Common use of Access to Project Site Clause in Contracts

Access to Project Site. 43.1 The Employer warrants that the Consultant shall have, free of charge, unimpeded access to the project site in respect of which access is required for the performance of the Services. The Employer will be responsible for any damage to the project site or any property thereon resulting from such access and will indemnify the Consultant and each of the Staff in respect of liability for any such damage, unless such damage is caused by the wilful default or negligence of the Consultant or any Sub-consultants or the Staff of either of them.

The Employer Procuring Entity will be responsible for any damage to the project site or any property thereon resulting from such access and will indemnify the Consultant and each of the Staff experts in respect of liability for any such damage, unless such damage is caused by the wilful willful default or negligence of the Consultant or any Sub-consultants or the Staff Experts of either of them.

The Employer Procuring Entity will be responsible for any damage to the project site or any property thereon resulting from such access and will indemnify the Consultant and each of the Staff experts in respect of liability for any such damage, unless such damage is caused by the wilful willful default or negligence of the Consultant or any Sub-consultants or the Staff Experts of either of them.

Access to Project Site. 43.1 The Employer Client warrants that the Consultant shall have, free of charge, unimpeded access to the project site site(s) in respect of which access is required for the performance of the Services. The Employer will be responsible for Consultant shall indemnify the Client against any damage to the project site or any property thereon resulting from such access and will indemnify the Consultant and each of the Staff in respect of liability for any such damage, unless if such damage is caused by the wilful default or negligence of the Consultant or any Sub-consultants Consultant(s) or the Staff of either of themtheir Personnel.
