Common use of Admission of Contractor Personnel to HA Premises Clause in Contracts

Admission of Contractor Personnel to HA Premises. 25.1 Upon request from time to time by HA, the Contractor shall provide to HA a list of the names, posts, staff identity card numbers, addresses and telephone numbers of all Contractor’s employees, agents, sub-contractors and those employees and agents of the aforementioned sub-contractors (collectively “Relevant Personnel”) who may at any time require admission on behalf of the Contractor to any premises owned, managed, controlled or occupied by HA (“HA premises”) for the purposes of the Contract if so required by the HA’s/Authority Representative and in that event such list shall specify the capacities in which those persons are employed by or connected with the Contractor and shall contain such other particulars as the HA’s/Authority Representative may reasonably require. 25.2 The Contractor shall ensure that while any of the Relevant Personnel is on HA premises, they shall observe HA’s rules, regulations, guidelines and code of practice which are from time to time applicable to the Contractor’s execution of all or any part of the services at the HA premises. 25.3 The Contractor shall obtain from all Relevant Personnel consent to disclose and/or submit to HA their personal data for the purposes of the provisions of this Clause 25 and other provisions of the Contract. 25.4 The HA’s/Authority Representative reserves the right to refuse to admit to the HA premises, or the right to evict from the HA premises, any person, whose admission would be, in the reasonable opinion of the HA’s/Authority Representative, undesirable. 25.5 In the event that the Contractor fails to comply with this Clause 25 and it is determined that such failure is prejudicial to the interests of HA, the HA’s/Authority Representative may thereupon terminate the Contract. 25.6 Without prejudice to any other provision of the Contract, the Contractor shall indemnify and keep indemnified HA against all losses, claims, costs, demands and expenses that may arise out of or in consequence of any breach of this Clause 25. 25.7 The Contractor acknowledges and agrees that: (a) HA may at any time vary unilaterally the entry requirements (including any vaccination and/or testing requirements) to any HA premises; (b) it will comply with the guidelines and/or directions issued by HA from time to time on entry requirements (including any vaccination and/or testing requirements) to the HA premises.

Admission of Contractor Personnel to HA Premises. 25.1 Upon request from time to time by HA, the Contractor shall provide to HA a list of the names, posts, staff identity card numbers, addresses and telephone numbers of all Contractor’s employees, agents, sub-contractors and those employees and agents of the aforementioned sub-contractors (collectively “Relevant Personnel”) who may at any time require admission on behalf of the Contractor to any premises owned, managed, controlled or occupied by HA (“HA premises”) for the purposes of the Contract if so required by the HA’s/Authority Representative and in that event such list shall specify the capacities in which those persons are employed by or connected with the Contractor and shall contain such other particulars as the HA’s/Authority Representative may reasonably require. 25.2 The Contractor shall ensure that while any of the Relevant Personnel is on HA premises, they shall observe HA’s rules, regulations, guidelines and code of practice which are from time to time applicable to the Contractor’s execution of all or any part of the services at the HA premises. 25.3 The Contractor shall ensure that: (a) all Relevant Personnel, save for those exempted, have completed three doses of COVID- 19 vaccine or shall complete the third dose of COVID-19 vaccine within 150 calendar days (i.e. 5 months) from the date of completion of the second dose of COVID-19 vaccine (or the latest required number of doses or timeframe as specified by HA from time to time) prior to their entry into HA premises; and (b) each Relevant Personnel, save for those exempted, shall present his or her vaccination record in such form as required by HA for inspection and verification by any person authorised by HA to do so before such Relevant Personnel enters any HA premises and upon request by the HA’s/Authority Representative. 25.4 The Contractor shall maintain an updated register of vaccination status of the Relevant Personnel and submit the register to HA for inspection upon request by HA from time to time. 25.5 Exemption from the requirement to present vaccination record will be granted to those who are medically unfit for COVID-19 vaccination as supported by a valid medical certificate. The exempted Relevant Personnel are required to undertake a polymerase chain reaction (“PCR”) test using combined nasal and throat swab at Community Testing Centres once every seven days at their own expenses prior to their entry into HA premises. The Contractor shall ensure that the exempted Relevant Personnel presents his or her valid medical certificate together with the negative COVID-19 PCR testing result in such form as required by HA for inspection and verification by any person authorised by HA to do so before such exempted Relevant Personnel enters any HA premises and upon request by the HA’s/Authority Representative. For this purpose, a medical certificate will only be regarded as valid if it is a COVID-19 Vaccination Medical Exemption Certificate issued by a registered medical practitioner within the meaning of the Medical Registration Ordinance (Cap. 161) in accordance with the guidelines issued and updated by Department of Health from time to time. 25.6 For the purpose of Clauses 25.3 to 25.5, the Contractor shall comply with the entry requirement of HA premises, implementation approaches, requirement on the vaccination record and other relevant documentations to be presented, consequence of non-compliance, maintenance and updating of the register of vaccination status, and all other necessary requirements as determined by the HA from time to time. 25.7 The Contractor shall obtain from all Relevant Personnel consent to disclose and/or submit to HA their personal data for the purposes of the provisions of this Clause 25 and other provisions of the Contract. 25.4 25.8 The HA’s/Authority Representative reserves the right to refuse to admit to the HA premises, or the right to evict from the HA premises, any person, whose admission would be, in the reasonable opinion of the HA’s/Authority Representative, undesirable. 25.5 25.9 In the event that the Contractor fails to comply with this Clause 25 and it is determined that such failure is prejudicial to the interests of HA, the HA’s/Authority Representative may thereupon terminate the Contract. 25.6 25.10 Without prejudice to any other provision of the Contract, the Contractor shall indemnify and keep indemnified HA against all losses, claims, costs, demands and expenses that may arise out of or in consequence of any breach of this Clause 25. 25.7 25.11 The Contractor acknowledges and agrees that: (a) HA may at any time vary unilaterally the entry requirements (including any vaccination and/or testing requirements) to any HA premises; (b) it will comply with the guidelines and/or directions issued by HA from time to time on entry requirements (including any vaccination and/or testing requirements) to the HA premises. 25.12 Nothing in this Clause shall derogate from any requirements under the Prevention and Control of Disease Ordinance (Cap.599) (including its subsidiary legislation) and any other legislation applicable to the Contractor’s performance of its obligations under the Contract.
