Common use of Acceptance of Employment; Standard of Performance Clause in Contracts

Acceptance of Employment; Standard of Performance. The Subadvisor accepts such appointment to serve as subadvisor and agrees to use its best professional judgment to make investment decisions and provide related services for the Series in accordance with the terms and conditions set forth in this Agreement. The parties acknowledge and agree that the services of the Subadvisor hereunder are not deemed exclusive and that accordingly, the Subadvisor may render services to others so long as those services do not conflict in any material manner with the Subadvisor's performance of its duties and obligations pursuant to this Agreement.
