Common use of ADR Ruling Clause in Contracts

ADR Ruling. The neutral in any ADR proceeding under Section 12.3 shall determine and notify the parties in writing: (a) Whether either party has committed a breach of any of its obligations under this Agreement; and (b) if either party has committed a breach, the appropriate remedy for any such breach pursuant to Section 12.5.

ADR Ruling. The neutral in any ADR proceeding under Section 12.3 16.2 relating to an alleged breach of the Agreement by either Party shall determine and notify advise the parties Parties in writing:: 16. (a) Whether 3.1 whether either party Party has committed a breach of any of its obligations under this Agreement; andand 16. (b) 3.2 if either party Party has committed a breach, ; 16. 3.2.1 whether such breach is a Material Breach or a breach other than a Material Breach; and 16.3.2.1 the appropriate remedy for any such breach pursuant to Section 12.516.4.

The neutral in any ADR proceeding under Section 12.3 2.3 shall determine and notify the parties in writing: (a) Whether either party has committed a breach of any of its obligations under this Agreement; and (b) if If either party has committed a breach, the appropriate remedy for any such breach pursuant to Section 12.5.

ADR Ruling. The neutral in any ADR proceeding under Section 12.3 24.2 shall determine and notify advise the parties Parties in writing: (ai) Whether whether either party Party has committed a breach of any of its obligations under this Agreement; and (bii) if either party Party has committed a breach, the appropriate remedy for any such breach pursuant to Section 12.5.;
