Common use of Additional Adequate Protection Clause in Contracts

Additional Adequate Protection. Any of the Banks reserves, with respect to Pre-Petition Loans, the right to petition the Bankruptcy Court or the Canadian Court for additional adequate protection with respect to any Pre-Petition Collateral and to retain all rights under the Existing Credit Agreement, the Bankruptcy Code, or otherwise; provided that, if such additional adequate protection causes the Borrowers to violate the Budget, then the amount of such increase in disbursements to the Banks required by such additional adequate protection shall not be included in calculating compliance with the Budget.
