Acknowledgement/Individual Clean Water Fund Loans. In the event the SSR Parties obtain individual Clean Water Fund loans in connection with construction of the First Group of Improvements, Racine and the Wastewater Commission acknowledge that the SSR Parties have authority to take certain actions regarding construction of the First Group of Improvements or operation or maintenance of the construction project if actions by Racine or the Wastewater Commission make a violation of such Parties’ Clean Water Fund loans likely. Examples of actions such Parties may be authorized to take include, but are not limited to, the following: (1) to ensure adequate construction and completion of the project; (2) to prevent erosion during construction of the project;
