FUNCTIONS OF. The Union agrees that the Employer has the exclusive right and power to manage its business to direct the working forces and to suspend, discharge or discipline employees for just and sufficient cause, to hire, promote, demote, transfer or lay-off employees, to establish and maintain reasonable rules and regulations covering the operation of the stores, provided however, that any exercise of these rights and pow- ers in conflict with any of the provisions of this Agreement shall be subject to the provisions of the Grievance Procedure as set out herein. It is agreed that the direction of the working force shall be at the discretion of the Employer within the of this Agreement.

FUNCTIONS OF. Except to the extent expressly abridged or limited by a specific provision of this Agreement, the Company reserves and retains all of it's inherent rights to manage the business. Such rights include management's right to establish or continue policies, practices, production standards, and procedures for the conduct of the business and, from time to time, to change or abolish such policies, practices, production standards and procedures; the right to determine, and from time to time redetermine, the number, location and types of it's operations and methods, processes and materials to be employed; to change, curtail or discontinue processes or operations or discontinue their performance by employees of the Company; to determine the need for and identity of suppliers, contractors, and subcontractors; to determine the number of hours per day or per week operations shall be carried on; to hire, select and determine the number of employees required; to assign work to such employees in accordance with requirements determined by management; to establish and change work schedules and assignments; to transfer, promote or demote employees; to lay off, terminate or otherwise relieve employees from duty for lack of work or other reasons; to make and enforce reasonable rules for maintenance of discipline; to suspend, discharge or otherwise discipline employees for just cause; and otherwise to take such measures as management may determine to be necessary for the orderly, safe and efficient conduct of the business, The parties recognize the necessity of eliminating restrictions and promoting efficiency and agree that no rules, customs or practices shall be permitted that limit production or increase the time required to do the work which an employee shall perform during the workday nor shall there be any restrictions against the uses of any kind of machinery, tools, or labour-saving devices.

B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.
