Common use of ADEA Waiver Clause in Contracts

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you have under the ADEA, and that the consideration given for the waiver and release you have given in this Agreement is in addition to anything of value to which you were already entitled. You further acknowledge that you have been advised, as required by the ADEA, that: (i) your waiver and release does not apply to any rights or claims that arise after the date you sign this Agreement; (ii) you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); (iii) you have twenty-one (21) days to consider this Agreement (although you may choose voluntarily to sign it sooner); (iv) you have seven (7) days following the date you sign this Agreement to revoke this Agreement (in a written revocation delivered to me); and (v) this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”).

You understand and agree that you will not receive the benefits provided by this Agreement unless this Agreement becomes effective.

You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you have under the ADEA, ADEA and that the consideration given for the waiver and release you have given in this Agreement is in addition to anything of value to which you were already entitled. ADEA Waiver. You further acknowledge that you have been advised, as required by the ADEA, are hereby advised that: : (ia) your waiver and release does do not apply to any rights or claims that may arise after the date you sign this Agreement; ; (iib) prior to signing this Agreement you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); ; (iiic) you have twenty-one (21) days to consider this Agreement (although you may choose voluntarily to sign it soonerearlier); ; (ivd) you have seven (7) days following the date you sign this Agreement to revoke this Agreement it by providing written notice to the Company’s Vice President, Human Resources; (in a written revocation delivered to me); and (ve) this Agreement will shall not be effective until the date upon which the revocation period has expired, expires which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”)Agreement.

Agreement; (iib) you should consult with an attorney prior to signing executing this Agreement (although you may choose voluntarily not to do so)Agreement; (iiic) you have twenty-one (21) days after the date of your receipt of this Agreement to consider this Agreement (although you may choose to voluntarily to sign it soonerexecute this Agreement earlier); (ivd) you have seven (7) days following the date you sign execution of this Agreement by the parties to revoke this Agreement (in a written revocation delivered to me)the Agreement; and (ve) this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it expired without your having revoked (the “Effective Date”), and you will not receive the benefits specified by this Agreement unless and until it becomes effective.

You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you may have under the ADEA, and that the consideration given for the waiver and release you have given in this Agreement the preceding paragraph is in addition to anything of value to which you were already entitled. You further acknowledge that you have been advised, as required advised by the ADEA, this writing that: (ia) your waiver and release does do not apply to any rights or claims that may arise after the execution date you sign of this Agreement; (iib) you should consult with an attorney prior to signing executing this Agreement (although you may choose voluntarily not to do so)Agreement; (iiic) you have twenty-one (21) days after the date of your receipt of this Agreement to consider this Agreement (although you may choose to voluntarily to sign it soonerexecute this Agreement earlier); (ivd) you have seven (7) days following the date you sign execution of this Agreement by the parties to revoke this Agreement (in a written revocation delivered to me)the Agreement; and (ve) this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it expired without your having revoked (the “Effective Date”), and you will not receive the benefits specified by this Agreement unless and until it becomes effective. 4.

You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you have under the ADEA, and that the consideration given for the waiver and release you have given in this Agreement is in addition to anything of value to which you were already entitled. You further acknowledge that you have been advised, as required by the ADEA, that: (i) your waiver and release does not apply to any rights or claims that arise after the date you sign this Agreement; (ii) you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); (iii) you have had more than twenty-one (21) days from March 13, 2014, (which is the date that you received the Company’s original severance offer) in which to consider this Agreement (although you may choose voluntarily to sign it sooner)the Company’s offer; (iv) you have seven (7) days following the date you sign this Agreement to revoke this Agreement (in a written revocation delivered to me); and (v) this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”).

You further acknowledge that you have been advised, as required by the ADEA, that: (i) your waiver and release does do not apply to any rights or claims that may arise after the date that you sign this Agreement; (ii) you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); (iii) you have twenty-one (21) days in which to consider this Agreement (although you may choose voluntarily to sign it soonerearlier); (iv) you have seven (7) days following the date you sign this Agreement to revoke this the Agreement (in a by providing written notice of your revocation delivered to methe Company); and (v) this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign the date that this Agreement is signed by you provided that you do not revoke it (the “Effective Date”).

You further acknowledge that you have been advised, as required by the ADEA, that: (i) your waiver and release does not apply to any rights or claims that arise after the date you sign this Agreement; (ii) you should consult with an attorney prior to signing this Agreement (although you may choose voluntarily not to do so); (iii) you have twenty-one (21) days from the Separation Date to consider this Agreement (although you may choose voluntarily to sign it sooner)Agreement; (iv) you have seven (7) days following the date you sign this Agreement to revoke this Agreement (in a written revocation delivered sent to me); and (v) this Agreement will not be effective until the date upon which the revocation period has expired, which will be the eighth day after you sign this Agreement provided that you do not revoke it (the “Effective Date”).

ADEA Waiver. You acknowledge that you are knowingly and voluntarily waiving and releasing any rights you may have under the ADEAADEA (the “ADEA Waiver”), and that the consideration given for the waiver and release you have given in this Agreement ADEA Waiver is in addition to anything of value to which you were are already entitledentitle.
