Common use of ACTIONS OR PROCEEDINGS AGAINST THE UNIVERSITY Clause in Contracts

ACTIONS OR PROCEEDINGS AGAINST THE UNIVERSITY. No action or proceeding shall lie or be maintained by the Consultant, or anyone claiming under or through the Consultant, against the University or any of its trustees, officers, agents or employees, upon any claim arising out of or based upon this Agreement or any breach thereof or by reason of any act or omission of the University or its trustees, officers, agents or employees, unless such action or proceeding is commenced within one (1) year after the University’s acceptance of the construction work.
