Maintenance Responsibilities. Agency shall, at its own expense, maintain operate, and provide power as needed upon Project completion at a minimum level that is consistent with normal depreciation and/or service demand and throughout the useful life of the Project. The useful life of the Project is defined in the Special Provisions. State may conduct periodic inspections during the life of the Project to verify that the Project is properly maintained and continues to serve the purpose for which federal funds were provided. Maintenance and power responsibilities shall survive any termination of the Project Agreement. In the event the Project will include or affect a state highway, this provision does not address maintenance of that state highway.
Maintenance Responsibilities. A. Except as to loss or damage caused by fire or other casualty insured against, or in the case of uninsured property, loss or damage resulting from windstorm, other natural casualty, or fire not resulting from negligence or fault of the Concessionaire, its agents, employees, assignee, subcontractor, sublessee, or licensee, the Concessionaire shall provide at its expense all maintenance and repairs needed to keep and maintain the whole of the Properties and appurtenances in good, rentable condition at all times during the term of this Lease and shall replace items as required under this Lease. “Good, rentable condition” is intended to mean a condition that the typical visitor would deem acceptable and equivalent to conditions found in similar facilities elsewhere.
B. The Concessionaire shall, at its cost and expense, provide all routine repairs and maintenance required to preserve the buildings, structures and equipment furnished by the Department under this Lease. Such maintenance and repairs shall include, but shall not be limited to:
1. Interior painting of building with prior approval of the park manager;
2. Drain cleaning and maintenance within the confines of the concession buildings;
3. Plumbing fixture repair and replacement, including the water heater(s);
4. Lighting fixture repair and replacement, including bulbs and security lighting on the building, if applicable;
5. Window and screen replacement;
6. Door repair and replacement;
7. Lock repair and replacement;
8. Electrical wiring and plumbing necessitated by additional equipment of the Concessionaire;
9. Furnace cleaning and furnace filter replacement;
10. Air conditioner unit repair and replacement;
11. Maintenance, repair and replacement of equipment or other structures provided by the Concessionaire;
12. Repair and replacement of equipment as enumerated on Attachment B;
13. Cost of major structural repairs resulting from the Concessionaire’s negligence or failure to perform required routine repairs and maintenance;
14. Pest control including, but not limited to wasps, hornets, mud daubers, and mice;
15. Routine maintenance boat docks included in the Properties, including but not limited to bumper replacement and cleat replacement;
16. Repair of the gasoline dispensers when necessitated by age or other cause; and
17. Exterior painting as approved by the Department.

Maintenance Responsibilities. At all times during the term of this Agreement, the Lessee shall, at the Lessee’s sole cost and expense, keep the Premises in good order, condition and repair, and clean, sanitary and safe, ordinary wear and tear excepted. The Lessee shall comply with all federal, state and local requirements of law, by statute, rule, ordinance or otherwise, affecting the Premises and all appurtenances thereto. The Lessor will not be required to make any repairs to the Premises occasioned by the act or neglect of the Lessee, its agents, employees, guests, clients, customers, patrons or invitees. Any of the foregoing repairs required to be made by reason of the negligence of the Lessee, its agents, employees, guests, clients, customers, patrons or invitees shall be the responsibility of the Lessee. If the Lessee refuses or fails to make such repairs hereunder, the Lessor may make and complete such repairs and add the cost thereof to the total rental amount due. The Lessee will not knowingly allow any nuisance(s) to exist upon the Premises.
Maintenance Responsibilities. CBE shall, during and following CBE events and at its expense, keep the interior of the Stadium, the exterior of the Stadium between the Stadium and the public streets immediately bordering the Stadium, and City parking lots designated by City for game day parking, in a neat, clean, safe, and sanitary condition, including but not limited to the removal of all waste and litter. The City shall provide for dumpster access for use by CBE. The City shall provide any reasonable equipment, materials, or supplies necessary for the maintenance. The City is responsible for providing CBE pregame field preparation and regular field and facility maintenance. The City shall has provided minimal necessary and identified locker room and umpire area upgrades prior to the 2020 season, and shall assist CBE on game and other event days by making available for CBE’s use items from the City inventory of event supplies, including but not limited to chairs, tables, and popup tents.

