Common use of Access to Property Not Under Owner’s Control Clause in Contracts

Access to Property Not Under Owner’s Control. Consultant acknowledges that the Project may require access to property not under the control of Owner at the time of execution of this Agreement. Consultant and Consultant’s employees and consultants shall, at Consultant’s expense, obtain all additional necessary approvals and clearances required for access to such property. Owner shall assist Consultant in obtaining access to such property at reasonable times but make no warranty or representation whatsoever regarding access to such property. Consultant understands and agrees that entry to properties not under Owner’s control may require Consultant to comply with the terms of separate access agreements to be negotiated hereafter with owners of such property.
