Common use of Absence of Notice Clause in Contracts

Absence of Notice. In the event that there is more than one Paying Agent and in the absence of any notice from the Principal Paying Agent under Clause 6.6 (Failure to receive timely payment), each other Paying Agent shall be entitled to: (a) assume that the Principal Paying Agent has received the full amount of principal and interest payable in respect of the Notes on the relevant due date; (b) pay amounts of principal and interest then payable on the Notes in accordance with the Conditions and the terms of this Agreement; and (c) claim any amounts so paid by it from the Principal Paying Agent.

Absence of Notice. In the event that there is more than one Paying Agent and in the absence of any notice from the Principal Paying Agent under Clause 6.6 (Failure to receive timely paymentReceive Payment), each the other Paying Agent Agents shall be entitled to: (a) assume that the Principal Paying Agent has received the full amount of principal and interest payable in respect of the Notes on the relevant due date; (b) pay amounts of principal and interest then payable on the Notes in accordance with the Conditions and the terms of this Agreement; and (c) claim any amounts so paid by it them from the Principal Paying Agent.

In the event that there is more than one Paying Agent and in the absence of any notice from the Principal Paying Agent under Clause 6.6 5.6 (Failure to receive timely payment), each other Paying Agent shall be entitled (but not obliged) to: (a) assume that the Principal Paying Agent has received the full amount of principal and interest payable in respect of the Notes on the relevant due date; (b) pay amounts of principal and interest then payable on the Notes in accordance with the Conditions and the terms of this Agreement; and (c) claim any amounts so paid by it from the Principal Paying Agent.
