Common use of Access to Right of Way Clause in Contracts

Access to Right of Way. DB Contractor shall be entitled to a Change Order for delays to a Critical Path due to failure of TxDOT to make available a portion of the Schematic ROW, or any Additional Properties that must be acquired due to a TxDOT- Directed Change, Force Majeure Event, or a Necessary Basic Configuration Change, only to the extent provided in Sections 4.4.5.3 and 4.6.9.5 of the General Conditions (as amended by this Design-Build Agreement) and subject to the requirements of Section 4.6 of the General Conditions. 6.5.1 Section 4.6.9.5 of the General Conditions is amended as follows: (i) underlined text is hereby added to Section 4.6.9.5 of the General Conditions and (ii) stricken text is hereby deleted from Section 4.6.9.5 of the General Conditions:
