Transfer Process. In-district and out-of-district positions may be posted and received by the District at the same time. However, out-of-district applications for open positions shall be placed in a separate file and shall not be considered in any way until all in- district employees have been notified of the results of their request for transfer.
Transfer Process. In determining transfers, the special needs of students, school-based requirements, and employee preferences will be given equal consideration. The Human Resources Department and Director responsible for the Department of Learning Services, in consultation with the school-based Administrator and Education Assistants, will determine placements in order of seniority. Education Assistants will be assigned to a school and/or a program and will be required to complete a probationary or trial period of ninety (90) days in accordance with the terms of the Collective Agreement. Any reduction of Education Assistant staff will occur prior to staffing day. The Union will be notified by Human Resources of all Education Assistant assignment changes or vacancies. If, as the result of this assignment process there are insufficient vacancies to place all Education Assistants, those with the least seniority will be laid off with the right to go on recall or bump outside the auspices of the Department of Learning Services. Should concerns arise with the administration or application of this Letter of Understanding, the parties will meet expeditiously. If the matter cannot be resolved by the parties, written submissions will be made to an agreed-upon Umpire for a recommended resolve. If this is not acceptable, Article 12.03 c) (Step III) of the Collective Agreement will apply.

Should a Shareholder wish to cause some or all of its Super Voting Shares to be Transferred in accordance with the provisions of this Article 3 the Shareholder shall provide to the Company all information necessary as requested by the Company to ensure that the proposed transferee of the Super Voting Shares is a Person contemplated under the provisions of Section 3.1, and upon the Company's determination in its sole discretion that the proposed Transfer is permitted under the provisions of Section 3.1, the Company shall provide its written approval for the purposes of the Articles as soon as practicable, and shall upon delivery of all necessary share certificates and instruments of transfer and accession agreements hereto in form and content satisfactory to the Company, shall cause such Transfer to be effected and reflected in the Company's central securities register. The Company shall also amend the provisions of Schedule 2.2 hereof to reflect the ownership of the Super Voting Shares arising from such Transfer.

Upon proper notice and concurrence by the City Manager, an employee may be transferred by the appointing authority from one position to another in the same pay range provided he/she possesses the minimum qualifications as determined by the Human Resources Director. If the transfer involves a change from one department to another, both department heads must consent thereto unless the City Manager orders the transfer for purposes of economy and efficiency. The employee shall be given five (5) business days' written notice of the transfer including the reason for the change.

Transfers will be immediately debited from the Sender's Account and will be delivered to the Recipient's Financial Institution or Bethpage, as applicable, once claimed by the Recipient. The receiving Financial Institution may have limits on the number and amount of Transfers allowed and on the timing for when the funds will be available to the Recipient. Neither Bethpage nor Acculynk is responsible for any failure of another Financial Institution to timely credit its customer's account.

In the event of a transfer pursuant to section 6.1, the Administrator will transfer the Common Shares, money or other property held for the benefit of the Member in the transferring Member’s Non-Registered Account to the Trustee, on behalf of the Member, as directed by the Member, to be held by the Trustee in trust for the benefit of the Member. The Trustee (or the Administrator as agent for the Trustee) will record in such Member’s Registered ESPP Account the number of Common Shares (including any fraction thereof) so held by the Trustee for the benefit of such Member. The certificate representing any Common Shares so transferred will, prior to the withdrawal of such Common Shares from the Member’s Registered ESPP Account, be registered in the name of the Trustee or its nominee. The Member will provide the Administrator or Trustee with such information, and comply with such requirements as the Administrator or Trustee may require in relation to any capital gains which may be realized by the Member as a result of any such transfer. The Member effecting such transfer will have sole liability for determining and discharging any tax liability of the Member in respect of or arising as a result of such transfer.
