Common use of AFY Clause in Contracts

AFY. Upon agreement with the Pueblo, the Town may offset those depletions by one or more methods as follows: (a) reconfiguring diversions within the In-Town Well Field to reduce surface water depletion effects on the Buffalo Pasture; (b) transferring water rights from the In-Town Well Field to the Town’s Future Water Supply Well Field in order to reduce surface water depletion effects on the Buffalo Pasture and reducing the diversion ceiling specified at Article 6.2.2.1 by an amount equal to the transferred amount; (c) providing a quantity of water to the Pueblo equal to such surface water depletion effects on the Buffalo Pasture; or (d) any other mutually acceptable means for reducing the Town’s hydrologic effects on the Buffalo Pasture.
