Additional Representations by Settlement Class Counsel. Settlement Class Counsel certify that, as of the date of the execution of this Agreement, they (i) do not currently represent any client besides the Settlement Class Representatives with claims against Mercury; (ii) are not aware of any other individual or entity with active claims against or intending to assert against Mercury; (iii) are not presently soliciting any client to assert any claims against Mercury; and (iv) have not encouraged and will not encourage any Settlement Class Member to opt out of this Settlement.

Additional Representations by Settlement Class Counsel. Settlement Class Counsel represent that, as of the date of the execution of this Agreement, they (i) do not represent any client besides Settlement Class Representatives with claims against Mowi arising out of Mowi’s marketing of the Ducktrap Products; (ii) do not presently intend to solicit any client to assert such claims against Mowi; (iii) have not encouraged and will not encourage any Settlement Class Member to opt out of this Settlement, provided that they may present Settlement Class Members with the fact that they have the option to seek to exclude themselves from the Settlement Class; and (iv) shall not offer to represent any Settlement Class Member that submits a request for exclusion.
