Administrative Searches. Motor vehicles are subject to various types of administrative searches which do not require search warrants. For example, the annual motor vehicle inspection procedure is, in effect, a warrantless search.
Administrative Searches. All Keene School District administrative searches conducted will include at least one (1) member of KAPS. The Human Resources Director will contact the Association President who will propose a member for the committee. If the Human Resources Director and Association President cannot mutually agree on a KAPS member each will suggest a member and both will serve on the search committee. The parties acknowledge the benefit of having a KAPS member serve on central office administrative search committees. The Association agrees that management has the right to make the final decision on hiring.
Administrative Searches. The following are not considered invasions of any privacy interest and, therefore, do not come under the search warrant requirement of the Fourth Amendment generally:
Administrative Searches. A member may be administratively ordered to submit to a blood, breath, or urine test for alcohol and drugs under any of the following circumstances: When the member, whether on or off-duty, is involved in a shooting or duty-related death When the member is involved in an injury or fatal accident while on duty When the member is involved in an injury or fatal accident while operating any City- owned vehicle whether on or off-duty When the member is found to be exhibiting objective symptoms of intoxication or drug influence while on duty The use of compelled testing results shall be restricted to the administrative investigation. A member may be compelled to disclose personal financial information pursuant to proper legal process, if such information tends to indicate a conflict of interest with official duties or if the member is assigned to or being considered for an assignment with a potential for financial malfeasance. Members shall have no expectation of privacy in or while using offices, desks, lockers, vehicles, telephones, computers, radios, or other communications provided by the Department. Assigned lockers, offices, desks, vehicles, and storage spaces are the property of the City and may be administratively searched by a supervisor for work-related purposes (e.g., obtaining a needed report or radio); however, an investigative search of such areas should only be conducted with the approval of the Chief of Police or a designee upon reasonable suspicion that a violation of policy or procedure has occurred. All other non-assigned areas (e.g., shared desks, common office space, and shared vehicles) may be searched at any time for any reason.
