Account Alerts. Alerts. Your enrollment in 1st Constitution Bank Online Banking and/or Mobile Banking (the “Service”) includes enrollment to receive transaction alerts and notifications (“Alerts”). Alerts are electronic notices from us that contain transactional information about your 1st Constitution Bank account(s). Alerts are provided within the following categories:  Mandatory Alerts provide you with important account notifications, such as information about changes to your Online Banking password, PIN, or login information. You do not have the option to suppress these Mandatory Alerts.  Account Alerts must be activated by you to be enabled. These Account Alerts can be accessed from the Alerts menu within 1st Constitution Bank Online Banking and Alerts menu within 1st Constitution Bank Mobile Banking. Account Alerts must be managed and/or added online through the Service. You cannot maintain all Alerts though your mobile device. We may add new Alerts from time to time, or cancel old Alerts. We usually notify you when we cancel Alerts, but are not obligated to do so. 1st Constitution Bank reserves the right to terminate its Alerts service at any time without prior notice to you. Methods of Delivery. We may provide Alerts through one or more channels (“EndPoints”): (a) a mobile device, by text message, (b) a mobile device, by push notification; (c) an email account, by an e-mail message; or (d) your 1st Constitution Bank Online Banking message in-box, by an e-mail message. You agree to receive Alerts through these EndPoints, and it is your responsibility to determine that each of the service providers for the EndPoints described in (a) through (c) above supports the email, push notification, and text message Alerts provided through the Alerts service. Please be advised that text or data charges or rates may be imposed by your EndPoint service provider. Alert frequency varies by account and preferences. You agree to provide us a valid mobile phone number or email address so that we may send you Alerts. If your email address or your mobile device's number changes, you are responsible for informing us of that change. Your Alerts will be updated to reflect the changes that you communicate to us with regard to your primary and secondary email addresses or mobile device number.

You may receive transaction alerts and notifications Alerts through a SMS-enabled mobile device (“AlertsMobile Alert”), an e-mail account that is accessed via a personal computer (“E-mail Alert”), or both. By enrolling or using the Service, you agree to the following Service Terms and Conditions. The Service allows you to request and receive Alerts are electronic notices from us that contain transactional information about your 1st Constitution Bank account(s). You canacknowledge and accept that each Alert may be sent to you without being encrypted and may include your name and information pertaining to your account. Depending upon which Alerts you select, information such as your account balance may be included. Anyone with access to your mobile device will be able to view the contents of these Alerts. It is your responsibility to: ensure the security of your mobile device; determine if your wireless provider supports SMS; and ensure your mobile device is capable of receiving SMS. You acknowledge that message and data rates may apply. You are solely responsible for any fees imposed of any kind whatsoever by your wireless service provider. Credit Union provides the Alerts Service purely as a convenience to you and for information purposes only. Credit Union does not maintain assume any additional responsibility or obligation in respect of the use of, or any transaction on your account. The Service does not free you from the responsibility of safeguarding the physical security and authorized use of your account or security codes. You acknowledge and agree that your receipt of any Alert may be delayed or prevented by factors outside of Credit Union’s control, including factors affecting your wireless or Internet service provider and coverage in your area. We do not guarantee the delivery, timeliness or accuracy of the contents of any Alert. The Service is subject to transmission limitations and service interruptions. You agree to indemnify, defend and hold Credit Union and agents free and harmless from any and all losses or damages, including attorneys' fees, that may arise, directly or indirectly, in whole or in part, from: a non-delivery, delayed delivery, or the misdirected delivery of an Alert; inaccurate or incomplete content in an Alert; your reliance on or use of the information provided in an Alert for any purpose; or any third party, whether authorized or not, obtaining information regarding your account disclosed in the Alerts though by accessing your mobile device. We may add new Alerts from time to timeTHE CREDIT UNION DISCLAIMS ANY RESPONSIBILITY AND ALL WARRANTIES OF ANY KIND, or cancel old AlertsWHETHER EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE. You acknowledge and agree that your receipt of any Alert may be delayed or prevented by factor(s) outside of our control, including factors affecting your wireless service provider and coverage in your area. You will promptly notify us if you are unable, for any reason, to receive text, or push alerts. You agree to indemnify, defend and hold us and our directors, officers, employees and agents and Service Providers free and harmless from any and all losses or damages, including attorneys' fees, lost profits, and indirect or special damages, including, but not limited to, to those relating to bank secrecy or financial privacy laws or regulations, that may arise, directly or indirectly, in whole or in part, from: a non-delivery, delayed delivery, or the misdirected delivery of an Alert; inaccurate or incomplete content in an Alert; your reliance on or use of the information provided in an Alert for any purpose; or any third party, whether authorized or not, obtaining information regarding your account disclosed in the Alerts. You may transfer funds between your Checking, Savings and Money Market Accounts you maintain with us. You may also transfer funds to a loan or credit Account you have with us using eBanking. You will be able to make funds transfers that are effective when you complete the transfer online, schedule future-dated transfers, and establish recurring transfers. The Available Balance of the Account from which funds are transferred (FROM Account) and the Available Balance of the Account to which funds are transferred (TO Account) will be updated as soon as the transfer is complete. If the transfer is made to a loan or credit Account, the principal balance of the loan or credit account will be updated as soon as the transfer is complete. Transfers made to pay off a loan or credit Account in full may take longer to process. Generally, the maximum dollar limit on any transfer is equal to the Available Balance in your FROM Account and may also include the unused credit limit of a Preferred Credit Loan account associated with the Account (if applicable) and the Overdraft Privilege Limit associated with the Account (if applicable), at the time the transfer is completed by us. It is your responsibility to determine ensure that each of sufficient funds are available for a requested transfer at the service providers for the EndPoints described in (a) through (c) above supports the email, push notification, time it is to occur and text message Alerts provided through the Alerts service.
