Common use of Acceptance of Flows from the Municipality Clause in Contracts

Acceptance of Flows from the Municipality. During the term hereof, the Municipality shall have the contractual right to discharge Wastewater into the York Interceptors subject to the following limitations: Average Daily Flow (ADF): 3,011,500 Gallons/Day as a monthly average Peak Daily Flow (PDF): 12,046,000 Gallons/Day Peaking Factor 4.0 PDF/ADF The Municipality covenants and agrees that it will not discharge Wastewater into the York Interceptors in a manner that constitutes an Allocated Capacity Default, as set forth herein, except as may be allowed by York hereunder.
