Access Obligations for Railway. This clause sets out the intention of the State and the Company that the Railways (Access) Act 1998 (WA) and the Railways (Access) Code 2000 (WA) apply to the Railway), sets out related provisions and imposes a range of obligations on the Company in respect of access by persons to the Railway. It also foreshadows the Company's intention to seek acceptance of a haulage service undertaking under the provisions of the Australian Consumer Law (Commonwealth).

  • Client’s Obligations 4.1 The Client shall:

  • Exception to Obligations Neither Party's obligations under this Section shall apply to the extent the infringement is caused by: (i) modification of the facilities or equipment (including software) by the indemnitee; (ii) use by the indemnitee of the facilities or equipment (including software) in combination with equipment or facilities (including software) not provided or authorized by the indemnitor, provided the facilities or equipment (including software) would not be infringing if used alone; (iii) conformance to specifications of the indemnitee which would necessarily result in infringement; or (iv) continued use by the indemnitee of the affected facilities or equipment (including software) after being placed on notice to discontinue use as set forth herein.

  • Recipient's Obligations A. Recipient agrees that the Confidential Information is to be considered confidential and proprietary to Owner and Recipient shall hold the same in confidence, shall not use the Confidential Information other than for the purposes of its business with Owner, and shall disclose it only to its officers, directors, or employees with a specific need to know.
