Common use of Abandonment of Suit Clause in Contracts

Abandonment of Suit. If either ULRF or Licensee commences a suit and thereafter intends to abandon the suit, it will give timely notice to the other Party. The other Party may continue prosecution of the suit after ULRF and Licensee agree on the sharing of expenses and any recovery in the suit.

The other Party may continue prosecution of the suit after ULRF suit, in which case Section 11.2 shall apply if such other Party is Licensee and Licensee agree on the sharing of expenses Sections 11.4 and any recovery in the suit11.5 shall apply if such other Party is ULRF.
