Vacation Accrual Maximum. Employees shall not accumulate more than two hundred seventy-five (275) hours of vacation leave. Additional hours that would have accrued at the rates in this Agreement shall be forfeited unless a denial of a vacation request prevents an employee from avoiding the 275 hours maximum. If denial of a vacation request prevents an employee from avoiding the 275 hour maximum, the employee shall be paid at regular rate for those hours accrued over 275 hours. This article is subject to the provision that the Employer shall have the option to "buy back" any vacation hours over 250 that an employee has accrued at the end of each fiscal year, at the employee's regular straight time rate.

Vacation Accrual Maximum. EMPLOYEES shall be allowed to carry over a maximum of 2 times their annual vacation accrual from one calendar year to the next (EMPLOYEES may accrue over 2 times during the calendar year). As of December 31, if an employee is over 2 times the annual vacation accrual, the employee will stop accruing vacation until they are below the maximum accrual limit. If an EMPLOYEE has requested and been denied vacation leave within four (4) months of the time that the vacation accrual maximum will be reached, enforcement of the vacation leave accrual maximum shall be postponed for six (6) months from the date of denial. The department and EMPLOYEE shall schedule the use of vacation time sufficient to reduce the EMPLOYEE'S accrual below the maximum within a reasonable time.

When the number of days accrued reaches the maximum amount allowable, vacation days will cease to accumulate until the total balance drops below the two-year maximum. The two-year accrual maximum is based on the employee’s current accrual rate. Vacations shall be scheduled as requested by employees as far as possible within the District’s work requirements. If there is a conflict, the needs of the District will govern the scheduling of vacations. If a decision must be made between two or more employees as to vacation scheduling, the employee with the greatest District seniority will be given preference.

All employees working an 80 hours/pay period schedule shall be entitled to earn and accrue up to and including three hundred and twenty (320) hours of vacation.
