d) the Environmental Protection Authority or a board of inquiry under Part | ||
6AA of the Resource Management Act 1991. | 20 | |
(2) | The content of a statement of association is not, by virtue of the statutory ac- | |
knowledgement, binding as fact on— | ||
(a) the bodies referred to in subsection (1); or | ||
(b) parties to proceedings before those bodies; or | ||
(c) any other person who is entitled to participate in those proceedings. | 25 | |
(3) | However, the bodies and persons specified in subsection (2) may take the statutory acknowledgement into account. | |
(4) | To avoid doubt,— | |
(a) neither the trustees nor members of Ngatikahu ki Whangaroa are preclu- | ||
ded from stating that Ngatikahu ki Whangaroa has an association with a | 30 | |
statutory area that is not described in the statutory acknowledgement; | ||
and | ||
(b) the content and existence of the statutory acknowledgement do not limit | ||
any statement made. |

(1) | This section applies in respect of the statutory area listed in Part 2 of Sched- ule 1. | |
(2) | The Minister of Conservation and the Director-General must issue a deed of | 5 |
recognition in the form set out in part 3 of the documents schedule for the stat- | ||
utory area. | ||
(3) | The Minister of Conservation and the Director-General may amend the deed, | |
but only with the written consent of the trustees. |
General provisions relating to statutory acknowledgement and deed of 10
recognition
37 Application of statutory acknowledgement to river or stream
If any part of the statutory acknowledgement applies to a river or stream, in- cluding a tributary, that part of the acknowledgement—
(a) applies only to— 15
(i) the continuously or intermittently flowing body of fresh water, in- cluding a modified watercourse, that comprises the river or stream; and
(ii) the bed of the river or stream, which is the land that the waters of
the river or stream cover at their fullest flow without flowing over 20
the banks of the river or stream; but
(b) does not apply to—
(i) a part of the bed of the river or stream that is not owned by the Crown; or
(ii) an artificial watercourse. 25
Exercise of powers and performance of functions and duties | ||
(1) | The statutory acknowledgement and the deed of recognition do not affect, and must not be taken into account by, a person exercising a power or performing a function or duty under an enactment or a bylaw. | |
(2) | A person, in considering a matter or making a decision or recommendation under an enactment or a bylaw, must not give greater or lesser weight to the association of Ngatikahu ki Whangaroa with a statutory area than that person would give if there were no statutory acknowledgement or deed of recognition for the statutory area. | 30 |

(4) | This section is subject to— | |
(a) the other provisions of this subpart; and |

(b) do not have the effect of granting, creating, or providing evidence of an estate or interest in, or rights relating to, a statutory area.
(2) This section is subject to the other provisions of this subpart.

40 Amendment to Resource Management Act 1991
(1) This section amends the Resource Management Act 1991.
(2) In Schedule 11, insert in its appropriate alphabetical order “Ngatikahu ki Whangaroa Claims Settlement Act 2016”.
Subpart 3—Overlay classification 15
In this subpart,—
Conservation Board means a board established under section 6L of the Con- servation Act 1987
New Zealand Conservation Authority means the Authority established by 20 section 6A of the Conservation Act 1987
overlay area—
(a) means the area that is declared under section 42(1) to be subject to the overlay classification; but
(b) does not include an area that is declared under section 53(1) to be no 25 longer subject to the overlay classification
overlay classification means the application of this subpart to the overlay area
protection principles—
(a) means the principles agreed by the trustees and the Minister of Xxxxxx- xxxxxx, as set out in part 1 of the documents schedule; and 30
(b) includes any principles as they are amended by the written agreement of the trustees and the Minister of Conservation
specified actions means the actions set out in part 1 of the documents schedule
statement of values means the statement—

national park management plan that relates to the overlay area, the Authority or | ||
Board must have particular regard to— | ||
(a) the statement of values for the area; and | ||
(b) the protection principles for the area. | ||
(2) | Before approving a strategy or plan that relates to the overlay area, the New | 25 |
Zealand Conservation Authority or a Conservation Board must— | ||
(a) consult the trustees; and | ||
(b) have particular regard to the views of the trustees as to the effect of the | ||
strategy or plan on— | ||
(i) any matters in the implementation of the statement of values for | 30 | |

