NEW CONTRACT. When a first contract is signed the period of employment for vacation and sick leave eligibility shall be measured from the last date of hire with the Employer, except as provided in Article 17, Section D hereof.

The parties agree that at the end of the term of this Agreement the parties shall, without obligation, review the terms of this Agreement for the purpose of negotiation of a new agreement for a further term of five (5) years. NEW CONTRACT. The Company acknowledges that only new contracts will be financed by the Investor and not contracts for which works have been commenced or partially or fully performed. The Company declares and confirms that the Awarded Contract is a newly awarded contract and it has not commenced any work in relation to the same.

NEW CONTRACT. During the executory period of this Agreement, without Purchaser's prior written consent (which consent shall not be unreasonably withheld or delayed), Seller will not enter into, extend, renew or amend in any material respect, terminate (unless the party with whom Seller is in contract is in default or breach of its obligations under such contract), or waive any default under, any contract that will be an obligation affecting the Property following the close of escrow; provided, however, the foregoing shall not preclude or prevent Seller from entering into any contract that does not encumber the Property but that is related solely to the operation of Seller's business conducted on the Property, nor shall the foregoing prevent Seller from renewing or extending any contract applicable to the Excluded Area or the Improvements thereon which is related solely to the operation of Seller's business conducted on the Property and which will not survive the termination of expiration of the Sublease.
