Action by. EMPLOYER Action by the Employer under the Plan shall be carried out by the sole proprietor, if the Employer is a sole proprietorship, by a general partner of the Employer, if the Employer is a partnership, or by the board of directors or a duly authorized officer of the Employer, if the Employer is a corporation. If the Employer is no longer in existence, and the Plan does not specify the person to take an action, or otherwise serve in the place of the Employer, in connection with the operation of the Plan, the Plan Administrator shall so act or serve, but if there is no person serving as Plan Administrator, such action shall be taken by a person selected following the approach referred to in paragraph 12.2. The Trustee/Custodian shall have, and assume, no responsibility for inquiring into the authority of any person purporting to act on behalf of an Employer.
Action by. Simple In Simple Cut Mode, all lines are scheduled to cut at the same time. Cut lines can be turned on or off individually, but cannot be sorted to cut in a specific order. In Simple Cut Mode, you can adjust the Cut Style of individual lines in your project. Cut Edge – This option will cut the outer edge of any overlapping lines and will suppress any lines with the same attribute if they are contained inside a larger image. This option may be preferable for the creation of Print & Cut images. Action By: Line Color, Fill Color, or Layer You have the option to break up your project into multiple stages. This is especially handy if your project is designed to be cut in several colors or with projects that are to be sketched and then cut out. You can schedule cuts by line color, fill color, or by layer (Designer Edition only). By Line Color - All of the line colors present in your project will be visible in the cut menu. Based on line color, you can turn cut lines on or off, activate or deactivate auto-weld, and arrange a cutting order. By Fill Color - All of the fill colors present in your project will be visible in the cut menu. Action by. TRUSTEES Except as otherwise provided by the 1940 Act or other applicable law, this Declaration of Trust or the By-Laws, any action to be taken by the Trustees on behalf of or with respect to the Trust or any Sub-Trust or class thereof may be taken by a majority of the Trustees present at a meeting of Trustees (a quorum, consisting of at least one-half of the Trustees then in office, being present), within or without Delaware, including any meeting held by means of a conference telephone or other communications equipment by means of which all persons participating in the meeting can hear each other at the same time, and participation by such means shall constitute presence in person at a meeting, or by written consents of a majority of the Trustees then in office (or such larger or different number as may be required by the 1940 Act or other applicable law).

  • Legal Action If you are dissatisfied with the determination of your claim, and have complied with applicable state and federal law, you are entitled to seek judicial review.
