Volume for each payment period shall be calculated by multiplying the number of loaded vans (vans delivered to load count locations) by the specified tonnage listed above. Special Load Count Product Removal Permits will be issued for chip vans. Product Removal Permits shall be completed by an assigned individual on the landing following the instructions on the inside cover of the product removal book. The truck driver shall sign for the load and the Product Removal Permit will then be stapled to a piece of wood or similar material attached to the lower front of the van on the driver's side. If a loaded van is staged on the Contract Area or any other approved location, the driver, prior to moving van, shall record the removal date, and sign on the outside of the attached ticket as instructed on the inside cover of the Product Removal Permit Book, section II.A.5 . Truck drivers are responsible for insuring the Product Removal Permit is attached to the load prior to removal from the loading area and until the load is accounted for at the final delivery point. All load count locations are to be final delivery points unless otherwise agreed to in writing. When other than the final delivery point is agreed to, the agreement shall require a designated individual to remove the scaler's portion of the product removal permit and return it to the agreed upon Forest Service location. The load portion of the Product Removal Permit shall remain attached to the load until it reaches the final delivery point. When hauling to the final delivery point for load count services is requested, Contractor shall sign an Alternate Scaling Agreement prior to hauling. This agreement shall clearly state the procedure for removal and return of the Product Removal Permits to Forest Service. Contractor shall make all necessary arrangements to implement load count services and make deposits to cover all costs associated with load count services including but not limited to the following: Designated individual removing Product Removal Permits Mailing scaler's portion of the Product Removal Permit to Forest Service on a daily basis Forest Service may agree to processing load count data. Locations other than final destination points shall be as close to the Contract Area as practicable. All holdover locations off the Contract Area, where vans may be stored for some period of time (over 24 hours), shall have an approved Holdover Yard Agreement in place prior to use. If staging areas on the Contract Area are to be used they must be approved in advance. Tickets will remain attached to vans until delivery to final destination. Chip vans used to move products from the Contract Area must display on the van the first letter of the van owner's last name and the last 3 numbers from the van license plate, e.g. P123, unless another unique identification system is agreed to. The characters are to be a minimum of 6 inches in height and located high enough on the van to be visible at all times. The characters are to be located on both the driver and passenger side at the front of the van. This same van identification shall be written in the Product Removal Permit book on the xxxxx permit that remains in the book. Lost load receipts will be paid for at the contract rate plus deposits at the agreed to tonnage per van load as stated above. K-G.8.4.9 - PRODUCT ACCOUNTABILITY (02/2005) Unscaled products from Included Timber shall not be hauled or presented for scaling on Sundays, Holidays, or after normal scaling hours at the designated scaling location without the written approval of the Contracting Officer. It will be difficult, if not impossible to determine the volume, weight, and species contained in such loads for payment purposes. Therefore, lost sample loads shall be assigned a volume and species composition equal to that of the highest value load Scaled during the sampling period as determined by Forest Service. If sample load is weighed but not Scaled, the weight shall be used as recorded. Otherwise the load will be assigned a weight equal to that of the highest weight load Scaled during the sampling period as determined by Forest Service. If no sample loads were Scaled during the period, the Scale data for the high-value load shall be taken from the most current preceding sampling period with Scale. Piles shall also be placed a minimum of 50 feet away from any improvements (not including roads). All piles shall be reasonably compact and free of soil to facilitate burning and shall be constructed of such size and at such distance from trees so that burning shall not result in unnecessary damage to residual timber. Material shall be bucked into lengths not exceeding 12 feet prior to piling. Piles shall be located a distance of at least twice their height in feet from the outer edge of any woody vegetation, live or dead, and no greater than 16 feet wide and 12 feet in height. Piles shall be no less than 4 feet in height. Material extending 3 feet or more outside the edge of a pile shall be trimmed. An eight foot fuelbreak shall be cleared of all but fine material around each grapple pile and an 18 inch wide fireline shall be cleared to mineral soil around the outer ring of the fuelbreak. For hand piles, Contractor shall construct a fireline cleared to mineral soil and at least 3 feet wide around each pile. In areas where there is between 3.9 & 9.9 inches in DBHa potential for burning material to roll, all firelines, shall be trenched on the downhill side of each pile to adequately prevent material from rolling crossing firelines. Material accumulated at landings shall be considered as Timber Subject to Agreement under C2.11K-C.1.1#, described as Substandard Material and may be removed and paid for at Contractor's option. * S A M P L E * C6.815 K-G.8.1.5 - THIRD PARTY SCALING SERVICES (09/2004) Notwithstanding the requirement for Forest Service or parties under contract to Forest Service to provide Scaling services under B6.81G.8.1, Scaling designated in A10 A.10 shall be conducted by a third party Scaling organization approved by Forest Service. Scaling shall be done in accordance with A9 A.9 and Contractor shall bear costs for Scaling service. In the event third party Scaling service is suspended for causes such as strikes, termination of third party's approval to Scale National Forest logs by Forest Service, or Contractor's failure to pay third party Scaling costs, hauling operations shall be suspended until agreed alternate Scaling services are provided or service by third party is resumed. When an approved alternate Scaling location pursuant to B6.811 G.8.1.1 does not have an approved third party scaling organization as a commonly used Scaling services provider, Forest Service or parties under contract to Forest Service shall provide Scaling services at the approved alternate location. In such an event, the cost of waived third party Scaling listed in A10 A.10 shall be charged to Integrated Resource Account. If Forest Service and Contractor agree