Common use of ADJUSTMENT OF THE FRAMEWORK PRICES Clause in Contracts

ADJUSTMENT OF THE FRAMEWORK PRICES. The Framework Prices shall only be varied: due to a Specific Change in Law in relation to which the Parties agree that a change is required to all or part of the Framework Prices in accordance with Clause 19.2 of this Framework Agreement (Legislative Change); where all or part of the Framework Prices are reviewed and reduced in accordance with Framework Schedule 12 (Continuous Improvement and Benchmarking); where all or part of the Framework Prices are reviewed and reduced in accordance with paragraph 7 of this Framework Schedule 3 (Supplier Periodic Assessment of Framework Prices); where a review and increase of Framework Prices is requested by the Supplier and Approved, in accordance with the provisions of paragraph 8 of this Framework Schedule 3 (Supplier Request For Increase Of The Framework Prices); or where Framework Prices or any component amounts or sums thereof are expressed in this Framework Schedule as “subject to increase by way of Indexation”, in accordance with the provisions in paragraph 9 of this Framework Schedule 3 (Indexation). Subject to paragraphs 6.11 to 6.13 of this Framework Schedule, the Framework Prices will remain fixed for the first two (2) Contract Years.

The Framework Prices or the Charging Structure shall only be varied: due to a Specific Change in Law in relation to which the Parties agree that a change is required to all or part of the Framework Prices in accordance with Clause 19.2 16.2 of this Framework Agreement (Legislative Change); where all or part of the Framework Prices are reviewed and reduced in accordance with Framework Schedule 12 (Continuous Improvement and Benchmarking); where all or part of the Framework Prices are reviewed and reduced in accordance with paragraph 7 55 of this Framework Schedule 3 (Supplier Periodic Assessment of Framework Prices); or where a review and increase of Framework Prices is requested by the Supplier and Approved, in accordance with the provisions of paragraph 8 56 of this Framework Schedule 3 (Supplier Request For Increase Of The Framework Prices); or where Framework Prices or any component amounts or sums thereof are expressed in this Framework Schedule as “subject to increase by way of Indexation”, in accordance with the provisions in paragraph 9 of this Framework Schedule 3 (IndexationOr Adjustment To The Charging Structure). Subject to paragraphs 6.11 54.1.1 to 6.13 54.1.3 of this Framework Schedule, the Framework Prices will remain fixed for the first two (2) Contract YearsFramework Period.

The Framework Prices shall only be varied: due to a Specific Change in Law in relation to which the Parties agree that a change is required to all or part of the Framework Prices in accordance with Clause 19.2 18.2 of this Framework Agreement (Legislative Change); where all or part of the Framework Prices are reviewed and reduced in accordance with Framework Schedule 12 (Continuous Improvement and Benchmarking); where all or part of the Framework Prices are reviewed and reduced in accordance with paragraph 7 6 of this Framework Schedule 3 (Supplier Periodic Assessment of Framework Prices); where a review and increase of the Framework Prices is not subject to Price Control Agreement (USO Tariff Review) but has been requested by the Supplier and Approved, in accordance with the provisions of paragraph 8 7 of this Framework Schedule 3 (Supplier Request For Increase Of of The Framework Prices); or and where Framework Prices or any component amounts or sums thereof are expressed in this Framework Schedule as “subject to increase Price Control Agreement (USO Price Tariff Review) from the Ofcom and such variation was Approved by way of Indexation”the Authority, in accordance with the provisions in paragraph 9 8 of this Framework Schedule 3 (Indexation). Subject to paragraphs 6.11 to 6.13 of this Framework Schedule, the Framework Prices will remain fixed for the first two (2) Contract Years3.
