Exchange Data definition

Exchange Data means certain data and other information: (a) disseminated by a System relating to securities or other financial instruments, products, vehicles, currencies, or other means; or (b) related to Persons regulated by an Exchange or to activities of an Exchange; or (c) gathered by CDS from other sources, in each case (other than foreign currency trading data) sourced by CDS within the U.S.
Exchange Data means certain data and other information disseminated relating to securities or other financial instruments, products, vehicles, or devices; or relating to Persons regulated by BATS or to activities of BATS; or gathered by BATS from other sources, in each case sourced by BATS within the U.S.
Exchange Data means certain data and other information: (a) disseminated by a System relating to securities or other financial instruments, products, vehicles, or other means; or (b) related to Persons regulated by MEMX or to activities of MEMX; or (c) gathered by MEMX from other sources.

Exchange Data means Data in Your Account that consists solely of Microsoft Exchange 2010 and 2013 mailboxes and public folders. If Your Exchange Data (a) becomes corrupted in Your Intermedia-hosted Exchange 2010 or 2013 database, or (b) is lost due to a direct failure of the relevant Intermedia hardware or datacenter where Your Exchange Data is hosted (each, an “Event”), and Intermedia fails to restore Your Exchange Data to the last known good state, as determined by Intermedia, within five (5) business days of your initial submission of a technical support ticket in the administrative control panel reporting Exchange Data loss, Intermedia will issue a credit (“Recovery Credit”) for the corresponding amount stated in the table: Amount of Exchange Data that Intermedia was not able to restore Recovery Credit Less than 24 hours of Exchange Data 25% of monthly fee 24 hours to 48 hours of Exchange Data 50% of monthly fee More than 48 hours of Exchange Data 100% of monthly fee To request a Recovery Credit, (a) Your Account must be in good standing with Intermedia, (b) You must open a Technical Support Ticket in the administrative control panel reporting Exchange Data loss within seventy-two (72) hours of the Event, and (c) You must send an email or written Recovery Credit request to the Billing Department at xxxxxxx@xxxxxxxxxx.xx.xx in the month immediately following the month for which You are requesting a Recovery Credit. Recovery Credit requests must include Your Account name or Account number and the dates and specific periods of lost or corrupted Exchange Data for which You are requesting the Recovery Credit. Intermedia will compare information provided by You to the actual Exchange Data that resides in Your Exchange 2010 or 2013 database. If Intermedia is unable to restore the relevant Exchange Data within five (5) business days of a valid Recovery Credit request, You will receive a monthly fee credit of one hundred percent (100%).

Exchange Data has the meaning set forth in the definition of “Monthly Floor Price Computation.”

The limits and sole remedies regarding Recovery Credits and total credits under this SLA are set forth in Section 4 of this Service Level Agreement.

If Client Exchange Data (i) becomes corrupted in Client CODEBLUE TECHNOLOGY-hosted Exchange 2010 database, or (ii) is lost due to a direct failure of the relevant CODEBLUE TECHNOLOGY hardware or datacenter where Client Exchange Data is hosted (each, an “Event”), and CODEBLUE TECHNOLOGY fails to restore Client Exchange Data to the last known good state, as determined by CODEBLUE TECHNOLOGY, within five (5) business days of Client initial submission of a Technical Support Ticket in the administrative control panel reporting Exchange Data loss, CODEBLUE TECHNOLOGY will issue a credit (“Recovery Credit”) for the corresponding amount stated in the table: Amount of Exchange Data that CODEBLUE TECHNOLOGY was not able to restore Recovery Credit Less than 24 hours of Exchange Data 25% of monthly fee 24 hours to 48 hours of Exchange Data 50% of monthly fee More than 48 hours of Exchange Data 100% of monthly fee To request a Recovery Credit, (a) Client Account must be in good standing with CODEBLUE TECHNOLOGY, (b) Client must open a Technical Support Ticket in the administrative control panel reporting Exchange Data loss within 72 hours of the Event, and (c) Client must send an email or written Recovery Credit request to the Billing Department at CODEBLUE TECHNOLOGY Billing Contact in the month immediately following the month for which Client are requesting a Recovery Credit. CODEBLUE TECHNOLOGY will compare information provided by Client to the actual Exchange Data that resides in Client Exchange 2010 database.
