Common use of Access to Official Files Clause in Contracts

Access to Official Files. (a) A Member may request, at least twenty-four (24) hours in advance, to the appropriate Xxxx to examine all of the Member’s Official File during normal business hours, in the presence of the Xxxx or the Xxxx’x designate. Members will be required to provide identification before access to the Official File is granted. Before a Member examines the Member’s file, confidential materials will be removed. (b) The contents of a Member’s Official File will be made available only to authorized representatives of the Employer for the purpose of administering the Collective Agreement. The Official File can be made available to other persons only with the written consent of the Member, with the exception of instances where it is required by law. In such cases, the Member will be immediately notified of the details of the release, including the names of any persons granted access to the Official File and the legal reasons for the granting of access, unless such notification is prohibited by law.
