Activity Not a Project. The Tribe may determine, acting pursuant to its Tribal Environmental Protection Ordinance, that a proposed activity involving a physical change to the reservation environment, the principle purpose of which is directly related to the activities of the Gaming Operation, is not a Project because it will not cause a Significant Effect on the Off-Reservation Environment, and the Tribe shall notify the State within thirty (30) days of that determination and the basis therefor.
