Common use of Access to Right of Way Clause in Contracts

Access to Right of Way. DB Contractor shall be entitled to a Change Order for delays to the Critical Path due to failure of TxDOT to make available a portion of the Schematic ROW, or any Additional Properties that must be acquired due to a TxDOT- Directed Change, Force Majeure Event, or a Necessary Basic Configuration Change, as provided in Section 4.6.9.5 of the General Conditions and subject to the requirements of Section 4.6 of the General Conditions. The Contract Documents are hereby amended by the provisions set forth in Exhibit 24 to this DBA.
