Common use of Against Competitive Facilities Clause in Contracts

Against Competitive Facilities. The District will not, to the extent permitted by law, acquire, purchase, maintain or operate and will not, to the extent permitted by law and within the scope of its powers, permit any other public or private agency, corporation, district or political subdivision or any person whomsoever to acquire, purchase, maintain or operate within the District any water system competitive with the Water System.

Against Competitive Facilities. The Except for any water system existing as of the date hereof, the District will not, to the extent permitted by law, acquire, purchase, maintain or operate and will not, to the extent permitted by law and within the scope of its powers, permit any other public or private agency, corporationauthority, district city or political subdivision or any person whomsoever to acquire, purchase, maintain or operate within the District any water system competitive with the Water SystemEnterprise; provided, however, that the District may, with the prior written consent of the Lender, assign all or a portion of the Enterprise to another entity provided such entity assumes the obligations of the District hereunder.
