Activity Not a Project. The Tribe may determine, acting pursuant to its Tribal Environmental Protection Ordinance, that a proposed activity involving a physical change to the reservation environment, the principle purpose of which is directly related to the activities of the Gaming Operation, is not a Project because it will not cause a Significant Effect on the Off-Reservation Environment, and the Tribe shall notify the State within thirty (30) days of that determination and the basis therefor. The State shall inform the Tribe in writing of any objection to the Tribe’s determination that the activity is not a Project and the basis upon which it objects within thirty
