ACDBE Compliance. (1) The Authority will conduct post-award compliance reviews to ensure that the ACDBE participation is occurring in accordance with the proposal and any agreements between the ACDBE and the Contractor approved by the Authority. (2) The Contractor shall provide true and accurate monthly reports of the ACDBE participation under this Contract using the “Monthly Report Form- ACDBE Concessions Program” as shown on Exhibit D-1. This report will include (as attachments to the report) minutes from joint venture management meetings, if applicable. This report is to be submitted each month with the Contractor’s Monthly Certified Statement. (3) Failure to provide ACDBE participation in accordance with this Contract may be considered a material breach of the Contract and the Authority may utilize all remedies authorized by the Contract, including, but not limited to, termination of the Contract for default.
