Additional Drainage. No party to this Agreement will drain any additional drainage volume into the storm sewer facilities constructed under the construction contract that was not included in the drainage for which the storm sewer facilities were designed, without first obtaining written permission to do so from the other party.

Additional Drainage. No party to this Agreement will drain any additional drainage volume into the storm sewer facilities constructed under the design-build contract that was not included in the drainage for which the storm sewer facilities were designed, without first obtaining written permission to do so from the other party. The drainage areas served by the storm sewer facilities constructed under the design-build contract are shown in a drainage area map, Exhibit "Drainage Area", which is on file in the office of the State's District Hydraulics Unit at Roseville and is incorporated into this Agreement by reference.
Additional Drainage. VCTC hereby authorizes Developer to fill the Temporary Drainage Facilities upon completion by Developer of the Drainage Structures, as demonstrated by a document showing that a final inspection has been conducted and approved by either City or the County, and as authorized by CDFW in correspondence attached as Exhibit C. The right of Developer to fill the Temporary Drainage Facilities and the obligations of VCTC set forth in Section 20 shall continue in perpetuity, notwithstanding the termination of this Agreement, upon completion by Developer and approval by City or County of the permanent drainage culvert and provision by Developer to VCTC of the documentation described in the first sentence of this Section 3, Developer shall have the right to carry out the Work described in this Section 3 pursuant to the Construction Easement.
