Additional Orders. Customer may order more Appliances, Software product modules and additional usage of the Software as permitted under this Agreement by executing the LogRhythm Order in addition to submitting written purchase orders to LogRhythm. The terms of this Agreement shall govern all such Orders submitted by Customer; no additional or inconsistent term or condition in any such order shall have any legal effect.
Additional Orders. Company, at its sole discretion, will allow the terms of this contract to be extended to both the Customer, as well as to other Municipal, State, or Federal agencies for similar unit(s). Company will allow tag on / additional orders for up to three (3) years from the date of contract execution. To facilitate pricing, Company will quote the original price plus manufacturer’s price increases or Producer’s Price Index (PPI) whichever is greater as it applies to either Fire Apparatus and/or commercial heavy truck industries. Additionally, any regulatory changes (NFPA, EPA, Engine Emissions, FMVSS, etc.) will also have to be added to the price as they become applicable. Change orders to the original specification will need to be authorized, signed, and accepted by Company. Any entity using this tag‐on/additional orders program will be required to sign a new contract commencing the relationship. Additionally, if required by the Purchaser, any new tag‐on / additional orders that require a “separate” Performance bond will be separately priced. This contract, including its appendices, embodies the entire agreement between the parties relating to the subject matter contained herein and merges all prior discussions and agreements. No agent or representative of Company has authority to make any representations, statements, warranties, or agreements not herein expressed and all modifications of amendments of this agreement, including any appendices, must be in writing and executed by an authorized representative of each of the parties hereto. No surety of any performance bond given by Company to the Customer in connection with this Agreement shall be liable for any obligation of Company arising under the Standard Applicable Warranty.
Additional Orders. Additional orders may be made from time to time under the terms of this Agreement by Company through an Order Form, although Provider has no obligation whatsoever to accept such order. Fees for additional orders shall be assessed at the then current rate. The parties agree that the terms of this Agreement will govern all purchases and use by Company of Provider Technology and Services unless otherwise agreed by the parties in writing. Provider and Company agree that Affiliates of Company may acquire Provider Technology and Services from Provider or Provider’s Affiliates by entering an Order Form with Provider or a Provider Affiliate that is governed by the terms and conditions of this Agreement.
Additional Orders. (a) This clause applies where it is specified in Item 10 of the Order Form that the Customer may place Additional Orders for Services and/or Deliverables within the scope of this Agreement.
(b) If, at any time during the Term, the Customer wishes to increase the volume or quantum of Services and/or Deliverables, the Customer may, in its sole discretion, do so by submitting a written notice to the Supplier for those increased Services and/or Deliverables. The written notice will be in the form required by the Customer and will include information relating to the Additional Order, including the number of additional Services and/or Deliverables required.
(c) Except to the extent agreed by the parties in writing, any increased Deliverables and/or Services will be supplied for the same rates and charges specified in the Payment Particulars.
(d) The parties agree that each time the Customer submits an Additional Order to the Supplier:
(i) that Additional Order forms part of this Agreement, and will not constitute a separate contractual relationship between the parties; and
(ii) the Supplier must increase the supply of the Deliverables and/or Services in accordance with that Additional Order, subject to any reasonable qualifications specified in Item 10 of the Order Form.
Additional Orders. During the Term, Purchaser may request to submit an additional purchase order for additional doses of the Product in writing to Pfizer. Upon written confirmation by Pfizer to Purchaser that Pfizer has additional doses to allocate to Purchaser (which sha l be determined in Pfizer’s sole discretion), and the number of such additional doses of Product, Purchaser may, during the Term, submit to Pfizer a subsequent legally binding and irrevocable Purchase Order (“Additional Order”) which shall be subject to the terms and conditions set forth in this Agreement. 3.
Additional Orders. C&C shall submit any additional orders for SiC exceeding the minimum quantities set forth in Exhibit B at least ninety (90) days prior to the requested shipping date. Subject to the foregoing, Jesperator shall use all reasonable efforts to ship the requested SiC on or before the date requested by C&C in its order.
Additional Orders. Subject to strict compliance with the provisions of this Modification #3, additional Avistar orders in excess of the * Codecs under this New Order shall be subject to a * per unit price plus * for maintenance or such other price as the parties may mutually agree at order placement time.
Additional Orders. Unless it is specifically stated to the contrary in the bid response, the City of Fairhope reserves the option to place additional orders against a contract awarded as a result of this solicitation at the same terms and conditions; to extend the renewal date until a new bid is in place, if it is mutually agreeable.
Additional Orders. At any time, following Customer’s execution of the initial Order Form, Customer may subscribe to or purchase additional products or services offered by Company, or otherwise expand the scope of the GoFan® Solution provided to Customer, upon Company’s receipt and acceptance of an amendment to an existing Order Form or additional Order Forms. The GoFan® Solution is subject to any usage limits that are specified in the Order Forms.
Additional Orders. Bitstream may accept purchase orders from Licensee for additional Licensed Products of similar classification to those at Exhibit A and such additional orders shall be governed by this Agreement, but nothing in Licensee’s purchase order or other communication shall be deemed to modify or add to the provisions or this Agreement or otherwise have any effect on the Licensed Products. This Agreement shall cover any item or service furnished by Bitstream to Licensee unless specifically covered by another written agreement signed by the respective officers of both Bitstream and Licensee.
