Common use of ACTIVITY LIFE Clause in Contracts

ACTIVITY LIFE. 3.1 The duration of the Activity Life for Grant Activities performed under the Grant Agreement is listed below. 3.2 The start and end date of the Activity Life for each Grant Activity will be established by the TCEQ in accordance with Article 1.1, General Conditions of this Agreement. 3.3 For on-road heavy-duty vehicle replacement activities, performance of an Activity may be completed eariier than the specified end date if the following conditions are met: 3.3.1 the duration of the Activity Life for that Activity is 5 years; 3.3.2 the Usage Factor for that Activity as listed in Article 5.1 of this Scope of Work is in miles; 3.3.3 the total usage commitment of an Activity, calculated by multiplying the Annual Usage Rate by 5 years, totals 400,000 miles or less; and 3.3.4 the actual total miles of operation of the Grant Equipment from the start date of the Activity Life reaches 400,000 miles.