b. The Concessionaire shall, at its sole cost and expense, provide all routine maintenance and repairs to preserve the buildings furnished by the Department under this Lease. Such routine maintenance and repairs shall include, but shall not be limited to:
1. interior painting of building with prior approval of the park manager
2. drain cleaning and maintenance within the confines of the concession building
3. plumbing fixture repair and replacement; this shall include all interior plumbing and winterization of the Properties
4. water heater repair and replacement
5. routine maintenance and care of the water system at the marina, to include but not be limited to replacement of water filters
6. drain cleaning and maintenance within the confines of the concession building(s)
7. electric and light fixture repair and replacement, including bulbs and ballasts
8. window and screen replacement
9. door repair and replacement
10. hood and ventilation system cleaning and inspection on an annual basis or more often if required by the Department or by the Concessionaire’s insurance carrier. The Park Manager should be notified of all mandated inspections and forwarded the results of all inspections when received by the Concessionaire.

Maintenance Responsibilities. 9.1 The Requesting Operator shall be responsible for the maintenance of those facilities which it provides in respect of a specified Blockwiring, including:
(a) the BIP;
(b) the tie cables connecting the BIP with the termination point of the Providing Operator’s main distribution frame if the BIP and the Providing Operator’s main distribution frame are located in different rooms, or if the cable distance of a tie cable is more than meters;
(c) the sub-local box;
(d) the horizontal wiring; and
(e) the customer termination socket that the Requesting Operator provides.
Maintenance Responsibilities. Each Owner shall be responsible for ensuring that the Unit is in good condition at the time of resale, with reasonable wear and tear acceptable. This obligation includes all matters which are in the control and responsibility of an Owner, and includes, but is not limited to cleaning the Unit and making necessary improvements to repair and maintain plumbing and mechanical fixtures, appliances, carpet or other flooring, roofs, painting and other similar items in good working order and condition, the Unit must contain all of the appliances that originally came with the Unit, of similar quality, and there must be no outstanding health or safety code violations.

Maintenance Responsibilities. A. The TOLLWAY agrees to maintain I-355 in its entirety.
B. The COUNTY shall continue its maintenance of the right-of-way of the Illinois Prairie Path Bridge, the St. Xxxxxxx Road Bridge, and the Great Western Trail Bridge. The COUNTY will maintain any PROJECT improvement the ILLINOIS TOLLWAY is constructing as part of the PROJECT for the COUNTY at the COUNTY’s request, in its entirety.
C. The bridge improvements being constructed under this AGREEMENT are of the following types as described in Section VI, Paragraph D above and involve the following local road(s):
X. Xxxx 0 - XXXXXX Xxxxxxx over ILLINOIS TOLLWAY Right of Way
1. The COUNTY has all maintenance responsibility as to the following:
a. All existing COUNTY right of way highway and approaches to any of the BRIDGES, including but not limited to pavement, curb and gutter, shoulders, guardrail, fences and screening, approach embankments outside access control fences, and bituminous repair of approach slabs.
b. The following portions of the BRIDGES:
i. The wearing surface;
ii. The deck below the wearing surface and above the structural beams including expansion joints, parapet walls, etc.;
iii. Guardrail;
iv. Fences and screening;
v. Drainage facilities above structural beams and girders;
vi. All lighting except underpass;
vii. All COUNTY signals, signs, and pavement markings;
viii. To the extent not addressed in other intergovernmental agreements to which the COUNTY is a PARTY, any facilities designed for traffic other than motor vehicles, such as bicycle or pedestrian paths or lanes;
ix. All drainage facilities carrying exclusively COUNTY drainage;
x. Ice and snow removal shall be accomplished in such a manner as to not block or obstruct I-355.
2. The ILLINOIS TOLLWAY has all maintenance responsibility for all portions of the BRIDGES not otherwise maintained by the COUNTY as set forth herein above, including but not limited to the following:
a. All parts of the grade separation structure, including but not limited to bearings, beams, girders, slope walls, abutments and piers;
b. All fences along ILLINOIS TOLLWAY routes, except COUNTY highway overpass fencing installed to separate pedestrians, bicycles and non-vehicular traffic from highway traffic;
c. All bridge deck downspouts, from a clean-out installed directly below the scuppers to the outfall;
d. All remaining drainage facilities installed for the purpose of carrying exclusively Toll Highway drainage;
e. Any underpass lighting.