(ii) any matters in the implementation of the protection principles for | ||
the area. | ||
(3) | If the trustees advise the New Zealand Conservation Authority in writing that | |
they have significant concerns about a draft conservation management strategy | 35 | |
in relation to the overlay area, the Authority must, before approving the strat- |

xxx, give the trustees an opportunity to make submissions in relation to those concerns. | ||
Noting of overlay classification in strategies and plans | ||
(1) | The application of the overlay classification to the overlay area must be noted | |
in any conservation management strategy, conservation management plan, or | 5 | |
national park management plan affecting the area. | ||
(2) | The noting of the overlay classification is— | |
(a) for the purpose of public notice only; and | ||
(b) not an amendment to the strategy or plan for the purposes of section 17I | ||
of the Conservation Act 1987 or section 46 of the National Parks Act | 10 | |
1980. | ||
Notification in Gazette | ||
(1) | The Minister of Conservation must notify in the Gazette, as soon as practicable | |
after the settlement date,— | ||
(a) the declaration made by section 42 that the overlay classification ap- plies to the overlay area; and | 15 | |
(b) the protection principles for the overlay area. | ||
(2) | An amendment to the protection principles, as agreed by the trustees and the | |
Minister of Conservation, must be notified by the Minister in the Gazette as | ||
soon as practicable after the amendment has been agreed in writing. | 20 | |
(3) | The Director-General may notify in the Gazette any action (including any spe- cified action) taken or intended to be taken under section 48 or 49. | |
Actions by Director-General | ||
(1) | The Director-General must take action in relation to the protection principles | |
that relate to the overlay area, including the specified actions. | 25 | |
(2) | The Director-General retains complete discretion to determine the method and | |
extent of the action to be taken. | ||
(3) | The Director-General must notify the trustees in writing of any action intended | |

(c) a reserve under the Reserves Act 1977. |

Termination of overlay classification | ||

of the Minister of Conservation, declare that all or part of the overlay area is no | ||
longer subject to the overlay classification. | ||
(2) | The Minister of Conservation must not make a recommendation for the pur- poses of subsection (1) unless— | |
(a) the trustees and the Minister of Conservation have agreed in writing that | 10 | |
the overlay classification is no longer appropriate for the relevant area; | ||

(b) the relevant area is to be, or has been, disposed of by the Crown; or | ||
(c) the responsibility for managing the relevant area is to be, or has been, | ||

Crown Lands. | ||
(3) | The Crown must take reasonable steps to ensure that the trustees continue to | |
have input into the management of a relevant area if— | ||
(a) subsection (2)(c) applies; or | ||
(b) there is a change in the statutory management regime that applies to all | 20 | |
or part of the overlay area. | ||
Exercise of powers and performance of functions and duties | ||
(1) | The overlay classification does not affect, and must not be taken into account | |
by, any person exercising a power or performing a function or duty under an | ||
enactment or a bylaw. | 25 | |
(2) | A person, in considering a matter or making a decision or recommendation | |
under legislation or a bylaw, must not give greater or lesser weight to the | ||
values stated in the statement of values for the overlay area than that person | ||
would give if the area were not subject to the overlay classification. | ||

Rights not affected | ||
(1) | The overlay classification does not— | |
(a) affect the lawful rights or interests of a person who is not a party to the | ||

or interest in, or rights relating to, the overlay area. |

Subpart 4—Official geographic names
Interpretation | ||

(4) The official geographic name of the reserve must not be changed in accordance with subpart 3 of Part 2 of the Act without the written consent of the trustees,
and any requirements under that subpart or another enactment for public notice 10
of or consultation about the proposed name do not apply.

(3) The Registrar-General must, on written application by an authorised person,—
(a) register the trustees as the proprietors of the fee simple estate in the property; and
(b) record any entry on the computer freehold register and do anything else necessary to give effect to this subpart and to part 5 of the deed of settle- 5 ment.
(4) Subsection (5) applies to a cultural redress property, but only to the extent that subsection (2) does not apply to the property.
(5) The Registrar-General must, in accordance with a written application by an au- thorised person,— 10
(a) create a computer freehold register for the fee simple estate in the prop- erty in the name of the trustees; and
(b) record on the computer freehold register any interests that are registered, notified, or notifiable and that are described in the application.
(6) Subsection (5) is subject to the completion of any survey necessary to create 15
a computer freehold register.
(7) A computer freehold register must be created under this section as soon as is reasonably practicable after the settlement date, but not later than—
(a) 24 months after the settlement date; or
(b) any later date that may be agreed in writing by the Crown and the trust- 20 ees.
(8) In this section, authorised person means a person authorised by—
(a) the chief executive of the Ministry of Justice, for the following proper- ties:
(i) Xxxxxx Block: 25
(ii) Stony Creek Station:
(iii) Thomson Block:
(b) the chief executive of LINZ, for the following properties:
(i) Pukeānginga/Kiwitahi Urupā:
(ii) Temahani Urupā: 30

(1) The vesting of the fee simple estate in a cultural redress property in the trustees under this subpart is a disposition for the purposes of Part 4A of the Conserva- 35 tion Act 1987, but sections 24(2A), 24A, and 24AA of that Act do not apply to
the disposition.