in writing that another party under contract to Forest Service will perform Scaling, the contract will be modified to include C6.816# K-G.8.1.6 and Integrated Resource Account will be charged for such Scaling. C6.9K-G.8.1.7# - LOAD COUNT SERVICES (02/2005) Stumpage payments shall be based on 25 Green Tons per loaded van of chips that leaves the Contract Area unless otherwise agreed to in writing. Volume for each payment period shall be calculated by multiplying the number of loaded vans (vans delivered to load count locations) by the specified tonnage listed above. Special Load Count Product Removal Permits will be issued for chip vans. Product Removal Permits shall be completed by an assigned individual on the landing following the instructions on the inside cover of the product removal book. The truck driver shall sign for the load and the Product Removal Permit will then be stapled to a piece of wood or similar material attached to the lower front of the van on the driver's side. If a loaded van is staged on the Contract Area or any other approved location, the driver, prior to moving van, shall record the removal date, and sign on the outside of the attached ticket as instructed on the inside cover of the Product Removal Permit Book, section II.A.5 . Truck drivers are responsible for insuring the Product Removal Permit is attached to the load prior to removal from the loading area and until the load is accounted for at the final delivery point. All load count locations are to be final delivery points unless otherwise agreed to in writing. When other than the final delivery point is agreed to, the agreement shall require a designated individual to remove the scaler's portion of the product removal permit and return it to the agreed upon Forest Service location. The load portion of the Product Removal Permit shall remain attached to the load until it reaches the final delivery point. When hauling to the final delivery point for load count services is requested, Contractor shall sign an Alternate Scaling Agreement prior to hauling. This agreement shall clearly state the procedure for removal and return of the Product Removal Permits to Forest Service. Contractor shall make all necessary arrangements to implement load count services and make deposits to cover all costs associated with load count services including but not limited to the following: Designated individual removing Product Removal Permits Mailing scaler's portion of the Product Removal Permit to Forest Service on a daily basis Forest Service may agree to processing load count data. When other than final delivery point for load count services is requested, the individual responsible for performing load count services shall be approved in advance by Forest Service and is responsible for the following: Removing Product Removal Permit and mailing on a daily basis to: Location: Stanislaus National Forest, Supervisor's Office (Attn: Campy Scale) Address: 00000 Xxxxxxxx Xx, Sonora CA 95370 The location where Product Removal Permits are to be removed shall be open to inspection by Forest Service at all times while hauling is in progress. When locations other than final product destination are requested, hours and days of operation shall be agreed to in writing and hauling will take place only when designated individual is physically present. Locations other than final destination points shall be as close to the Contract Area as practicable. All holdover locations off the Contract Area, where vans may be stored for some period of time (over 24 hours), shall have an approved Holdover Yard Agreement in place prior to use. If staging areas on the Contract Area are to be used they must be approved in advance. Tickets will remain attached to vans until delivery to final destination. Chip vans used to move products from the Contract Area must display on the van the first letter of the van owner's last name and the last 3 numbers from the van license plate, e.g. P123, unless another unique identification system is agreed to. The characters are to be a minimum of 6 inches in height and located high enough on the van to be visible at all times. The characters are to be located on both the driver and passenger side at the front of the van. This same van identification shall be written in the Product Removal Permit book on the xxxxx permit that remains in the book. Lost load receipts will be paid for at the contract rate plus deposits at the agreed to tonnage per van load as stated above. K-G.8.4.9 - PRODUCT ACCOUNTABILITY (02/2005) Unscaled products from Included Timber shall not be hauled or presented for scaling on Sundays, Holidays, or after normal scaling hours at the designated scaling location without the written approval of the Contracting Officer. K-G.8.5.2 - SCALING LOST SAMPLE WEIGHT LOADS (02/2005) If Scaling is being done by sampling loads of logs, Contractor shall present such sample loads for Scaling by Forest Service. If loads of logs selected to be sample Scaled are placed in the decks before they are Scaled, they shall be considered as lost sample loads. It will be difficult, if not impossible to determine the volume, weight, and species contained in such loads for payment purposes. Therefore, lost sample loads shall be assigned a volume and species composition equal to that of the highest value load Scaled during the sampling period as determined by Forest Service. If sample load is weighed but not Scaled, the weight shall be used as recorded. Otherwise the load will be assigned a weight equal to that of the highest weight load Scaled during the sampling period as determined by Forest Service. If no sample loads were Scaled during the period, the Scale data for the high-value load shall be taken from the most current preceding sampling period with Scale. Sample loads lost as a result of Forest Service actions shall be treated as non-sample loads. K-G.9# - STEWARDSHIP PROJECTS (09/2004) * S A M P L E * Performance of stewardship projects shall be in accordance with the following specifications. C7.2# - SPECIFIED FIRE PRECAUTIONS (06/2012) Contractor or a designated Contractor's Representative shall certify compliance with specific Contract and California Public Resources Code (CPRC) fire precautionary measures in B7.2 Plans, C7.2# and C7.22#. Certification shall be provided prior to starting operations during Fire Precautionary Period and shall be updated as needed. Listing of specific fire precautionary measures in the following subsections is not intended to relieve Contractor in any way from compliance with State fire laws covering fire prevention and suppression equipment applicable to Contractor's Operations. Upon request of Forest Service, Contractor shall permit and assist in periodic testing and inspection of required fire equipment. The following definitions shall apply to C7.2# and C7.22#: Active Landing: A location Contractor is skidding logs into, or performing other operations such as delimbing, log manufacturing, and chipping logs.
