Access to the Site. 22.1 The Contractor shall allow the Engineer and any person authorized by the Engineer access to the Site, to any place where work in connection with the Contract is being carried out or is intended to be carried out and to any place where materials or plant are being manufactured / fabricated / assembled for the works.
Access to the Site. (a) The Buyer acknowledges that:
(i) the Developer, its contractors and its nominees have exclusive access to and possession of the Site to carry out the Building Works; and
(ii) the Buyer has no right to have access to or to go onto the Site at any time, unless by arrangements under paragraph (c).
(b) The Developer is entitled to allow or refuse access to anyone, and may order unauthorised people from the Site.
(c) Subject to paragraph (d), the Buyer and any authorised officer of the Buyer's Bank may go onto the Site to inspect the Building Works. If the Buyer or any authorised officer of the Buyer's Bank is permitted by the Developer to go onto the Site, those persons do so entirely at their own risk.
(d) The Buyer acknowledges that the Developer will be engaging the services of a builder to deliver the Building Works. The appointed builder will have sole responsibility for compliance with work health safety legislation and therefore prior to allowing access to the Site the appointed builder may:
(i) prescribe times during which access will, or will not, be permitted;
(ii) require compliance with site induction and training requirements;
(iii) require acknowledgments and waivers to be signed; and
(iv) issue reasonable instructions which must be complied with by the Buyer and any authorised officer of the Buyer's Bank.
Access to the Site. 10.2.1 During the Development Period, TANGEDCO hereby grants to the Mine Developer and Operator access to the Site for carrying out any survey, investigation and soil test that the Mine Developer and Operator may deem necessary during the Contract Period, it being expressly agreed and understood that TANGEDCO shall have no liability whatsoever in respect of the surveys, investigations and tests carried out or works undertaken by the Mine Developer and Operator on or about the Site pursuant hereto in the event of Termination or otherwise.
10.2.2 In consideration of development of Mines, this Agreement and the covenants and warranties on the part of the Mine Developer and Operator herein contained, TANGEDCO, in accordance with the terms and conditions set forth herein, hereby grant to the Mine Developer and Operator, commencing from the CP Completion Date, access to and permission to work or to use in respect of all the land, along with all buildings, constructions or immovable assets, if any, thereon comprising the real estate, which is more particularly described, delineated and shown in Schedule A hereto (the Site),on an "as is where is" basis to develop, operate and maintain the said Site, for the purposes permitted under this Agreement, and for no other purpose whatsoever. The Mine Developer and Operator hereby acknowledges and accepts that the entire Site shall be and shall at all times remain the exclusive and absolute property of TANGEDCO and neither the Mine Developer and Operator nor any persons claiming through or under the Mine Developer and Operator shall have or shall at any time claim any propriety, right, title or interest in such Site.
10.2.3 The Mine Developer and Operator shall perform its obligations in a manner that the existing roads, if any, along the boundary of the Mines, or an alternative thereof are open to traffic at all times during the Contract Period. The MDO shall construct access/approach road to the mine from the neighbouring public road. Strengthening, widening of the existing roads to establish access to the Site shall be carried out by MDO on their own cost. If any land required shall be acquired by MDO for which documented cost shall be borne by TANGEDCO in accordance to the provisions of Article-18.
10.2.4 It is expressly agreed that all rights and permissions of the Mine Developer and Operator granted hereunder in respect of the Site shall terminate automatically and forthwith, without the need for any action to be tak...
Access to the Site a) The Contractor will be responsible for maintaining the access to the Site during the course of the Contract.
Access to the Site. Except to the extent prohibited by applicable Law or any Consent, the City shall grant to the Supplier non-exclusive, timely and in accordance with any agreed schedule, access (as the City is reasonably able to provide) to all necessary areas of the Site on and from the Effective Date and such other non-exclusive access as is necessary or appropriate to perform the Supply and the Supplier’s other obligations in accordance with this Agreement.
Access to the Site. Owner shall provide Contractor with reasonable access to the Site on which the Project is to be physically situated. Subject to Section 3.13, such access on the Site shall be sufficient to permit Contractor to progress with the Work without substantial interruption or interference.
