ADDITIONAL TERMS & LIMITATIONS FOR UNSUPPORTED PRODUCTS. 6.1 Pre-Release Product. If the product you have received with this license is "Alpha" or "Beta" product (such Alpha or Beta product referred to herein as "Pre-Release Product"), then the provisions of this section apply. You acknowledge that Zyrion has not promised or guaranteed to you that Pre-Release Product will be announced or made available to anyone in the future; Zyrion has no express or implied obligation to you to announce or introduce the Pre-Release Product; and you understand that Zyrion may not introduce a product similar to or compatible with the Pre-Release Product. Accordingly, you acknowledge that any Use of the Pre-Release Product or any product associated with the Pre- Release Product is done entirely at your own risk. During the term of this Agreement, if requested by Zyrion, you will provide feedback to Zyrion regarding testing and use of the Pre-Release Product, including error or bug reports. If you have been provided the Pre-Release Product pursuant to a separate written agreement, your use of the Pre-Release Product is also governed by such agreement. Upon receipt of a later unreleased version of the Pre-Release Product or release by Zyrion of a publicly released commercial version of the Pre-Release Product, whether as a stand-alone product or as part of a larger product, you agree to return or destroy all copies of earlier Pre-Release Product received from Zyrion and to abide by the terms of the applicable End User License Agreement for any such later versions of the Pre-Release Product. You hereby agree that the features and functions of Pre-Release Products are confidential, and you will not disclose any such features and functions until such time as the Pre-Release is publicly available.

  • Additional Products Upon satisfying the minimum order requirements above, Enrolled Affiliate may order Additional Products.

  • Additional Products and Services Subject to the allocation of funds, the CPO may add similar equipment, supplies, services, or locations, within the scope of this Agreement, to the list of equipment, supplies, services, or locations to be performed or provided by giving written notification to Contractor. For purposes of this Section, the “Effective Date” means the date specified in the notification from the CPO. As of the Effective Date, each item added is subject to this Agreement, as if it had originally been a part, but the charge for each item starts to accrue only on the Effective Date. In the event the additional equipment, supplies, services, or locations are not identical to the items(s) already under this Agreement, the charges therefor will then be Contractor’s normal and customary charges or rates for the equipment, supplies, services, or locations classified in the Fees and Costs (Exhibit “F”).

  • New Products You agree to comply with NASD Notice to Members 5-26 recommending best practices for reviewing new products.

  • Vendor Logo (Supplemental Vendor Information Only) No response Optional. If Vendor desires that their logo be displayed on their public TIPS profile for TIPS and TIPS Member viewing, Vendor may upload that logo at this location. These supplemental documents shall not be considered part of the TIPS Contract. Rather, they are Vendor Supplemental Information for marketing and informational purposes only. Some participating public entities are required to seek Disadvantaged/Minority/Women Business & Federal HUBZone ("D/M/WBE/Federal HUBZone") vendors.   • Product Specific Terms these terms apply to specific Products referenced in this section.

  • Description of Goods or Services and Additional Terms and Conditions The Contractor shall perform as set forth in Exhibit A. For purposes of this Contract, to perform and the performance in Exhibit A is referred to as “Perform” and the “Performance.”

  • Funding Restrictions and Order Quantities The Agency reserves the right to reduce or increase estimated or actual quantities in whatever amount necessary without prejudice or liability to the Agency, if: 12.3.1 Funding is not available; 12.3.2 Legal restrictions are placed upon the expenditure of monies for this category of service or supplies; or, 12.3.3 The Agency’s requirements in good faith change after award of the contract.

  • DISTRIBUTION OF CONTRACTOR PRICE LIST AND CONTRACT APPENDICES Contractor shall provide Authorized Users with electronic copies of the Contract, including price lists and Appendices, upon request. Contract Updates will be handled as provided in Appendix C – Contract Modification Procedures.

  • Procurement of Recovered Materials In the performance of this contract, the Contractor shall make maximum use of products containing recovered materials that are EPA-designated items unless the product cannot be acquired