(ii) that the land is subject to sections 80(3) and 86; and | ||
(b) for any other cultural redress property, that the land is subject to Part 4A | ||

(2) | A notification made under subsection (1) that land is subject to Part 4A of the Conservation Act 1987 is to be treated as having been made in compliance | |

(b) part of the property, the Registrar-General must ensure that the notifica- tions referred to in paragraph (a) remain only on the computer free- hold register for the part of the property that remains a reserve. | ||

Application of other enactments | ||
(1) | The vesting of the fee simple estate in a cultural redress property under this | |
subpart does not— | ||
(a) limit section 10 or 11 of the Crown Minerals Act 1991; or | 35 | |

(4) | Section 11 and Part 10 of the Resource Management Act 1991 do not apply | 5 |
to— | ||
(a) the vesting of the fee simple estate in a cultural redress property under | ||
this subpart; or | ||
(b) any matter incidental to, or required for the purpose of, the vesting. | ||
Minister of Conservation may grant easements | 10 | |
(1) | The Minister of Conservation may grant any easement over a conservation area | |
or reserve required to fulfil the terms of the deed of settlement in relation to a | ||
cultural redress property. | ||
(2) | Any such easement is— | |
(a) enforceable in accordance with its terms, despite Part 3B of the Xxxxxx- | 15 | |
vation Act 1987; and | ||
(b) to be treated as having been granted in accordance with Part 3B of that | ||
Act; and | ||
(c) registrable under section 17ZA(2) of that Act as if it were a deed to | ||

Names of Crown protected areas discontinued | ||
(1) | Subsection (2) applies to the land, or the part of the land, in a cultural redress property that, immediately before the settlement date, was all or part of a | |
Crown protected area. | ||
(2) | The official geographic name of the Crown protected area is discontinued in re- | 25 |
spect of the land, or the part of the land, and the Board must amend the Gazet- | ||
xxxx accordingly. | ||
(3) | In this section, Board, Crown protected area, Gazetteer, and official geo- | |
graphic name have the meanings given in section 4 of the New Zealand Geo- | ||

(1) | The trustees are the administering body of a reserve property. | |

with section 87 or 88. | ||
(3) | In this section and sections 87 to 89, reserve land means the land that re- mains a reserve as described in subsection (1). | |
Transfer of reserve land to new administering body | ||
(1) | The registered proprietors of the reserve land may apply in writing to the Min- | 20 |
ister of Conservation for consent to transfer the fee simple estate in the reserve | ||
land to 1 or more persons (the new owners). | ||
(2) | The Minister of Conservation must give written consent to the transfer if the | |
registered proprietors satisfy the Minister that the new owners are able— | ||
(a) to comply with the requirements of the Reserves Act 1977; and | 25 | |
(b) to perform the duties of an administering body under that Act. | ||
(3) | The Registrar-General must, upon receiving the required documents, register | |
the new owners as the proprietors of the fee simple estate in the reserve land. | ||
(4) | The required documents are— | |
(a) a transfer instrument to transfer the fee simple estate in the reserve land | 30 | |
to the new owners, including a notification that the new owners are to | ||
hold the reserve land for the same reserve purposes as those for which it | ||
was held by the administering body immediately before the transfer; and | ||
(b) the written consent of the Minister of Conservation to the transfer of the | ||
reserve land; and | 35 | |
(c) any other document required for the registration of the transfer instru- | ||
ment. | ||
(5) | The new owners, from the time of their registration under this section,— |

Transfer of reserve land to trustees of existing administering body if | ||

The registered proprietors of the reserve land may transfer the fee simple estate | ||
in the reserve land if— | ||
(a) the transferors of the reserve land are or were the trustees of a trust; and | 10 | |
(b) the transferees are the trustees of the same trust, after any new trustee | ||
has been appointed to the trust or any transferor has ceased to be a | ||
trustee of the trust; and | ||
(c) the instrument to transfer the reserve land is accompanied by a certifi- | ||
cate given by the transferees, or the transferees’ solicitor, verifying that paragraphs (a) and (b) apply. | 15 | |
Reserve land not to be mortgaged | ||
The owners of reserve land must not mortgage, or give a security interest in, | ||
the reserve land. | ||

(1) | This section applies to any bylaw, or any prohibition or restriction on use or | |
access, that an administering body or the Minister of Conservation made or im- | ||
posed under the Conservation Act 1987 or the Reserves Act 1977 in relation to | ||
a reserve property before the property was vested in the trustees under this sub- | ||
